sitting as the Board of Adjustment, held on December 9, 2011, your
application for Appeal of Final Action of the Planning and Building
Administrator was heard. Your appeal was granted, followed by Zoning
in Progress being placed on this type of tile until such time as it
has been researched and considered through the usual process for
possible code amendments.
You may now have your contractor make application for the
permit for the installation. This approval shall expire
9, 2012 if a permit has not been applied for that relates
installation of roofing material you presented.

RE: Administrative Appeal — Use of a flat white roof tile which has a semi - glossy
exterior coating, slurry coat, applied over the white cement formed tile.
Issue:
Is the semi -gloss slurry coated roof tile prohibited by code for a single family structure that has
a Gulf Stream Bermuda style architecture?
Codes Considered durinlz review:
Section 70 -4 (c) Design standards (2) Preferred (a) (2)
"Consistency of architectural style"
Section 70 -4 (c) Design standards (3 ) Discouraged (a)
"...Discouraged items are thought to not comply with the following goals with respect
to desired zoning district character and quality: 2. Consistency of architectural style."
Section 70 -4 (c) Design standards (4) Prohibited
"Prohibited items are design elements that do not maintain the desired character or
quality of the zoning district within which they are located and are not permitted under current
codes or regulations."

Previous Direction liven to staff from the ARPB and /or Town Commission
On more than one occasion, during public meetings and code amendment review, the topic of
allowing a white painted /coating over a flat tile on Gulf Stream Bermuda architectural styled
structures was discussed. In all previous discussion it was agreed that the roof material used
should remain a white flat untextured, /uncoated, unpainted material. In commonly used
Bermuda architectural reference materials, a shiny surface is not utilized.
Personally, I remember asking the ARPB what decision on this specific issue should the Town
building administrator render? It was told that the material must remain unpainted and true to
Bermuda style architectural. That has been my constant decision on roof materials on Bermuda
style architecture for single family residual zoning districts.

Another direction provided the building official is to treat Place Au Soleil in the same manner,
and taking the same direction as the building administrator would for the Barrier Island. On the
Barrier Island, and for a Gulf Stream Bermuda style home, if the roof material requested was a
slurry coated, painted semi gloss white tile, it would not be approved by the building official.
Finally, on several development approvals, a condition was applied, that the "roof shall be
white (through and through) flat cement finish."
Response to statements made by applicant on application for appeal of final action
of planning and building administrator.
# II. "Bill Thrasher refused use of tile already accepted on other re- roofs"
In all instances consistent language was placed on the permit for approval, "white, flat through
and through the ". Also, in replacing an existing white flat tile roof, often language would be
added "like kind ". It has never been the intention to approve a flat roof tile with a shiny, slurry
coated tile.
The Gulf Stream B &T has this type of roof with the slurry coating. However, the B &T is
located in a OR (Outdoor Recreational) District. The Code does not presently speak to
preferred, discouraged, or prohibited roof materials.
# III. "rejection of use does not concur with existing town codes"
I believe that to grant this type of tile conflicts with the code and specific previous direction of
the ARPB and the Town Commission. I believe that to grant approval of this type of roof tile
opens the door for diversion from the Town's history and character of home appearances and
entire zoning districts.
Reason to deny the Appeal: (Cited by the Town Manager /Planning & Building
Administrator).
1. Conflicts with section 70 -4 related to consistency of architectural style.
2. Introduces a standard for roof material that has been considered uncharacteristic of the
neighborhood.
Is contrary to previous "conditions" of approval denied other applicants.
The pros and cons of the quality of the product
Based on previous product investigation as exists on the internet and with contractors, there are
as many pros as there are cons. The biggest complaint seems to be that pressure cleaning
causes pits on the tile and that keeping the roof white is difficult. More recently, there is a
process that with routine applications, without the use of pressure cleaning, the roof whiteness
can be achieved rather easily and with minimal cost.
Time needed to discuss further
Finally, this is an item that should be given ample time for proper discussion. To grant this
appeal only complicates the permit process for others in the future and the appearance of the
neighborhoods could forever change to something unexpected and unchangeable.
ACTION TAKEN 12 -9 -11: Appeal granted & permission given to use slurry
coated tile on only this property, followed by Zoning In Progress being
placed on use of this product until research by ARPB & Commission
thru the usual process when considering code amendments.

NOTICE OF APPLICATION FOR APPEAL OF FINAL ACTION OF
PLANNING & BUILDING ADMINISTRATOR
NOTICE IS HEREBY GIVEN that the Town Commission, sitting as
the Board of Adjustment of the Town of Gulf Stream, will hold a
Public Hearing on Friday, December 9, 2011 at 9:00 A.M. in the
Commission Chambers of the Town Hall, 100 Sea Road, Gulf Stream,
Florida, at which the following will be considered:
An application submitted by Peter S. Bennett, owner of
property located at 2522 Avenue Au Soleil, legally described
as Lot 52 Place Au Soleil Subdivision, Gulf Stream, Florida,
for the following:
APPEAL OF ADMINISTRATIVE DECISION to deny the installation
of slurry coated, white flat cement tile on the roof of
the dwelling at the location stated herein.
The Town Commission shall make a final decision regarding the
subject application at the meeting noticed above. The meeting may
be adjourned from time to time and place to place as may be
necessary to hear all parties and evidence.
The complete application materials are on file in the Office
of the Town Clerk located at 100 Sea Road, Gulf Stream, Florida
33483, and may be reviewed during regular business hours, which
generally include non - holiday weekdays from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Town Commission of the Town of Gulf Stream at the time and place
aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY
THE TOWN COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT THE
PUBLIC HEARING, SAID PARTY WILL NEED A RECORD OF THE PROCEEDINGS,
AND FOR SUCH PURPOSE, MAY NEED TO INSURE THAT A VERBATIM RECORD OF
THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND
EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. 286.0105, F.S.S.
