Memberspresent: Mayor, Wayne Neddermeyer; Councilmen, Robert Franklin, Arthur Theis, Will- iam Reiser; Clerk, Donna Roehl; Planning and Zoning Administrator, Anne Dorweiler; Attorney Richard Schleifer. Councilman Donald DesLauriers was absent. Motion by Robert Franklin, seconded by Arthur Theis to accept the minutes of April 16, 1976 with the correction of Item 10 to read: Building Inspector, Russel Bouley should suggest someone to the City Council to assist him with inspections. Motion carried unanimously Motion by Arthur Theis, seconded by William Reiser to attach Court reporters transcript of Dockside hearing to minutes of April 6, 1976. Motion carried unanimously 1. ARNE DORWEILER Ralph Burnett Division Annd borweiler explained that Mr. Burnett had purchased 11 plus acres ( Lot F) of Virgil Eisinger property. Zoning Ordinance states that a 25 ft. easement is needed for driveway purposes. A legal description of said easement has been furnished. Motion by Robert Franklin, seconded by William Reiser to approve division of Ralph Burnett property into two 5 acre tracts with road easement. Motion carried unanimously Douglas Leatherdale Mr. Leatherdale has requested a variance for setback from siddyard to construct an addition to a barn and an arena to be used only for private use. He owns 8 acres and uses a portion of Mrs. Vant Hulls for pasture. Mrs. Vant Hull has sent a letter stating she has no object- ion to the construction. Planning Commission has recemmended approval of the variance. Motion by Robert Franklin, seconded by Arthur Theis to grant Douglas Leatherdale a side yard variance to within 85 feet of west property line for an addition to barn and riding arena on the condition that it is not used as a "for profit" venture. Variance granted because of long narrow character of the parcel, and to note that Mrs. Vant Hull has sent a letter approving of the project. Motion carried unanimously Motion by Robert Franklin, seconded by Arthur Theis to request advice from the Planning Commission on lot sizes for keeping livestock and dog kennels. Motion carried unanimously Motion by Robert Franklin, seconded by Arthur Theis to award the 3/4" limestone bid to Jim Sazama., on pickup. Motion carried unanimously Motion by Robert Franklin, seconded by Arthur Theis to award the 3/4" limestone bid to Buesing Bros.,on delivery with Jim Sazema as alternate, subject to attorneys opinion as to bid price of Buesing Bros. Motion carried unanimously Motion by Robert Franklin, seconded by William Reiser to award the 14" limestone bid to River Warren, on pickup and Buesing Bros., on delivery with Kraemer and Sons as alternate on delivery. Motion carried unanimously Criteria used for selecting an alternate was the travel expense (distance, time and availabilit; 3. ANNE DORWEILER Loretto Towing Annd Dorweiler presented site and building plans of Loretto Towing (Bob Altricter) to build a 5200 sq. ft., unheated storage garage on Co. Rd. 19, South of the 55 Club. They are willing to post a bond guaranteeing blacktopping. Letter from engineer states that a $10,000 bond is needed if building were entirely heated and $3500 bond if entrance area and 7 parking stalls were to be blacktopped. Motion by Arthur Theis, seconded by William Reiser to grant Loretto Towing permission to construct an unheated storage garage according to plans dated April 13, 1976, and grant a variance for 7 parking stalls, blacktopping bond to be $3500, building set back 80 feet from edge of Co. Rd. 19. Reason for the variance is that the building will be unheated until a later date. Motion carried unanimously X. KURT KINSTLER Mr. Kinstler wishes to reactivate the plat filed with the city, of John and Fritz Gullickson. Anne Dorweiler explained the various steps the plat had gone through including the paying of $535 park fee and $150 platting fee. The hard shell had not been signed by the city because Mr. Gullickson had not posted the $13,500 required bond for street purposes. Mr. Kinstler wishes to know what needs to be done to reactivate. Mr. Sehieffer advised that they be asked to provide the city with a certificate of owners and encumberances. Mooney Lake Study Anne Dorweiler informed Council of request from Plymouth to Medina's sharing expenses of study regarding lake level of Mooney Lake. She stated that she would have further information and recommendations at the May 4th Council meeting. She also suggested that the ordinance regarding lot sizes be finished so that Council could vote to pass the ordinance, 4. DENNIS KLAGES Mr, Klages requested permission to leave a 10.5 x 21 foot portion of his old house, constructed in 1960 to be used as a storage area. Attorney reminded Council that they should set a prec- edent to be followed by others in the area. Motion by Robert Franklin, seconded by Arthur Theis to grant Dennis Klages a variance from side yard setback to retain the 1960 addition as a storage shed unless council recdives ob- jection within 30 days from the 2 adjoining property owners. Motion carried unanimously Clerk was instructed to mail copies of the motion to Lloyd Hall and Herb Heickert, 30 5. S'aVENS WELL Motion by Arthur Theis, seconded by William Reiser to pay the final bill of Stevens Well for $2467.50 as Mr. Schieffer has advised that well and pump house had been separate bids. Motion carried unanimously 6. BILLS Motion by Arthur Theis, seconded by William Reiser to pay bills, payroll # 4016-4021 in the amount of $17 43-: 36. / 9 iA S 3 Motion carried unanimously 7. WILLIAM COLEMAN Mr. Coleman requested that licenses be granted to him as of May 1, 1976 to allow reopening of the Dockside Inn. Chief of Police, Hoover stated that there was no criminal record. Applications had been completed and fees paid. Mr. Persian representing Erle Anderson, property owner explained the property transfer and listed the lien holders. He also stated that claims against the business of the Dockside Inn are Dennis Sazenski' responsibility and Mr. Anderson will not pay these bills. Robert Franklin stated that he would like to see a copy of agreement under which Mr. And- erson acquired interest in the property, what bills will be paid and a list of the outstand- ing bills against the Dockside Inn. Mr. Schtieffer suggested that Council delay action for 2 weeks and presented a list of items of information that should be secured before granting of the licenses. Motion by Robert Franklin, seconded by William Reiser to table the applications and request the information, as per Mr. Sehieffers list, be secured, and to hold a public hearing on May 4, 1976 at 8:00 P.M. to consider the matter. Motion carried unanimously 8. RAY BOSCH Letter of resignation from Police Officer Ray Bosch had been received. Mr. Bosch wishes to resign as part-time patrolman as of June 1, 1976. Motion by Robert Franklin, seconded by Arthur Theis to accept letter of resignation with regret and thanks for service to Medina. Motion carried unanimously 9. Orono COMMUNITY SERVICE Motion by Robert Franklin, seconded by William Reiser to approve a contract with Orono Community Services for 370.10 to provide recreational services for Medina residents for the 1976 season. Motion carried unanimously Motion by Arthur Theis, seconded by William Reiser to allow the Community Services the use of unfinished basement space for 2 afternoons per week during the summer. Motion carried unanimously 10. NUISANCE ORDINANCE Attorney presented a sample ordinance and asked that Council members study and recommend. Motion by Robert Franklin, seconded by Arthur Theis to hold a public hearing on May 4, 1976 at 9:00 P.M. to discuss the nuisance ordinance. Motion carried unanimously 11. COMPREHENSIVE PLAN DIscussion of the best way in which to present the comprehensive plan to the Metro Council. Anne Dorweiler felt that a professional planner would be best suited for the job. Motion by Robert Franklih, seconded by William Reiser to ask that Anne Dorweiler explore possibilities of hirigg a planner to assist in presenting the plan to the Metro Council.
