Mayor Nunamaker at 7:30 P.M.

6. ORDINANCE NO. 63 -111: Controlling Installation of Bus Be;,ches
within the City. City /attorney Shatford read title to Ordin-
ance No. 63 -111 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING
THE MUNICIPAL CODE BY ADDING 'ROVISIONS ESTABLISHING CERTAIN
REGULATIONS 'WITH REFERENCE TO BENCHES IN PUBLIC STREETS, stating
this was the second reading. Councilman Tyrell moved to waive
further reading, seconded by Councilman Dickason and carried by
the following roll call vote:

7. REPORT ON PROPOSED POLES FOR CHRISTMS TREE LIGHTS:
City Manager Woollett explained the or000sal with surrorting
map showing existing and proposed locations of poles. The cur-
rent situation is makeshift and not entirely safe. The entire
program would cost an estimated$14,V0. but could be broken down
over a period of years. After considerable discussion Council-
man Fitzjohn moved to appropriate $2,900. to add to ts'e $1,000.

8. ORDINANCE NO. 63 -109: Establishment minimum public Street
Frontage on a Residential Lot as 35 ft. - 2nd reading.
City Attorney Shatford read title to Ordinance No. 63 -109 AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMEND-
ING ORDINANCE NO. 63 -107 TO CLARIFY AND MAKE CERTAIN NO LOTS
SHALL BE DEVELOPED OR CREATED HAVING LESS THAN 35 FEET MINIMUM
FRONTAGE IN CONFORMITY WITH ORDINANCE N0. 63 -103. Councilman
Tyrell moved to waive further reading, Councilman Merritt
seconded, roll call vote as follows:

PUBLIC HEARING: 7 :30 P.M. - CURB, GUTTER & SIDEWALK
a. Golden West, east side, Flaherty to Garibaldi, curb, gutter
& sidewalks
b. Longden, north side, Golden West to Salter, curb, gutter and
sidewalks
c. Rancho Real, north side, Sultana to Loma, curb and gutter
d. Rancho Real, south side, Sultana to Loma, curb and gutter
e. Longden, north side, Salter to east city limits, curb,
gutter and sidewalk.
The City Manager presented the above petitions each signed by
at least 60% or more of the front footage of the property owners.
Councilman Tyrell moved to open the public hearing, seconded by
Councilman Fitzjohn and carried.
Mr. Ken Walter, 9129 Rancho Real spoke in opposition to item
"c" stating that the present 40 ft. street would be narrowed to
36 ft. after curbs and gutters were put in and felt this was
too narrow for safe passage of cars if there should be a care
parked on either side of the street directly opposite one another.
Mr. & Mrs. Dan Kelty, 9056 Rancho Real stated they wished to
now sign the petition, although they objected very strongly to
the way in which the petition was presented to them. Felt the
City should send letters to all property owners before a peti-
tion is circulated which would state all the facts. City Mana-
ger Woollett apprised the Kelty's of the fact that the City is
not in a legal position to interfere in any way until the prop-
erty owners indicate their wishes.
Councilman Tyrell moved to close the public hearing, seconded
by Councilman Fitzjohn and carried. Councilman Tyrell moved to
determine the improvements to be in the public interest and to
instruct the Road Supt. to cause the work to be done, seconded
by Councilman Dickason and carried by the following roll call
vote:

PUBLIC HEARING: 7:30 P.M. - ORDINANCE NO. 63 -112 - ZONING ORDINANCE:
Planning Advisor Cushman advised that this is a regulatory or-
dinance supplying the conditions under which the zoning map
will apply when it has had its hearings and been adapted.
Councilman Merritt moved to open the Public hearing, seconded
by Councilman Dickason and carried,
After a brief recess, City Attorney Shatford read the last
paragraph of the ordinance which states that this Ordinance be-
comes effective upon the adoption of the new zoning map and it
shall become a part of the Ordinance and the old ordinance under
which the City is now operating is repealed and rescinded. The
new one will not become effective until such time as a new zoning
map is agreed upon and adopted, at which time the present one

will become extinct.
Councilman Tyrell moved to waive further reading of Ordinance
No. 63-112, seconded by Councilman Dickason and carried by the
following roll call vote:

