WHEREAS, Delta Trucking Inc. ("Delta") has requested Site Plan approval to construct a permanent office facility at 12705 NW 30th Avenue, Opa-locka, FL ("Property"); and WHEREAS,the eastside portion of the Property legally described as Folio 08-2128-004- 0070 is zoned R-3; and WHEREAS, on April 2, 2013, the Planning Council recommended approval of Delta's site plan with conditions which included rezoning the R-3 portion of the Property to I-2; WHEREAS, on April 11, 2013, Delta submitted a rezoning application number 13-05- 0701, to rezone said portion of the Property from R-3 to 1-2; and WHEREAS, on May 7, 2013, the Planning council recommended approval of the rezoning request; and WHEREAS, the City Commission desires to approve Delta's request to rezone the property identified as Folio 08-2128-004-0070, from R-3 to I-2 zoning district; and Ordinance No. 13-20 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City Of Opa-Locka, hereby approves the request of applicant Delta Trucking to rezone the property identified as Folio 08-2128-004-0070 from R-3 to I-2, to allow appropriate uses as listed in section 6.11A (B) of the Land Development Code. Section 3. REPEALER. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. SEVERABILITY. If any portion, section, phrase or clause of this Ordinance is held invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of this Ordinance. Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances when the code is recodified. Section 6. EFFECTIVE DATE. Based on dates and mfa, iiation proyi.c4ed;you can see the location and at that location you see two separate"p rcels and in recent'dine the largest parcel is in an industrial zoning district but the smaller parcel inesidenttalanrthfs presents a slight challenge but the building they plan to erect TT'is going to be on the propeifOnd with that being the case Delta Trucking would suggest that we allow them the approval tonight if yott,,so see it and that after that they be required to rezone the secondary property tlaf they already would have to have as a part of a unity of title so they have one parcel for the entire site so vt e would have to address that anyway so that when they do the same that they rezone the secondary parcel as industrial when they unify and that this be a requirement of site plan approval that is accomplished before building permits are issued no later than rezoning is completed before the C.O. is issued.Mr, Lee further pointed out the location and the zoning areas for clarity. Staff recommends approval for this use and for the remedies that has been suggested. Chairman Russell asked if there were any questions for staff.No questions were asked. Mr. Lee stated that the Representative for Delta Trucking was,,=present.'Mr. Raul Suarez-Delcampo,Architect for Delta Trucking stated he was the one that submitted the application. Chairman Russell opened the floor for the public to speak on behalf, for or against this project.No one came forward so the Public Hearing was closed. Chairman Russell asked Mr. Lee for clarity as to where the property was and where the zoning district lies. Mr. Lee pointed to the area on the slide presentation. Assistant City Attorney Hope Calhoun clarified for the record that the staff would add a fifth recommendation that would be the piece that is currently zoned residential must be rezoned to the compatible Industrial Zoning district prior to issuance of the C.O. on the building that's going to be erected on the piece that's industrial. Mr. Brown stated that it was an oversight on the Staff's part and we are trying to ensure that the applicant's rights are protected and if this is approved by Planning Council Minutes 4/2/2013 Page 2 of 9 the planning council and city commission it can withstand a legal challenge and this is what staff is recommending and this is what we really need from you. Chairman Russell added that this is why we try to have these things done prior to so there are no discrepancies. Mr. Brown stated that this will be fast tracked and you are duly noted. Mr. Alvin Burke made the motion that we follow staffs fifth recommendation for approval with the necessary comments from the Assistant City Attorney Hope Calhoun. Elio Guerrero second the motion. Address: 780 Fisherman Street, 4thi Floor, and Opa-locka,Florida 33054 Request: An Amendment to the City Ordinance 86-8,(Land Development Code) concerning Churches in the I-1 Industrial Zoning District. Assistant Attorney Calhoun announced the second item on the agenda. Mr. Lee explained that this item was before the planning council before and you all supported it. It was forwarded to the city commission. When it went to the city commission,the Way it was formatted at that time it included all industrial districts. This time it's only going to be addressing the allowance of religious facilities in I-1 zoning districts; the lowest intense industrial district in the city. The reason we are bringing this back again is that we continue to receire applications from churches that are requesting to be in industrial zoning districts. Also we know that you all supported and approved this particular use so staff is recommending approval for this with these 4 conditions. We have discussed this with the city attorney's office and they've suggested the following. Attorney Calhoun explained that what their office is recommending is that rather than making them conditions of approving the ordinance that we just amend the ordinance to fold