HomeMy Public PortalAbout12-27 Adopt the Future Land Use Map and Text Amendments 1st Reading: October 10, 2012 2nd Reading: October 24, 2012 Public Hearing: October 24, 2012 Adopted: October 24, 2012 Effective Date: October 25, 2012 Sponsor: City Manager ORDINANCE NO. 12-27 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO ADOPT THE FUTURE LAND USE MAP AND TEXT AMENDMENTS, AMEND THE PARKS AND RECREATION ELEMENT TO THE CITY;S COMPREHENSIVE DEVELOPMENT MASTER PLAN, AND AUTHORIZE THE TRANSMITTAL TO THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY FOR FINAL ADOPTION; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City Commission of the City of Opa-locka desires to amend the City's Comprehensive Development Master Plan by creating the Transit Oriented District (TOD) Overlay Classification; and WHEREAS, Policies 7.1 and 7.2 of the Comprehensive Development Master Plan, adopted by the City Commission in 2011, states that the city should adopt ordinances which encourage mixed-use development and higher density residential projects; and WHEREAS, On July 25, 2012, the City Commission adopted an Ordinance amending the Comprehensive Development Master Plan by creating the TOD Overlay Classification, amending the future land use map, updating the park and recreation element and authorizing the transmittal to the FDEO to initiate their review. NOW,THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AS FOLLOWS: Section 1. Recitals The recitals to the preamble herein are incorporated by reference Section 2. Adoption The amendment set forth in Exhibit "A" attached hereto and made a part hereof, is hereby adopted, and the City Manager is authorized to transmit it to the Florida Department of Economic Opportunity. Section 3. Interpretation of Captions All headings of articles, sections, paragraphs, and sub-paragraphs used in this Ordinance are intended for the convenience of usage only and have no effect on interpretation. Section 4. Providing for Repeal of Laws in Conflict All local laws and ordinances in conflict with any provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 5. Severability If any section, paragraph, sentence, clause, phrase, word, map, diagram, or any other item contained in this Ordinance is for any reason held by the Court to be unconstitutional, inoperative, void, or otherwise invalid, such holding shall not affect the remainder of this Ordinance. Section 6. Inclusion in the Unified Land Development Regulation Code The provisions of this Ordinance shall be codified in the Unified Land Development Regulation Code and may be reorganized, renumbered, or re-lettered to effectuate the codification of this Ordinance. The City Commission authorized transmittal of this information to the state (DEO). The Florida (DEO) Department of Economic Opportunity has provided comments, as have many of the other reviewing agencies. These responses are incorporated in the attached ordinance. Upon adoption, this document will be transmitted to the DEO for its final review of the proposed CDMP amendment. There are no objections from the Florida Department of Economic Opportunity (FDEO)at this time. Brown,Jr. Community Development Directo Gerald Lee, City Planner 2 PROPOSED CDMP TEXT Policy 1.2 of the Future Land Use Element is amended to add the following additional text (existing text in grey, new text in underline): TRANSPORTATION Streets, roadways, alleys and railroad as needed. UTILITIES Communications, water and sewer facilities, electrical as needed. TRANSIT ORIENTED DEVELOPMENT Residential Uses(up to 150 units per gross acre), OVERLAY not to exceed 1,755 total units within the Opa- Locka Tri-Rail Station TOD. All uses otherwise permitted in the underlying land use classification. Section C.d. of the Future Land Use Element is amended to add the following additional text (existing text in grey, new text in underline): Utilities - Standards related to utilities are largely dependent upon the requirement of tile particular facility being considered. Since utilities are often located within street right-of-ways, their placement should be carefully coordinated with street plans. Residential areas should be protected from sewage treatment plants and related disposal uses by open space or other protective measures. The amount of land uses exclusively for utility purposes (communications, electrical included) normally represent about 1/2 of Pl b of the total land area of the community. Many of these uses are considered in other elements of the comprehensive plan. 10. (TOD) Transit Oriented District- This overlay district provides for additional residential uses in areas served by transit infrastructure. Property shall only be eligible for designation with a TOD overlay when located within one-half mile of an existing transit station. The district's close proximity to transit will support a variety of moderate and high-density development. The specific objectives of this district are to: -Encourage people to walk, ride a