Mayor Nunamaker asked if anyone wished to come forward.
Mr. B. L. Meek, 9556 Woodruff Ave. asked about R -3, 4 and C
zones as applied to the present zoning, stating that C -1 zone
is now eliminated. Mr. Cushman advised that new zoning has both
R -3 and R -4 and is basically the same as present with the ex-
ception that new ordinance wil..l designate the lot area Per dwell-
ing. In place of C -1 zoning there will be a CC Zone (Commercial
Center). All C zones will be exclusive and will not Permit
residences.
Don Secres, 10249 Green St. expressed concern over the increased
minimum lot size in residential zones from 5,000 sq. ft. tc
7,200 sq. ft., and was advised by the Planning Advisor that all
existing property cuts would be recognized as legal building
sites regardless of square footage. There are over YO Parcels
of legal record under 4000 sq. ft. Any new Parcels would have
to maintain a minimum of 72x:.0 sq. ft.
Mrs. Georgia Maxey, 9823 Hallwood Dr. wondered if it would not
be wise to hold in abeyance the adoption of the ordinance it-
self until after the public hearings were held. City Attorney
Shatford advised that there must be a starting place and the
adoption of the ordinance was the logical place to start, but
that it would be possible to amend parts of the ordinance.
Councilman Dickason moved to adopt Ordinance 63 -112 seconded
by Councilman Fitzjohn and carried by the following roll call
vote:

PUBLIC HEARING: 8:00 P.M. - ASSESSMENT OF PROPERTY FOR CONSTRUCTION
OF CURB AND GUTTER, 5306 Weiland Dr.
City Manager Woollett explained that pursuant to the Petition,
a public hearing was held on Nov. 12, 1962, work has been com-
pleted and the street has been paved out with everything approved
The total cost for the project is $1,251.56 and the share at
5306 Welland (62 lin. ft.) is $166.16. This public hearing is
to determine those for and against this assessment.
Councilman Tyrell moved to open the public hearing, seconded by
Councilman Fitzjohn and carried. No one spoke either for or
against this assessment and Councilman Fitzjohn moved to close
the public hearing, seconded by Councilman Tyrell and carried.
Councilman Tyrell moved to adopt Resolution No. 63 -3�.:( assessing
the property at 5306 Welland Dr., seconded by Councilman Fitzjohn
and carried by the following roll call vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker

ABSENT: Councilmen -None
PUBLIC HEARING: 7:45 P.M. - REQUESTED ZONE CHANGE EAST SIDE ROSEMEAD
BETWEEN HERMOSA & GARIBALDI FROM R -1 to C -1, B. L. Meek. et al
Planning Advisor Cushman stated that there are 17 ownerships in-
volved in this request, of which 3 owners have signed the pe-
tition. No development plan was submitted. The surrounding
area is fully developed in single family dwelling .units.
Councilman Tyrell moved to open the public hearing, seconded
by Councilman Merritt and carried.
Mr. B. L. Meek spoke in behalf of the other parties and stated