these conditions into the ordinance. Mr. Lee stated that so it won't seem like conditional use; it will be if you want this use these things have to be adhered to. Chairman Russell stated being that apparently there are churches operating in these areas and you mentioned about parking. Mr. Lee stated that they have to have some type of agreement with the owner and the size of the ministry has to be a minimum size. Based on the size of the ministry there is an allotment based on that and it should not be a problem. Mr.Barrett asked if the owners lease to churches would the city benefit from the taxes. Mr. Lee stated yes if the owners lease to these church and remain the owner,this would not affect the taxes. Mr. Brown further stated that it's based on ownership use of the building is how the tax assessor taxes the building. It is taxed based on the ownership use per Assistant City Attorney Calhoun. Mr. Lee showed a table of other Planning Council Minutes 4/2/2013 Page 3 of 9 cities Miami Dade County and Miami Gardens that allow churches in industrial zoning districts. Chairman Russell opened the floor to the Public to speak for or against the project. Mr. Tavares Robinson 14916 SW 22nd Street Miramar,Florida. He said he had spoken to Mr. Lee regarding wanting to know about the possibility of leasing 4300 NW 135 Street. The owners gave them permission but there was an issue about operating a church in the industrial area because it was not zoned for a church. He wanted to see if the City of Opa-locka would grant permission for churches to be in industrial areas. Mr. Angelo Jackson a resident of Opa-locka 1830 NW 146 Lane he agreed with the changes to allow for churches to operate in the industrial district.The Public hearing was closed by Chairman Russell. Mr. Burke stated that as long as the tax base doesn't change and the building is being leased. but what if the whole building becomes churches then what happens?Mr. Brown stated then its ownership and if it's own by a private entity then they would still receive a tax bill and we would receive our tax from it. Mr. Brown alluded back to the gentleman that spoke about 4300 NW 135 Street the churches in the industrial area that this item before us is for I-lzoning and not for the 1-3 zone and this would not help or assist his request at this time. Mr. Barrett said that what if the church goes in and down the road the o\\net-decides to sell the property to the church, what would be the guidelines then?Mir. Brown said es the church could apply for tax exemption but this provision is based on use asked if Attorney Calhoun could clarify this question. Attorney Calhoun said Mr. Brown's point was correct the church could apply for tax exemption as a church and most of them do. The ordinance speaks to the use of the property allowing a church to operate in an I-1 zoning district and what they anticipate is that a church v,ould mo■e in to an existing industrial building an operate with or without a cham_.4e in ownership and so to ■our question that if ownership changes and a church then owns that industrial buildi nu.. would that property then become tax exempt the answer is that they could apply for tax emption as a church and this ordinance is for permitted use not ownership.Mr. Brown stated that right now they are not allowed. Chairman Russell closed the public hearing and asked for the motion for or against. Mr. Alvin Burke made the motion to pass it with staff's recommendation and Mr. Elio Guerrero second the motion. Mr. Lee stated to the committee that in the City we offer Occupational Licenses to deal with the actual license and the use that is going to be applied at that site. It has come to our attention that a better way would be to bring about having certificates of use in addition to occupational licenses then we can address zoning issues and other things that have not been specifically addressed or appropriately addressed. Certificates of Use would help us do those things listed,tnere and help us better attend to whatever happens at a property site and then on a yearly basis it wouldn't just be a renewal of an occupational license but it would be a recertifying of what actually occurs because of that license at that site Someone from the city would go out and examine what they do,determine if they are douig what they need to do or if what they are doing now is allowed in;that zorte district or not and then if not we can address it on a different level other than just havmgecode enforcement to happen t po t them to find out that they are not doing the right thing or go thiou r g b g g g�'��a process to revoke a�':l�t�ense.,W�iere as we can say the certificate of use is no longer valid and you can no longer operate the business theft. Staff recommends that to improve the city to address the need to make siire that thie right uses„occur in the right zoning districts we move the amendment forward to allow for certifieittes of use Mr.Burke said that in essence what is being said now is that not only does ari applicant have to obtain an occupational license but in addition they would have to obtain a certificate of use,:Mr. Brown answered that was correct. Mr. Burke asked if that would be in the same application or an additional application and would it cost.Mr. Brown stated yes it would be an additional cost and that the occupational license is just a payment of tax; it's not zoning approval and what we've learned through he would say the last two years in the city