The regular meeting of the City Council of the City of Temple City was called to order by Mayor Nunamaker at 7:30 P. M. who 2. then gave the invocation, following which he led the Pledge of 3. Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford & City Manager Woollett 5. APPROVAL OF MINUTES: Regular meeting of September 23, 1963. City Manager Woollett referred to page 3, item 15, paragraph three, correcting "stop light" to "Mast Arms ". Also page 4, first paragraph, 5th line to read "open all the time ". Council- man Fitzjohn moved to approve the minutes of September 23, 1963, as corrected, Councilman Merritt seconded, carried by the follow- ing roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. RESOLUTION NO. 63 -313: Requesting annexation to Consolidated Fire Protection District. The City Manager advised this was a request to put the property annexed on Wendon Way into the District. Councilman Tyrell moved to adopt Resolution No. 63 -313, Councilman Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 7, ACCEPTANCE OF WORK & CANCELLATION OF FAITHFUL PERFORMANCE BONDS: a, Tract #26522, Bond #C 7- 037 -500 in amount of $15,100.00 b. Tract #27309, Bond #C 7- 041 -481 in amount of $30,300.00 Tract #27309, Bond #M 7- 041 -482 re- payment of taxes c. Tract #20748, Bond #33 S 54562 in amount of $8750.00 d. Tract #27787, Bond #C 7045953 in amount of $490.00 City Manager Woollett recommended the work covered by these bonds be accepted and that the Council authorize cancellation of the above Faithful Performance Bonds. Councilman Merritt so moved, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None NEW BUSINESS: 8. AGREEMENT WITH O'MELVENY & MYERS, LEGAL SERVICES, OFF- STREET VEHICLE PARKING DISTRICT #2. City Manager Woollett advised this was the same agreement as previously executed for Parking District #1 and recommended approval of the Special Council Agreement and that the Mayor and City Clerk be instructed to sign in behalf of the City. Council- man Dickason so moved, Councilman Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Mayor Nunamaker advised they already had 6 signatures on this which is about 20% of requirement, and that they have 532% of the 60% required for Parking District #1. 526 Council Minutes, October 14, 1963, page 2 9. RESOLUTION NO. 63 -314: appointing David Recupero Administrative Aide. The City Manager advised this position was budgeted for July 1, 1963, and requested approval of David Recupero. Councilman Tyrell moved to adopt Resolution No. 63 -314, Councilman Dickason seconded, and carried by the following called vote: AYES; Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 10. PRESENTATION OF CERTIFICATE OF RECOGNITION: Walter E. Griesmeyer Mayor Nunamaker advised that due to a prior committment Mr. Griesmeyer could not be present and requested this be held over until the next Council meeting. 11. ACCEPTANCE OF PARCEL 2 TRACT 12998 LOCATED BETWEEN 9346 AND 9352 E. LOWER AZUSA AS A GIFT FROM THE COUNTY FOR ROAD PURPOSES Manager Woollett advised the property indicated is on the south side of Lower Azusa just east of the railroad tracks. The sole use of this triangular shaped parcel is by Hastain & Miller Bros. for access in making floats for the Rose Parade. It was picked up by the County for non - payment of taxes. This Company came to the City with the problem and the County will give to the City for road purposes this parcel, the Hastain & Miller Bros. Co. have agreed and signed an agreement whereby they will pay the complete cost for construction of the street. He advised it to be in the public interest to have the public street, and they have agreed to pay the City Treasurer the sum the City Engineer determines to be the cost, and recommended the Council accept this parcel for road purposes. Councilman Merritt moved to accept for road purposes the above named parcel, and instruct the Mayor and City Clerk to sign with provision for the construc tion of a 40 ft. street south from Lower Azusa with entire cost to be borne by Miller Bros. & Hastain, Councilman Tyrell seconde.. and carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. RESOLUTION N0. 63 -315: Warrants & Demands Following discussion Councilman Tyrell moved to adopt Resolu- tion #63 -315, in the sum of $37,212. 48, Nos. 4130 through No. 4217, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 13. TRAFFIC COMMISSION RECOMMENDATIONS: 5. Sultana between Longden & Hermosa - removal of yellow double center line striping & replace with single center -line Traffic Engineer Envall explained the recommendation. Council -, man Dickason moved to approve, Councilman Tyrell seconded, roll: call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 9. Temple City Blvd. & Workman: installation 20 f'c. red curb north side of Workman at west corner of Temple City Blvd. and 27 ft. red curb on west side of Temple City Blvd, at north side of Workman Ave. Traffic Engineer explained the recommendation and Councilman Merritt moved to approve, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 527 Council Minutes, October 14, 1963, page 3 7. Bicycle Riding & Parking: placing designated bicycle parking stall to occupy one parking space in middle of block on south side of Las Tunas Dr. between Primrose & Temple City Blvd. and between Camellia & Temple City Blvd., and to be marked with signs, and to instruct the City Attorney to draw such an ordinance. Traffic Engineer Envall explained the recommendation of the Traffic Commission in detail. There followed a lengthy discussi- on, Mayor Nunamaker made a motion to have the City Attorney draw an ordinance putting bicycles in red zone and for the traffic engineer to get as many as possible in each such zone. The City Manager advised the staff will give recommendations at the