that there were a total of 15 signatures, the rest being on the
2nd page of the petition. The reason for the requested zone
change stems From the fact that Rosemead Blvd. is a main highway
with C -2 and 3 and M zones on the south clear down to Long Beach
and C -3 to the north, all within the City limits. Petitioner
contends that R -1 on Rosemead Blvd. is unrealistic.
The following people also spoke in favor of granting this zone
change:
George Zeliff, 6351 Sultana; George Zeliff III, same address
Mrs. Mathew Delacorte, 6030 Rosemead Blvd.. Gladys Geley, 6022
Rosemead Blvd.; Carl Lindeman, 6202 Rosemead Blvd.; and Florence
Cole, 6040 Rosemead Blvd.
Mr. Zeliff modified his statement by saying that although he was
in favor of commercial zoning on Rosemead Blvd. he felt very
strongly that it should be of the nature of a planned shopping
area.
The Mayor then asked if there was anyone wishing to sneak against
the proposed zone change, but no one came forward.
C. Ray Johnston, Planning Commissioner expressed the Feelings of
the Planning Commission, stating that they were very much against
this type of strip zoning unless it is accompanied by a Precise
plan of development. This feeling would be true of any area in
Temple City at this time.
Mr. Meek spoke in rebuttal, stating that he felt the reo .)le re-
questing this zone change were being discriminated against.
Mrs. Meek stated that speculators are buying prcperty and then
renting until the property becomes more valuable, and due to the
lack of interest and pride in ownership the area is deteriorating
and feels it will become a slum area.
Councilman Merritt moved to close the public hearing, seconded
by Councilman Fitzjohn and carried by the following roll call vote

ABSENT: Councilmen -None
Since the public hearing on the proposed zoning maps For the
area south of Glribaldi will be held on September ?r;.; it was gen-
erally felt by the Council that this matter should be held over
until such time as all residents in the area may heard, and
when the Planning Commission makes its specific recommendations
to the City Council, which should be within a three month period.
Councilman Merritt moved to deny the request for zone change
without prejudice and instruct the City Attorney to draw a
resolution to that effect, seconded by Councilman Dickason.
City Attorney Shatford stated that if, after the adoption of the
Master Plan, Mr. Meek should not be satisfied and wish to re-
apply for a zone change under the new Zoning Ordinance, this
body will, on its own motion, institute proceedings on that area
without further cost to Mr. Meek.
Motion carried with the following roll call vote:

NEW BUSINESS:
9. RETENTION OF GORDON AND BRYS I S WHITNALL AS PLANNING CONSULTANTS
TO THE CITY:
City Manager Woollett apprised the Council of the value of re-
taining the Whitnall's for the balance of the fiscal year (10
months) in order to aid the City in proper development of the
commercial and manufacturing centers. The Whitnall's have been
retained in this capacity to develop Chapman Center in Fullerton,
Manchester center in Fresno, Mar Vista Center in Costa Mesa, and
are now being retained by the City of Hawthorne and Anaheim.
They function as advisors to the legislative body of the City.
Their fee would be $300. per month, and would require an appra-
priation of $3,000. from the budget, for which there are suf-
ficient funds. After brief discussion, Councilman Fitzjohn

moved to retain the Whitnall's for the balance of the Fiscal
year and authorize the Mayor and City Council to authorize the
agreement after it is approved by the City Attorney. Seconded
by Councilman Merritt and carried by the following roll call vote

10. TRAFFIC COMMISSION RECOMMENDATIONS:
Item 5 - Radar speed check on Sultana Ave. between Hermosa and
Longden.
Item 10- Placement of pedestrian crosswalk across Las Tunas at
Agnes.
Item 11- Placement of vertical LOADING ZONE ONLY sign on south
side of Las Tunas between Agnes & Rowland
Item 12- Upgrading of weight limit and arrow signs on all
necessary city streets for truck routes.
Item 13- 1 (a) - Repaint curb markings at snorkel box on north
side of Las Tunas on west side of Temple City Blvd.
Councilman Dickason moved to approve all above items, seconded
by Councilman Fitzjohn and carried by the following roll call
vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker

