The Council of the City of Medina met in regular session on Tuesday, April 20, 1982, 41
at 7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, Wilfred Scherer, William
Reiser; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen
Burr; Attorney, Richard Schieffer; Engineer, Paul Pearson
Absent: Councilmember, Thomas Crosby
1. ADDITIONAL AGENDA ITEMS
Council agreed to discuss the following additional items:
Dog problem at Independence Beach

Motion by Lutz, seconded by Scherer to accept minutes of April 5, 1982, as presented.

4. POLICE DEPARTMENT
Suburban Police Recruiting Service
Richard Schieffer reported that the joint powers agreement provides for each participating
city to appoint a director and alternate director to the recruiting board. He stated that
there is also a provision for withdrawal if a city does not agree with the budget.
Council tabled action on the matter until May 4, 1982.
Independence Beach Street lights
Matter was tabled until May 4, 1982
Independence Beach Dog Problem
Penny Elsenpeter reported on the continuing dog problem in the Independence Beach area
stating that the police have been in the area three to four times a day to answer dog
complaints.
Various residents related incidents concerning specific dogs and the need to control the
problem before a serious incident occurs.
William Foss reported that there is a lack of communication regarding the handling of com-
plaints.
Sarah Lutz stated that there should be one set of information given to residents for reporting
and handling of problems.
Discussion of changing the ordinance provision regarding the number of dogs allowed one owner.
Several residents explained that they have dogs kenneled that do not cause problems.
Thomas Anderson stated that the city will be building kennels in which to house dogs until
l°1etro Animal Patrol picks them up.
Independence Beach Parking
Anne Heideman asked that Council authorize the posting of "towing zone" signs in the Inde-
pendence Beach area, which had been discussed at an earlier meeting.
Motion by Scherer, seconded by Lutz to authorize the posting of "towing zone" 'signs in
designated areas.
Motion declared carried
5. PERSONNEL POLICY
Anne Heideman reported that she would begin writing a rough draft of individual department
policies and would have them completed in June.
6. PUBLIC WORKS DEPARTMENT
Road -side Pickup
Wilfred Scherer reported that he had been working on an arrangement with the camel Athletic
Club to pick up the Medina roadsides. He also stated that he believed that Maple St. at
Independence Beach should have Supac applied.
42 7. JACK EBERT, OFF -SALE LIQUOR LICENSE
Donna Roehl reported that Jack Ebert has made application for an Off -Sale Liquor license
to sell liquor in an existing building at 4365 Hwy. 55. She stated that the Police Depart-
ment had reviewed the application and checked references and had no objection to its being
approved.
JoEllen Hurr reported that the Planning Commission will hear the application for Condit-
ional Use Permit on May llth with Council to hear the application on June 1st. She stated
that the application is in order and there does not seem to be a problem as the type of
business is approved under the ordinance and plans meet parking requirements.
Motion by Reiser, seconded by Scherer to grant an Off -Sale Liquor license to Jack Ebert
for the remainder of the 1981 licensing period, on the condition that the Conditional Use
Permit is approved. Motion carried Voting No -Lutz
Mr. Ebert explained the work that needs to be completed in the building and asked if repair
work could be done before Conditional Use Permit approval.
Thomas Anderson stated that if he wanted to take the chance and do the work,he could do so.
He also asked that the item be brought to the Council at the May 18th meeting.
8. CHARLES PANGIEH
Marie Peterson, Fence
Charles Pangier explained that Mrs. Peterson had erected a fence which was placed 18" inside
his property line at one end of her property. He stated that Ivan McGinnis' fence is also
located partially on his property but that they have worked out an arrangement. He explained
that there was an apparent mistake made when the property was surveyed or perhaps, the Peter -
sons' used the wrong stake as a guide, when placing the fence. He asked that the Council do
something about having the fence moved.
Richard Schieffer stated that the City Council does not become involved in boundary disputes.
Mr. Pangier stated that someone should be checking fences to see that they are placed corr-
ectly.
Lance Beaulieu stated that he owns a fence company and if a fence is placed incorrectly the
company is responsible.
Anne Theis stated that when they erected a fence they discovered a 24" discrepancy in the
survey, which, as everyone knows, is common for the entire Independence Beach area.
Mrs. Peterson stated that there are no stakes inside her fence and that it is 8" inside
her survey stakes.
Thomas Anderson stated that the surveyor should be contacted to correct any error made, which
should be fairly simple as the same surveyor did the work for both parties.
Eugene Dabrowski, Property Clean-up
Mr. Pangier asked that the Council tell Mr. Dabrowski to clean up his property on Cedar Ave.
and Fern St. There is debris remaining from an old cabin, an old sailboat, and various pipes.
JoEllen Hurr presented pictures of the property and stated that there are numerous properties
in the area that have similar problems.
Mr. Pangier stated that the city should enforce its' junk ordinance.
Thomas Anderson stated that the record should show that the problem had been brought to the
attention of the City Council.
9. GAMBLING ORDINANCE
Richard Schieffer stated that Minnesota law prohibits gambling unless a city has a gambling
ordinance.
Thomas Anderson advised that the Attorney prepare an ordinance.
10. INDEPENDENCE BEACH TAX FORFEIT LOTS
Discussion of securing tax forfeit lots from the state in order to correct drainage problems
in the Independence Beach area.
Richard Schieffer explained that the lots would go back to the state after the drainage
problem was corrected and a public purpose was so longer served. He also stated that he
would meet with Sam Nelson of Hennepin County Tax Forfeited Land Department and discuss
various procedures for acquiring and selling tax forfeit properties.
11. COLONIAL DRIVE IN THEATRE 43
Richard Schieffer stated that he had spoken with Mr. Dahl regarding the fence repairs
that are needed at the Drive In Theatre and had been told that Iry Braverman would con-
tact him.
Thomas Anderson stated that they should also be informed that some paving needs to be
repaired and landscaping needs to be improved.
12. WCCO
Thomas Anderson reported that the WCCO application was not being discussed because Thomas
Crosby was out of town and that WCCO had asked for a further delay.
JoEllen Hurr stated that the May 4th agenda had ten or eleven planning items and to deal
with the WCCO application would make the meeting to lengthy. Also she would not be in
the office for a week and if WCCO had items to submit to Council she would not be available
to review before materials are sent to Council.
Motion by Reiser, seconded by Lutz to table the WCCO matter until May 18th.

