AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA,FLORIDA,TO AUTHORIZE THE
CITY MANAGER TO ENTER INTO A SEVEN-YEAR
CONTRACT WITH ENVIRONMENTAL PRODUCTS,INC.
TO LEASE PURCHASE AN ELGIN BROOM BEAR
STREET SWEEPER,IN AN AMOUNT NOT TO EXCEED
$47,031 PER YEAR, PAYABLE FROM ACCOUNT 43-
538640; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR CONFLICT AND
REPEALER; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS,pursuant to Resolution No. 12-8372, the City issued Request for Proposals
(RFPs) for a mechanical street sweeper; and
WHEREAS,three bidders responded to RFP 12-3105200 for lease purchase of an efficient
mechanical street sweeper; and
WHEREAS, the Elgin Broom Bear Mechanical Street Sweeper is $47,031 a year, per a
seven year period, at a total cost of$329,217, including maintenance and interest, with the City
owning the Sweeper at the end of the seven years; and
WHEREAS, the RFP Evaluation Panel analyzed the street sweeper specifications and
recommended the contract be awarded to Environmental Products, Inc., based on reliability,
durability, economical feasibility, and product demonstration of the Environmental Broom Bear
Street Sweeper; and
WHEREAS,the City of Commission of the City of Opa-locka desires to authorize the City
Ordinance No. 12-28
Manager to enter into contract with Environmental Products,Inc.to lease purchase an Elgin Broom
Bear Street Sweeper, payable from account 43-538640.
NOW,THEREFORE, BE IT DULY ORDAINED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka, hereby authorizes and
directs the City Manager to enter into a seven-year contract with Environmental Products, Inc. to
lease purchase an Elgin Broom Bear Street Sweeper,in an amount not to exceed$47,031 per year,
at a total cost of$329,217, payable from account 43-538640, in substantially the same form
attached hereto.
Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4. SEVERABILITY. If any portion,section,phrase or clause of this Ordinance is
held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the
remainder of this Ordinance.
Section 5. CODIFICATION. This ordinance shall be codified in the Code of Ordinances
when the code is recodified.
Section 6. EFFECTIVE DATE. This Ordinance shall upon adoption, become effective
immediately

efficient mechanical street sweeper on a commercial chassis with fully dualized controls and a single engine
design usable in heavy construction debris or light street maintenance to keep the city clean.The evaluation
committee analyzed the Street Sweeper Specifications and the terms and conditions for the lease-purchase offers
of all the three bidders for reliability, durability, and economical feasibility. After a very comprehensive evaluation

Description: The City of Opa-locka requested and received proposals from three bidders for proposal is
to lease purchase efficient mechanical street sweeper on a commercial chassis with fully dualized controls

Environmental Products, Inc. On Thursday, June 21, 2012 the City received a demonstration of the
Environmental Broom Bear Street Sweeper at the Public Works yard. The financial offer from
Environmental Products,Inc. is tabulated below:

Financial Impact: The cost to lease purchase Elgin Broom Bear Mechanical Street Sweeper is
$ 47,031.00 per year for seven years. The total payoff amount is $329,217.00 including maintenance and
interest. At the end of the seven year payments the City will own the Sweeper.
Implementation Time Line: As soon as possible.

Recommendation(s): Staff recommends approval in order to keep the city clean.
Analysis: Street sweeper will be used for the proper maintenance of all the roads and streets in the city.
The street sweeping is highly recommended nonstructural Best Management Practices (BMPs) by Florida
Department of Environmental Protection Agency to keep the city in compliance with Municipal Separate
Storm Sewer System (MS4)permit with the State of Florida. The use of street sweeper will reduce the
maintenance cost of the City's storm water system.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA TO AUTHORIZE THE CITY MANAGER TO ISSUE A
REQUEST FOR PROPOSALS (RFP) TO LEASE-PURCHASE AN
EFFICIENT MECHANICAL STREET SWEEPER CAPABLE OF
HANDLING HEAVY CONSTRUCTION DEBRIS OR LIGHT STREET
MAINTENANCE,PAYABLE FROM ACCOUNT NUMBER 43-538640;
PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS the lease-purchase of a mechanical street sweeper will provide support in the
proper maintenance and cleanliness of all roads and streets in the City of Opa-locka,and reduce the
maintenance cost of the City's Storm Water System; and
WHEREAS, the Request for Proposals will be for the lease-purchase of an efficient
mechanical street sweeper of a commercial chassis with full dual controls, single engine design,
capable of handling heavy construction debris or light street maintenance; and
WHEREAS,the City of Commission of the City of Opa-locka desires to lease-purchase an
efficient mechanical street sweeper, cost dependent on responses from the RFP, to be allocated
from Account#43-538640, Storm Water Management Machinery&Equipment.
NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA,FLORIDA:

TOTAL COST OF OWNERSHIP
AGREEMENT
The intent of this agreement is to describe special terms and conditions for the City of Opa
Locka to lease with vendor maintenance, (Elgin Broom Bear sweeper). The proposal is written
to insure that equipment operated by you will provide the lowest total cost during its useful life.
The proposal is supplemental to the (Elgin Broom Bear Sweeper) Technical Specifications.
DEFINITIONS:
• The term "you" shall mean the City of Opa Locka.
• The term "EPOFC" shall mean Environmental Products of Florida Corporation,
the dealer who represents the manufacturer of the equipment being proposed.
• The term "Fleet Management" shall mean Fleet Manager or his/her designated
representative, wherein the equipment will be operated and maintained.
• The term "EPOFC Principal" shall mean the principal person or his/her
designated representative of EPOFC, whom this contract shall apply.
• The term "normal work day" shall mean a day which falls on or between
Monday and Friday of the calendar week, 52 weeks a year, excluding city
holidays. A list of all city holidays shall be supplied to the EPOFC from you
upon award of this contract.
• The term "normal working hours" shall mean the time period of a normal
workday when City of Opa Locka main equipment shop and/or maintenance
facility is normally open for operation. You shall supply EPOFC with this
information upon award of this contract.
• The term "in-service date" shall mean the date the City of Opa Locka places the
unit in operation. The City of Opa Locka will notify the EPOFC Principal of
the in-service date.
• The term "downtime" shall mean the period of time measured in normal work
days that the unit is unable or unsafe to perform those operations for which the
unit was designed.
1. The lease period shall be for a seven (7) year term.
2. Training will consist of 2 days on site, which will cover the daily maintenance of the
machine as well as operation training and proper broom pressure adjustments.
3. City of Opa Locka is responsible for providing fuel, insurance, (nozzles, debris
hose, brooms, common wear items) and operator for the (street sweeper).
Original equipment items listed in this paragraph to be utilized and will be
supplied at fleet pricing.
4. City of Opa Locka is responsible for the daily maintenance of the (Elgin Broom
Bear sweeper) in accordance with instructions from EPOFC and/or the
manufacturer.
5. EPOFC is responsible for the cost and labor of the following:
a) Chassis and related components except tires
b) (Elgin Broom Bear sweeper) and related components
c) All weekly annual maintenance requirements
6. EPOFC shall be fully responsible for transporting to and from your facility, at
no cost to you for any repairs or maintenance required, if said repairs or
maintenance cannot be completed at City of Opa Locka site.
7. This proposal is based on maximum average annual usage of the (Elgin Broom
Bear sweeper) equipment of 2,400 engine hours per year. An hourly charge of
($75 Sweeper) will be invoiced for hours exceeding 2400 annual engine hours
per year.
8. EPOFC shall guarantee that the equipment purchased under this contract will
be available for operation at least 95% of normal workdays. EPOFC shall
guarantee that the equipment purchased under this contract will not be out of
service for more than three (3) consecutive, normal work days, nor more than
five (5) normal workdays, in any 100 consecutive, normal work day period.
9. Equipment availability shall apply to equipment put out of service due to faulty
parts, components, or equipment design, which render the unit unable or unsafe
to perform those operations for which the unit is designed. City of Opa Locka
supervising personnel, after inspection will determine in conjunction with an
EPOFC Principal, if the unit was inoperable or unsafe. Equipment availability
shall not apply to equipment during routine maintenance or equipment put out
of service due to theft, vandalism, accident, City of Opa Locka personnel
negligence or act of God.
10. The unit will be considered out of service starting the first normal workday,
following EPOFC notification by City of Opa Locka that the unit is inoperable
or unsafe and requires repair. Therefore, the downtime clock will start at the
beginning of the first normal workday, following such notification. City of
Opa Locka Fleet Manager will notify the EPOFC Principal during normal
working hours of a unit that is out of service and requires repair. The unit will
be considered in service (operational) starting the first normal work day

following the completion of the repair and/or return of the repaired unit.
Therefore, the downtime clock will stop at the beginning of the first normal day
following the repair completion or return of the repaired unit.
11. Equipment availability or in-service percentage (uptime) will be computed by
the City at the end of each 100 consecutive, normal work day period, beginning
from the in-service date, using downtime increments of normal work days. The
City will use the following formula to compute equipment availability at the
end of each 100 consecutive, normal work day period: Equipment Availability
= [(100 Days -Downtime)/100 Days]x 100%
NOTE: The term "Days" refers to normal work days. The term "Downtime"
refers to the total downtime accumulated during the 100 consecutive, normal
work day period.
12. EPOFC will credit City of Opa Locka a daily amount of equal to 1/365th of the
annual charge for each normal workday required to provide 95% availability in
the event a replacement unit is not available.
13. EPOFC will provide a relief unit should repair downtime be more than three (3)
consecutive normal workdays. All costs associated with securing and
delivering the relief unit shall be at EPOFC's expense, with no cost to City of
Opa Locka. The relief unit must be functionally equivalent to its replacement.
14. This guarantee shall be in effect for a period of seven (7 years). Time will be
measured in calendar years from the in-service date and engine hours will be
recorded on the electric, solid state hour meter provided with the unit.
15. Insurance required: a.) Auto Physical Damage/Collision coverage for the full
value of the equipment (TBD) b.) Automobile Comprehensive/Theft coverage
for the full value of the vehicle (TBD) c.) Auto Liability Insurance in the
amount of $1,000,000.00. All coverage's shall be evidenced by Certificate of
insurance naming Environmental Products of Florida Corporation and its
finance company as additional insured and loss payees.
16. City of Opa Locka is responsible for payment of Title and License Plate Fees.
Maintenance agreement costs are $12,000 per year for a total of 5 years. This
is paid annually in advance and is built into your single annual lease payments.
17. Rate: 2.87%/Term 7 years annual in advance
Annual lease payment $33,925.36
Annual maintenance payment (years 1-5) $12,000.00
Total Payment (years 1-5) $45,925.36
Total Payment (years 6-7) $33,925.36

To commence the maintenance contract please acknowledge below with a signature. The
maintenance contract start date will be recorded by EPOFC the day that the machine is
put into service by the City of Opa Locka.

Rose we came up with$3,500 for the trade and we will have it picked up. The last two of these old sweepers to sell at a
local auction was two years ago at the City of Miami Beach. Their machines were around the same age and they went
for$3,500 each. You can Google a "1997 Elgin Pelican sweeper for sale" and see what you come up with. This machine
needs quite a bit of work to resell for a decent price. There are a lot of this vintage Pelicans out there for sale.