Item 8 - Request City Attorney to draw ordinance for placement
and enforcement of bike racks at specific locations
on Las Tunas Drive.
Traffic Engineer Envall stated that the Traffic Commission re-
commended the City Attorney be asked to draw up an ordinance
for placement of specific bike racks in the City, stalls to be
placed on curbs facing toward streets, with appropriate signing.
A discussion followed regarding City liability in case of an
accident and Mr. Woollett introduced a proposal suggested by
some of the merchants for the placement of bike racks in the
red zones adjacent to intersections on the side streets off Las
Tunas. These racks could accommodate 4 bikes and be placed on
the sidewalk to be approached in either direction.
Councilman Dickason moved to have the City Attorney draw uo an
ordinance and refer this matter back to the Traffic Commission,
seconded by Councilman Fitzjohn and carried.
11. RESOLUTION NO. 63 -307 - WARRANTS & DEMANDS IN THE SUM CF
$13,583.00, DEMAND NOS. 2959 through No. 3018.
Councilman Dickason moved to adopt Resolution No. 63 -3;17,
seconded by Councilman Merritt and carried by the following roll
call vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
COMMUNICATIONS:
12, 1. Request for charitable solicitation permit, Santa Anita
Girl Scout Council.
2. Temple City Lions Club, request to conduct Annual White Cane
Days, Oct. 4th and 5th.
3. Temple City March of Dimes, request to conduct line of dimes
on Friday, Jan. 24th.
4. United Way, request to hang street banner across Las Tunas
from Nov. 1st to 15th.
Councilman Fitzjohn moved to a? ?rove the above requests, seconded
by Councilman Dickason and carried.

13. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Mr. A. Lindberg, 9932 Nadine St., addressed the Council stating
that he was disappointed in the "buck passing" regarding the
bike racks on Las Tunas. Felt that this matter of bicycle and
pedestrian safety has been before the Council and passed back
to the Traffic Commission too many times in the past two years.
The particular matter of bike racks has not, however, been before
the Council previously, and Council felt that more study was
needed in this matter due to the safety factor, and thatoff- street
parking of bikes is more feasable.
14. MATTERS FROM CITY OFFICIALS:
(a) City Manager Woollett read petition protesting interum zoning
on Temple City Blvd. with 34 signatures affixed.
(b) City Manager stated that a check to Shepard & Morgan was
omitted From the expenditure Resolution because approval
had not been received from the architect due to his illness.
This has since been approved.
Councilman Tyrell moved to approve the expenditure, seconded
by Councilman Fitzjohn and carried by the following rcll
call vote:

(c) City Manager stated a Notice of Completion on the new library
had been filed today.
(d) City Manager requested a public hearing be set for Curb and
Gutter project on Key West, north side, between Halifax and
Doreen. Councilman Dickason moved to set a public hearing
at 7:30 P.M. for Curb and Gutter on Key West, seconded by
Councilman Tyrell and carried.
(e) Councilman Merritt moved to appoint T. Donald Buchan as City
Treasurer to replace Walter Griesmeyer, seconded by Council-
man Tyrell and carried by the following roll call vote:

NOES: Councilmen -None
ABSENT: Councilmen -None
Mr. Buchan will be sworn in at the next Council meeting, and
a Deputy City Treasurer will probably be selected by then.
(f) Councilman Tyrell stated that there are two things before
the California Contract Cities Assn. at the present time:
(1) problem of liability for acts of employees leased to the
City (governmental immunity). John Todd, William Woolleti
Jr. and self have been appointed on committee to investi-
gate.
(2) A discussion will be held at Oct. meeting concerning the
Sheriffs sub- contract and problems. County Counsel has
Proposed a new contract on this phase of our contractual
obligations. The same committee on governmental im-
munity has been appointed to discuss this subject also
and a series of meetings will be held.
(g) Councilman Tyrell also asked what progress is being made
regarding the development of the downtown business center.
Mayor Nunamaker stated that they are moving ahead and are
making plans for the properties they want to buy, but this
will in no way affect Parking District No. 2.
(h) Councilman Merritt stated the next Californ-i -a Contract Cities
meeting is Sept. 18th and he will attend.
15. ADJOURNMENT:
Councilman Dickason moved to adjourn, Councilman Fitzjohn seconded
and carried. Council adjourned at 11:15 P.M. until the next
regular meeting on September 23, 1963 at 7:30 P.M. at the City
Hall, 966t. E. Las Tunas Dr., Temple City.