bicycle or use transit; -Allow for a mix of uses designed to attract pedestrians; -Achieve a compact pattern of development more conducive to walking and bicycling; -Provide sufficient density of employees, residents and recreational users to support transit; and, -Generate a relatively high percentage of trips serviceable by transit. Residential uses will be permitted within all underlying future land use designations in the TOD overlay district. All other uses otherwise permitted in the underlying future land use classifications may be developed separately, in combination with the residential use, or replaced by residential use, as long as the development is in compliance with the building envelope requirements of the underlying future land use designation, including(but not limited to)restrictions on height andpervious/impervious areas. However, the maximum number of residential units permitted within the TOD shall not exceed a fixed number,to be assigned to each TOD district area. The total number of units permitted for the initial TOD district area for the Opa-Locka Tri-Rail station shall be 1,755 units. According to the department's responsibilities under Section 163.3184(3)(b), Florida Statutes, I reviewed the amendment package considering provisions of Chapter 163, Part II, F.S., and to determine whether the proposal, if adopted, would have potential to create adverse impacts on public school facilities. The proposed amendment package relates to the proposed transit-oriented development district and proposes increasing residential densities to permit development of up to 1,755 units in the affected area. According to the data and analysis provided, adequate school capacity is available in the affected or adjacent concurrency service areas. The City is adjacent to the municipalities of North Miami, Hialeah, and unincorporated Miami-Dade County. The City is approximately four square miles, with a 2010 population of 15,419. The City is home to the Opa-locka Executive Airport and located in close proximity to the North Campus of Miami-Dade College, both of which serve to encourage population growth and development within the area. The City is also in close proximity to Northwest Dade Industrial Area and shares a FIea Market with the City of Hialeah, both of which serve as centers of employment in north Miami-Dade County.Opa-locka has a Tri-Rail station within walking distance of the downtown area. Opa-locka is primarily a residential community(70 percent),with a small Commercial (16 percent) area. Less than two percent of the land area is developed for Industrial uses. Approximately 391.03 acres of vacant land are within the city. Large scale development of these parcels is not possible because the parcels are scattered. Opa-locka is seeking annexation of an additional 883.2 acres of land in unincorporated Miami-Dade County. A general location of the City is shown in Attachment 1. DESCRIPTION OF AMENDMENT Amendment 1 I Future Land Use Element Proposed amendment#12-1ESR includes the creation of a Transit-Oriented Development(TOD)Overlay land use classification. The TOD Overlay would add Residential uses to the application area,defined as "areas served by transit infrastructure", as well continuing to authorize the uses permitted by the underlying land use classifications (see Attachment 2). The proposed change notes that Residential will have a density of 150 dwelling units per gross acre with a maximum of 1,755 residential units. The amendment is not written as a Comprehensive Plan Policy, rather as a legend entry on the Future Land Use Map. It is not clear if the TOD's density and maximum units are the standards for its use in any area of the city that may be subsequently designated as a TOD or solely the proposed application area. The analysis accompanying the amendment uses a Floor Area Ratio of 3.0 for the Commercial, Industrial, Public Buildings/Facilities, Semi-Public, and Utilities land use categories; however, the City's Comprehensive Plan nor the proposed amendment include intensity standards. Objection The TOD Overlay land use classification would not be authorized by a Policy in the Comprehensive Plan. In addition, the proposed legend entry does not provide an adequate definition of a TOD nor does it provide guidance on densities,intensities,the allowable mixed uses, and percentage distribution of uses within the TOD. Recommendation The City should develop a Comprehensive Plan Policy authorizing the TOD Overlay land use classification. The Policy should include additional criterion regarding where the TOD Overlay land use classification may be applied in the future. Section 163.3164(46),Fla. Stat.,the Community Planning Act, includes a TOD definition that the City could employ.1 The Policy should also clarify the density and maximum number of residential units and include intensity standards. 