HomeMy Public PortalAbout3202-1977- ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND UNPLATTEDa F02-87 8249 OCT 241977 ORDINANCE NO. 3202-1977 AN ORDINANCE ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND UNPLATTED, LEGALLY DESCRIBING THE ANNEXED TERRITORY, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, WAYNE COUNTY, INDIANA. SECTION NO. 1. That on the taking effect of this Ordinance, the territory described below shall be annexed to and be de- clared a part of the said City of Richmond, Indiana; being located in Wayne County, State of Indiana, and more particularly described as follows, to wit: NORTHEAST TRACT: Being all that part of Wayne Township, Wayne County, Indiana adjacent to the present corporation line of the City of Richmond, Indiana which is bound on the north by the south right of way of the Columbus Branch of the Penn Central Railroad, on the east by the westwardly right of way of the Inter -state Seventy (70) and on the south and west by the present corpora- tion of the City of Richmond, and being more parti- cularly described as follows: Beginning at the northeast corner of the present jcorporation of the City of Richmond, Indiana at the southwardly right of way of the Columbus Branch of the Penn Central Railroad and the centerline of Elks Country Club Road, and running thence northeastwardly, along the southwardly right of way ofssaid railroad to the intersection of said right of way line with the westwardly right of way line of Inter -state Seventy (70); thence southeastwardly, along said right of way, to the present corporation line of the City of Richmond, Indiana; thence southwardly, west- wardly and northwardly, along said corporation line, to the place of beginning, containing an area of six hundred eighty-five (685)'acres, more or less. 6uEy ®ntnred for Bassoon this doy bf i9, AUDirm of wAYNE CMTy Ordinance No. 3202-1977 Page 2 SECTION 2. On the effective taking date of this Ordinance, the newly incorporated areas shall have the following zoning classi- fication: 1. 0-1 zones annexed shall remain 0-1 in the City. 2. R-2 Multi -Family areas annexed shall become R-4 Multi -Family Residence Districts in the City. 3. C-3 zones annexed shall become C-4 General Busi- ness Districts in the City. 4. R-1 areas annexed shall become R-2 Single Family Residence Districts in the City. 5. M-2 areas annexed shall become M-2 General Indus- trial Districts in the City. SECTION 3. WHEREAS, the annexation is in the best interest of the City and of the territory to be annexed, and, WHEREAS, the annexation area is urban in character, being an economic and social part of the City, and, WHEREAS, the City is financially able to provide municipal services to the annexed area within the reasonably near future, and, WHEREAS, the area sought to be annexed, where un- developed, is needed for development of the City in the reasonably near future, and, WHEREAS, the lines of the annexation are so drawn as to form a compact area abutting the City. SECTION 4. WHEREAS, the Richmond P n Commission held a Public hearing on the,- day of , 1977, to hear this proposed Ordinance and voted r to /__ _ in favor of recommend- ing passage of this Ordinance to Common Council. SECTION 5. This Ordinance shall be in full force and effect sixty (60) days after its passage and approval by the Mayor and publica- tion as by law required. Ykman, Mayor���'�'"J ATTEST: DCity Clerk CITY PLAN COMMISSION RICHMOND, INDIANA 1 40' July 1, 1977 Mr. James Carter, President Members of Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 3202-1977 - Plan Commission Case A-12, Richmond City Plan Commission requesting annexation of 685 acres northeast of present Corporation boundaries Dear Mr. Carter, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on May 24, 1977 and June 28, 1977 to present Annexation Ordinance No. 3202-1977 to the public for their input. This Ordinance was legally advertised in a local pd)er and pro- perty owners were further informed through leaflets delivered door-to-door prior to the hearing. Robert Goodwin, Executive Secretary of the Commission, presented the staff recommendation to the Commission and the public. Remonstrators were heard in favor of, and in opposition to, Ordinance No. 3202-1977. Two petitions were given the Commission by remonstrators showing sixty (60) individuals in opposition to annexation Ordinance No. 3202-1977. The Plan Commission voted 8 to l in favor of recommending passage of this Ordinance to Common Council with the recommendation that Council adopt by resolution the accompanying fiscal plan and pro- vide for a Council Committee to periodically review this plan to assure that services are delivered to the annexed area as sched- uled. It was the Plan Commission's determination that the annexation of this area is in the best interest of the City and of the terri- tory to be annexed and the area is urban in character, being an economic and social part of the City, and, that the City is Mr. James Carter, President Members of Common Council July 1, 1977 Page 2 financially able to provide municipal services to the area that are equal to areas similarly situated within present City boundaries, within the reasonably near future and; that the area sought to be annexed, where undeveloped, is needed for the future growth of the City of Richmond and, that the annexation lines are so drawn as to form a compact area abutting our municipal boundaries. Commissioners Lynwell Case, Geraldine Bartz, William Kyle, Don Meredith, George Webb, Joanne Tiano, James Corley and Tom Austerman voted in favor of this Ordinance.