is that when a person comes in to obtain a license they don't necessarily have zoning approval or the ability to operate under all the laws of the city as a matter of fact,the license itself is just tax payment;most people call it business tax receipt so it's not confused so what we are doing is consistent with what most cities do. We have forms in our office that are used.routinely that say certificate of use on them and we do not charge for them other than the necessary inspections from the building and plumbing,electrical trades,they go out and make those inspections but one of the things we are finding out is that when we issue a business license to an entity, it's checked for zoning approval at the onset but every year thereafter renewals are not checked by the zoning office and so the business evolve into something else and so what the certificate of use would do is allow us to go and look at that property not just for zoning but for other issues like clean-up, if they need a permit for a sign,paint the building or get rid of junk vehicles; those are the kinds of things that come up on the certificate of use so it's not something that is requiring somebody to do something. Planning Council Minutes 4/2/2013 Page 5 of 9 Mr. Brown wanted to bring the attention that there are entities that we don't want anybody to spend money in the city and operate at a location for six years and then be told that they don't have proper zoning so this is a comprehensive way of addressing the issue city wide. Mr. Burke disagreed with the idea of extra fees. Mr. Brown stated that we are trying to accomplish what other cities are doing and based on what they are doing, this is staff's recommendation to ensure field inspections are in place because currently the city only has an honor system. Mr. Barrett said this was a good idea and the guidelines and fees would be set accordingly. Mr. Brown stated that this ordinance is only to give us the authority to do these inspections and to provide for what he calls gap inspections. Right now code enforcement only deal with nuisance violations, or property violations and its all based on us getting a complaint in Community Development. Mr. Burke still disagreed with the staffs request. Mr. Elio Guerrero asked if there was a flat fee for this process. Mr. Brown stated that there was no fee established for this ordinance. This just gives us the authority to do it and the county does it and other counties. This just gives us the authority. Chairman Russell stated that the city has to survive and it's only fair that we put things in place so that the city would be able to function properly and better serve the businesses that come into the community. Chairman Russell opened the floor for or against. Mr. Bill Dissepio a business owner at 2335 NW 149 Street disagreed with the idea of an additional fee. He has been a business resident for 3 and half years and he said code enforcement was doing a good job at monitoring and he opposes the idea.Mark Maritza 2335/2337 NW 149 Street business owner stepped forward to say he was for the idea because they can afford it it benefits the city overall,and it benefits each individual business to avoid exactly what's being said that a business comes in and they start out doing one thing and the economy changes and it transforms their business into something entirely different it gives them the authority to do that and it,protects that individual business and the surrounding businesses. Mr. Willie Hernandez came forward his business is at 2350 NW 149 Street and he is against the item presented. He feels that code enforcement,does an outstanding job by coining to the business and writing people up. Perhaps a better job internally could be done rather than taxing the businesses. Chairman Russell asked for public hearing,to be closed after there were no others for or against. The way for this process to go through is like all the others and that's based on site plan review and this is for site plan review of a warehouse use in the industrial zoning district. Staff recommends approval of the site plan subject to compliance to the conditions listed in your report. Chairman Russell asked if the zoning was correct. Mr. Lee stated yes and based on the allowance code presently is for single stream of use and they can only operate solely for cardboard and paper recycling. Based on the code the Director can speak to that action himself but as understood based on what our code allows his interpretation allows him to say that the use that's available to them is the one that he indicated previously and unless text is added to code to add additional usage they will not be able to do everything they've envisioned and they are willing to do everything that's necessary to address those expanded uses but what's allowed in our code at present is solely for them to do paper and cardboard recycling.Mr.Brown stated that they have complied with the requests and they want to do other things like plastics,aluminum and some other things similar to what two years ago this board looked at Waste Pro who was standing behind the ordinances to do to bring in these kinds of recyclables. That goes above the scope of what they are trying to do here as far as run a paper recycling company with cardboard and anything past that our office couldn't support it and we definitely recommend an approval of their site plan with those conditions.They have hired and retained an architect to design the project