1 "Transit-oriented development means a project or projects, in areas identified in a local government comprehensive plan, that is or will be served by existing or planned transit service. This is based on a mix-use distribution of 50% residential, 20% retail, and 30% general office. It is not clear what mechanisms the Comprehensive Plan will employ that would limit the amount of development from the maximum permitted to the proposed development plan. In addition, General Office and Retail are not authorized uses in the Industrial, Public Building/Facilities, Semi-Public, and Utilities land use categories. The analysis indicates there would be an increase demand of 128,115 gallons per day of sanitary sewer and potable water;a reduction in solid waste by 4,111 tons per day;an increase of 7.27 acres of recreation and open space;and a reduction of 40,366 daily trips,which translates to a 2,808 AM Peak Hour and 5,760 PM Peak Hour. Objection The proposed amendment is not adequately supported by an analysis of the impacts of the addition residential development and increased intensities and the type of development allowed by land use. Recommendation The City should provide data and analysis reflecting the projected number of additional trips to local, state, and regional roads that would result from the increases in residential and non-residential development based on the levels authorized by the Comprehensive Plan. A similar analysis for sanitary sewer,potable water,recreation and open space,and solid waste should also be provided. 1. The transit station and adjacent areas are designated as a Community Urban Center (CUC) on Miami-Dade County's Adopted 2015-2025 Future Land Use Plan map. Community Urban Centers are areas encouraged to become hubs of future urban development intensification and planned and designed to promote transit oriented development, with a mix of residential, retail, professional, institutional, cultural, open space, and pedestrian friendly environments that promote the use of rapid transit. CUCs shall have a radius of 700 feet to a one-half mile radius where recommended in a professional area plan for the center. Thus, the proposed TOD Overlay District area is consistent with the Miami-Dade County Comprehensive Development Master Plan. However, the proposed high density of 150 DUs/Acre and 3.0 FAR seems to be out of character with the adjacent neighborhood. 2. The City should identify the proposed TOD Overlay District as a land use category on its Future Land Use Plan Map. Also, the City should adequately define the land use Howard W. The proposed TOD Overlay District provides for more intense mixed-use development which will cause an increase in trip generation, causing more impact on the adjacent and regional roadway network. 4. The proposed TOD Overlay District is located east of the Opa Locka Executive Airport. The City is advised that any proposed use on the referenced parcel must comply with all applicable local, state and federal aviation regulations including the Code of Miami-Dade County, Chapter 33, Airport Zoning. 5. The City of Opa Locka is a wholesale water and wastewater customer of the Miami- Dade Water and Sewer Department. Based on the Department's review and calculations, the intensities and densities of the land use designations would result in an increase of approximately 10,759 daily trips. We recommend that the study be revised to reflect the trip generation increase by assuming the addition of the 1,755 residential units. The amendment does not address how the transit oriented development will reduce automobile trips. • Trip Distribution and Assignment: Assuming that a revised study will show an increase in trip generation, the analysis should show where the additional trips will be added on the system using an assumed trip distribution pattern based on regional and local trends. • Mode Choice and Internal Capture: The May 2012 traffic study does not discuss how the transit, pedestrian, and bicycle facilities would support the TOD overlay. This discussion is key to the study given the City's intent to create a transit-supportive environment through the amendments. The amendment should specify the type of transit service required for the TOD overlay and how it will be provided. We also recommend providing guidance about walkability, connectivity, mix of uses (e.g., land use mix percentages), and so forth in the TOD overlay text so that the site's potential to develop as a transit-supportive environment can be maximized. Lastly, we were unable to determine how the study's internal capture percentages were calculated and we recommend that this component be revised. • Network Impact and Mitigation: The revised study should identify impacts to the transportation system (both roadway and transit) and identify necessary mitigation needed to maintain the City's level-of-service standards. Alternatively, the City can revise the amendments to limit intensity and density in the study area to levels that would not result in impacts. The concept of'de minimis impact' appears to be misused within the traffic study.
