D'Ombrain 0' the Pacific CDls & Electric C.o. addressed the moard, stating that the rate tor street light1ng was about to be reduceci and requesting permission to submit at the nex~ meeting plans for better lighting at the reduced rates and tor main- taini~g the street lights in repair. This being the time set tor the hearing in the case ot Jt>hn Ratti, to show cause why his permit and license to sell sott drinks should not be revoked, said John Ratti appeared before the Board and adm1tted receiving, a copy ot the petition and .'ftdavit and also the citation, to appear, served on him by the Marshal. Town Clerk Elmer G. Still was then sworD by :bge President of the ]foard, and testified; that Ordinances N~s. 104, 107 and 110 were still in effect and had not been repealed and that the permit and license issued to said John Ratti to sell sott drinks were still in ettect and had not been revoked or cancelled. Town Marshal D. F. Bernal was next sworn, and testified: that he was pres en tat said John Ra t ti' s trial in the Recorder's court on: January 2d, 1923, and that Ratti pleaded guilty and was tined. $300 for violating ordinanae No. 110. John Ratti then stated to the Board that he would like to be given another cgance and promised that he would "never sell any more liquor." RESOLUTION REVOKING SOFT-DRINK PIillMIT AND LICENSE. "Whereas, on the 22d day ot August, 1921, the BOard ot Trustees ot the Town of Livermore, County ot Alameda, state of Calitornia, granted. to John Ratti a permit to conduct the business of'selling, malt and cereal beverages and sott dr1nks at '~atti's Place' on the south side ot East First street between Lizzie and MCLeod streets, Livermore, calitorniaj and "Whereas, the Clerk ot the Town ot Livermore did on the 22d day of November, 1922, regularly issue to said John Ratti a license to sell malt and cereal beverages and sott drinks, to-wit: Number 2362, tor the peri~d of three months, to-wit, from November 22d, 1922, to JAN ;2 J 1923 871 February 2d, 1923, in the name of John Ratti at 'Ratti's Place', Liver- more, calitornia; and "Whereas, the Board ot Trustees ot the Town ot Livermore have, by ordinance regularl'J and duly passed, made and provided an ordinance regulating the business ot selling and the sale or otherwise disposinS of mal~ and cereal beverages and soft drinks, and regulating the keep- ing or maintaining ot any place tor such business or tor the sale or otherwise disposing ot any such malt and cereal beverages and sott drinks in all portions ot the Town ot Livermore, as amended Januar'J 17th, 1921; and "Whereas a petition has been filed with the Clerk ot this SOard by the Marshal ot the Town ot Livermore, which petition has affixed thereto an atfidavit setting torth that said John Ratti has, by sell- ing and. having in his possession intoxicating liquor containing mor& thsnone-half of one per centum or' alcohol by volume in violation ot ordinance No. 110 ot the TOwn ot Livermore and N.a tional Prohibition Act, violated the permit and license heretotore issued to said John Ratti by this SOard ot Trustees; and "Whereas said ordinance aforesaid provides that upon suffic1ent cause being shown or proof.' turnished to this Board ot Trus tees that any person holding a perm! t or license thereunder has violated any o~: the proviSions ot said ordinance regulating the businesses mentioned in sections 47 and 48 ot said Ordinance or any law ot the State of calitornia or ot the Government of the United States, the llfOardc-,01t Trustees shall after not1ce g1ven to the person holding such permit or license, and a hearing had, revoke, cancel, withdraw or suspend the permit and license issue. and granted under said Ordinance; andl. "Therefore, be it resolved by the Hoard ot Trustees. of the Town of Livermore, County ot Alameda, state of calitornia, that the permit and license heretotore granted to John Ratt1, and under which said permit and license said John Ratti is now carryi#g~ on his business, and which said permit and license was issued to said John Ratti to carryon and conduct the business ot selling malt and cereal beverages and sott drinks at 'Ratti's Place,' on the south side of East First street between Lizzie and MCLeod streets, Livermore, California, be and the same is hereby revoked, annulled, forteited and set aside, and "Be it turther res ol ved that this 8'oard of Trus tees does. by this resolution, hereby revoke, forteit, set aside and annul an~ . and all permits and licenses under which aaid John Ratti or any assignee of said John Ratti is now doing business, upon the premises occupied by the said John Ratti at 'Ratti's Place,' on the south side of East First street between Lizzie and MCLeod streets, Livermore, Calitornia, and the permit and license hereby revoked, annulled, fortelted and set aside are detined to be any permit or liceaae granted under said Ordi- nance No. 104 as amended, and which said ordinance and amendment theEeto were adopted by this Board ~or. the ,.punpose ot regulating the conduct and sale of malt and cereal beverages and soft drinks in the Town ot Li V8rmore . II HEARING OF CASE OF HARRY CmRUTI. This being the time set for the hearing in the case ot Harry cerruti, to show cause why his permit and license to sell soft drinks should not be revoked, said Harry Cerruti appeared before the g~ard. Eby, as chai~man"ot a committee from the Chamber ot Commerce, addressed the BOard, advanc~ reasons why the Board should adopt an ordinance requiring house-numbering on all the town's streets, espec- ially as an aid in directing strangers. E. W. D'Ombrain also addressed the Board in regard to the matter, as local agent for the Pacific Gas & Electric Co., stating that the compan, would be g~ad to co-operate by furnishing without: charge prints o~' blocks and other nec..aary data. The President gave assurance, on behalf of the Board, that the requiring: ot house-numbering and also the erection of street signs would be carried ou~ at the B~ard's earliest convenience. DISCUSSION IN RE TEMPORARY CLOSING OF SIXTH STREET. Chairman T. W. Norris of the BOard ot Trustees of- the Liver- more Grammar School requested that Sixth street between :t and' J be temporarily closed to traftic again during seh.ool hours until the end of. the school term in Junct, 1924, and a prolonged discussion ensued in which SchoCl. Trustees Norris, E. J. Lawless and 0;. I. N~ssen, Chas. W. and Fred Zimmerman, and the 1Jlembers of the Town Hoard participated. Chas. W. and Fred Zimmerman objected to the street being closed tor so long a time, maintaining that negotiations for the purchase of their residence property on the part of the street in question should be consummated without further delay. M):>. lforris stated that the School Trustees :-had acquired several lots in .the same~(lU.ock as theZinnnerman property as addi- tional needed playgrounds for the school children and that closing the street in question was necessary in order that the children might sately pass to an4 from the schoQa ~lock and. because many children played in this street itself, .and also stated. that the School Trustees had been unable to induce the Zimmer~ans to accep~ a fair and reasonable price for their property, but'- the.t on the contrary they had increased their proffered sale-price for their place, an&had refused to leave t~e matter to impartial arbiters. Zimmerman brothers stated that the value of their property had increased in the past ye~. or two by reason of the greatly in- creased cost ot erecting new buildings, but that, at the solicitation ot President Rees, the~ had finally agreed to accept $3,850 for their property. Mr. Norris stated that the School Board had a fund of $3,500 available for the purpose and consid~red that a high price for the proper ty.