and once they go through the motions and articulate parking issues and we are hoping they can resolve those issues and those are resolved through the board of appeals to which we do not have one right now. There is history with this project dating back to June or July 2012. Chairman Russell stated that basically it's only sufficient for partial of what they want to do so if this board approves it then that means we have had previous times when people just do further than what we approve to be done because they already want to do more. Mr.Brown stated that this application what Planning Council Minutes 4/2/2013 Page 7 of 9 was noticed is for a paper recycling operation and that's what staff's recommendation is for and anything other than that is something that is not noticed tonight. If the applicant is saying he wants to do something other than what was noticed in the paper,we will need another legal notice and he would have to table this item or defer it until the appropriate Iegal add is put in the paper. Chairman Russell asked to hear from the applicant. Mr. Jose Flores came forward the address is 2350 NW 149 Street and that's our facility. They have been an Opa-locka business owner for 4 years and they have gone through the process of complying with all requirements.They have their occupational licenses and also went to DERM and they have their permit from them authorizing them to do single stream. They want to bring paper, cardboard,PET bottles that are no contaminates,no smell and nothing to harm the environment. They stated that they were the largest employer in Opa-locka. They have complied with all tax obligations and insurances. Mr.Willie Hernandez spoke on behalf of Ecological Paper Recycling, Inc that they have focused on hiring Opa-locka employees and they want to comply with the city and are not looking for short term. They would appreciate the favor from the city. Attorney Calhoun pointed out that the application before the board is for a paper recycling facility. The reason this is raised is because the applicant was advised board members that consistent with code paper recycling is consistent with code and only single stream paper recycling is pointed out as you deliberate. They asked for the conditions and Mr. Brown asked for Mr. Lee to read the conditions to them for the record.The conditions were read in stating the following: Only paper or paper products recycling per the city zoning code shall be allowed, unity of title shall be required to combine all three lots of record, a landscaping and parking variance shall be required, and that be in compliance with all city, county, state and federal regulations.There are concerns the city attorney gave us concerning these as'fin as we understand those variances are things that they are going to apply for after this.Mr. Browny stated that should the committee choose the staffs recommendation is to recominehd approval of the site plan with those conditions and before this is placed on the city commission s,agenda wee,,w tt]lave the zoning board of appeals hear the variance request and we can do that before the city cormniS§ioh meeting according to Mr. Geller the city attorney who I spoke with earlier about having an emergency ordinance to enact a zba so we can deal with the other part of the site plan.We have spoken with Mr. Flores and Mr.Hernandez regarding the other items they were alluding to and they are in support of an ordinance we plan on bringing later but right now this is just for paper to legitimize what they have done. They did come forward and they did try to get in compliance. They had a license but it was erroneously issued because they did not go through the process but we are trying to,get them in compliance and the only way they can is through this board. Chairman Russell called for a public bearing. Mr. Mark Maritza owner of 2335/2337 NW 149 Street and is totally against the t items approval=„before eve ng is done.The building is immense and he expects them to do what they have said they would do;, e traffic is a problem for my customers and the trucks cause an enormous problem not putting a damper on what they want to accomplish. He wants them to basically comply with the necessary items before the committee as things move forward.He presented a short presentation of the day to day activity before the committee and it will be made available upon request. Mr. Bill Dissepio owner of 2335 NW 149 Street came forward to say he has no objections to the recycling business being there and he is happy to see activity again in that area because it was dead for a while. However,the amount of dust and litter,the ground being so bad that it need repairing,the truck traffic and parking are his only complaints. If they address the issues they should become a good business in that area.Mr. Barrett suggested that Mr. Brown sets up a meeting with the business owners in that area and also discuss Planning Council Minutes 4/2/2013 Page 8 of 9 the roads that need repairing and Mr. Brown consented to do that. Chairman Russell closed the public hearing and Mr. Burke recommended approval of staff's recommendations and Mr. Barrett second the motion with discussion. He had a power point presentation of the present locations to be discussed which included the criteria for rezoning and the Iocation and zoning maps. They came for site plan review and it was approved pending rezoning of the property and this is their request to rezone the additional property