next meeting giving placement and costs, and the City Attor- ney advised he will draw the ordinance and the Council can de- signate by resolution the location of the racks, the ordinance to provide where racks are located the bicycles cannot park ex- cept in the racks but in other streets they may be parked where vehicle parking is permitted. Carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Tyrell, Nunamaker NOES: Councilmen - Merritt ABSENT: Councilmen -None COMMUNICATIONS: 14. a. Appeal of Zone Variance Case #63 -60, Marcelle Shea, 9701 -05 E. Broadway. City Manager Woollett advised this was an appeal from the Plan ning Commission denial of the request, and recommended this appeal be set for Public Hearing on October 28, 1963, at 7:30 P. M. in the Council Chambers. Councilman Tyrell so moved, Councilman Dickason seconded, and carried. b. Los Angeles County Boundary Commission: City Manager Woollet presented proposed annexations #31, City of Arcadia, and #332 -A and #339 City of El Monte, and #46 and #47 City of South El Monte. Councilman Fitzjohn moved to receive and file, Councilman Tyrell seconded, and carried. 1 5 . TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK: Mr. Ed. Raith, 9803 Garibaldi, stated he just wished to call Council attention to the catch basins at the corner of Golden West and Garibaldi, and that they were too high and the water goes right by them. The City Manager advised this was done by the County Flood Control District and he would take this matter up with them and report back to the Council next meeting. Chas. Oakley, 6164 N. Rosemead, complained again regarding the property adjoining his owned by Mr. Gabriel Janus and was advis- ed by both the City Manager and City Attorney that the City was doing everything necessary to effect compliance with all city requirements. Mrs. Georgia Maxey, 9823 Hallwood, requested the Council to pro- claim October 23 as United States Day and for the flags to be flown in the down town area, and for the citizens to fly their flags also. Councilman Merritt so moved, Councilman Tyrell se- conded, and carried. 16. MATTERS FROM CITY OFFICIALS: City Attorney Shatford presented Resolution No. 63 -316: A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE CITY TREASURER T. DONALD BUCHAN TO INVEST OR REINVEST, AND TO SELL OR EXCHANGE. SECURITIES OF THE CITY OF TEMPLE CITY AND DEPOSIT SAME IN ACCORDANCE WITH PROVISIONS OF GOVERNMENT CODE SECTIONS 53607 AND 53608. Councilman Tyrell moved to adopt Reso- lution No. 63 -316, Councilman Merritt seconded, and carried by the following called vote: 528 Council Minutes, October 14, 1963, page 4 AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell asked if we had been paid by the County for the new library and the City Manager advised this will be acted on the 17th of the month and we expect payment around the 20th. He also asked about the traffic light arms and Mr. Woollett ad- vised they will be installed in the next few weeks. Councilman Dickason stated he felt the library should be kept open on holidays and Sunday afternoon for the benefit of all and particularly students. The City Manager will get some information in this regard and report back to the Council. Councilman Dickason also suggested that possibly once a month before a council meeting the councilmen have a study session in the public meeting room in the new library to give them a chance to discuss various subjects of concern to the Council such as the public work program and the new 1 gas tax money, also Contract Cities regarding services contracted with the County. Following discussion the first pre - council meeting for study session was set for November 25, 1963, at 5:45 at the new public meeting room in the new library with the discussion to be on the new gas tax and public works. Councilman Fitzjohn asked regarding the bids on the modifica- tion for the new City Hall. City Manager Woollett advised the bids will be opened on October 24th and brought to the Council . at their meeting on October 28. Councilman Merritt stated in numerous areas in the business dis- trict and around the tree plantings the weeds are heavy and also debris in the alleys and asked whose responsibility it was to keep these clean. The City Ms.nager advised it is the res- ponsibility of the property owner unless debris is in the public street or public alley. It was suggested that the staff make a survey and send a letter of gentle reminder to merchants involved. City Manager Woollett read a letter from the Cub Scout pack at St. Lukes Church requesting a charitable solicitation permit to sell tickets Oct. 21 to Nov. 23, with a 50 donation, the funds to be used for cub scout activities. Councilman Fitzjohn moved to approve, Councilman Tyrell seconded, and carried. The City Manager advised the City is participating in the Econo- mic Educational program with the School District and Robert Garrison has been assigned to the City Hall, and he recommended the Council authorize putting him on the city staff at a rate of pay of $1.00 per hour. At 4 hours a week it will require $136.00 which can be paid from salary savings made by not hiring an Administrative Aide until October and which was budgeted as of July 1. Following discussion Mayor Nunamaker moved to approv recommendation and to pay him the minimum wage, Councilman Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett referred to the master tree planting pro- gram for this year and asked at this time if the Council wishes to approve the program the planting should start in December and requested authority to do so. Councilman Dickason moved to proceed with the program, Councilman Fitzjohn seconded and car- ried by unanimous roll call vote: 17. ADJOURNMENT: Councilman Fitzjohn moved to adjourn and carried.