13. MEDINA MORNINGSIDE
Water lines
Richard Schieffer explained that it would be logical to replace water lines in the problem
area of Medina Morningside, so as to keep the street from deteriorating. He suggested
borrowing from the Park Fund and paying back from user charges. He suggested that the
contingency fund remain, as is, for some additional work needed on the sewer project.
Discussion of the amount of the quote received from Nodland and Associates of $30,092.50,
and whether a better price would be secured by bidding the project.
Paul Pearson stated that there might be some confusion if there were two contractors work-
ing in the same area at the same time.
Mr. Schieffer stated that such an arrangement might not work because street restoration is
part of the sewer project, but if Council were to bid the project a written agreement should
be made with Nodland for cooperation in working with another contractor.
Discussion of a Special Assessment project for only the eleven affected property owners.
Thomas Anderson asked how a water main break in another area would be handled if this pro-
ject was assessed to just eleven properties.
Sarah Lutz stated that bids could be taken and all rejected if Council did not like the
arrangement or if a lesser quote could be gotten from Nodland and Associates.
Motion by Lutz, seconded by Scherer to authorize the Engineer to draw plans and specifications
for installation of water main on Maplewood Tr. and set bid date of May 10, 1982 for 10:00 A.M.
Motion declared carried
Burlington/Northern Railroad
Richard Schieffer reported that the City of Orono would need to approve the project for re-
location of Burlington/Northern poles.
Thomas Anderson asked that Mr. Schieffer set up a meeting of the Mayors of Medina, Orono
and Long Lake for the week of April 25th, to discuss such matters.
Curbing and Parking Spaces
Paul Pearson presented comparison figures for installation of surmountable vs, insurmountable
curbing. He stated that it would cost approximately 1000 extra for insurmountable curbing
at the corners.
Discussion of extending street, curb and gutter to the end of the Elsinor Circle boundary.
Discussion of providing for parking spaces on Bobolink and the park property.
Motion by Reiser, seconded by Scherer to approve Change Order # 4, extension Qf Elsinor Cir-
cle street, curb and gutter; construction of an 8 ft. wide parking area on the north side
of Bobolink Dr.; construction of B-618 concrete curb and gutter on all radiis,at each
intersection.
Motion declared carried
14. BILLS
Motion by Scherer, seconded bylLutz to pay the bills with the exception of the 2 hours Court
time charged by Officer Robert Anderson, which needs clarification; Order Checks # 1204-
1208 in the amount of $994.07 and Payroll Checks # 6645-7756 in the amount of $$6047.63