at the site to make that site whole. This is a zoning change from R-3 to I-2. They submitted their application in a timely manner and staff has reviewed their site plan and found that everything was in compliance accept for this portion that they are attempting to redo now and according to our land development code the use that they have for that site is not permitted if we leave the zoning as it is. Based on the city's code(86-8),4.8 of our code allows for rezoning procedures. At the same time, 6.11 and 6.10 provide for the use that this business is going to perform in that zoning district. Mr. Lee further stated that these are the criteria that we have to go through in allowing for rezoning. The proposed change is contrary to establish land use patterns. Staffs review is not ag,unst the land use pattern. The proposed would create an isolated district unrelated to adjacent and nearby districts;the answer is no because the property that occupies the majority of their land is for the zoning district that are trying to be zoned to The proposed change would alter the population or traffic patterns and thereby negatively tax the load on public facilities such as schools,utilities or streets;the answer is no. They are already occupying the use and this portion would make everything right in that area for what their business does at that particular site. The proposed district boundary would be more illogically drawn in relation to existing boundaries of the property proposed for change;no this is the perfect change for the use for the entire site which includes the rezoned area request and the existing area that's I-2. The proposed change would be in conflict with the adopted city comprehensive plan or portion or portions thereof or would require modification of the adopted comprehensive development plan or portion or portions thereof;the answer is no. This zoning district change is consistent with the land use for the designation. This is consistent when you look at the map it is Industrial. Zoning areas allotted Planning Council Minutes 4/2/2013 Page 2 of 7 make the passage of the proposed change necessary. The answer is no.It is not the zoning areas that make the proposed change necessary but the use that they have on that property require that all of it have the same zoning and that's why we are asking for the change. The proposed change would adversely influence living conditions in the neighborhood; the answer is no because they are already occupying the land but it is incorrect with the zoning that's for that particular east most portion.The proposed would create or excessively increase traffic congestion or otherwise affect public safety; it will not because the property is already being used as such and the traffic that's there is already there. They are not adding anything new;they are just correcting the site. The proposed change would create a drainage problem; it will not. Again for the same answer. The proposed change would seriously reduce light and air to adjacent areas; they are not erecting a building on the rezoned area,they are not expanding so that's a no. The proposed change would adversely affect property values in the adjacent areas it will not for the same reasons stated previously. They are already in use. The proposed change would be a deterrent to the improvement or development of adjacent properties in accordance with existing regulations; it will not negatively impact the area so the answer is no also. The proposed changes will constitute a grant of special privilege to an individual owner as contrasted with the public welfare. It will not. There are no substantial reasons why the property can't be used in accordance with the existing zoning. Yes,the current use is permitted in the I-2 zoning district not in the R-3 so it has to be changed. Whether the change suggested is out of scale with the needs of the neighborhood or the city, it is not out of scale it is a land development code requirement that the use for that business be consistent throughout all the parts that are part of that site. Finally the final two; is it possible to find other adjacent sites in the city for the proposed use in the district already permitting such use;Yes,but it is not part of this particular site and that's why they are asking for the property to be rezoned and finally the proposed development meets regulations and codes; Yes it does. For clarity Mr. Lee pointed to the area that is already I-2 and the area that is being rezoned and noted that the majority of the property is I-2. The portion that is R-3, there is an apartment complex here(pointing to the area)and this area belongs to this business and it is zoned R-3 right now and that's what Otiy are asking to be rezoned. Staff's recommendation is for the approval for the boundary change and those criteria we gave in the presentation are the points that you have to agree with staff on to be able to allow them to rezone this property. Mr.Lee asked if there were any questions and that was the finish of his presentation. Chairman Russell asked if the applicant was present and Mr. Raul Suarez came forth to speak on behalf of Delta Trucking, Inc located at 12705 NW 30TH Avenue, Opa-locka,Fl 33054. He is the architect and representative for the owner. Chairman Russell asked for his address and it is 2515 SW 101 Court,Miami Fl 33165. He stated that what they were asking for was what Mr.Lee stated to have coherent zoning for the entire site. He stated that they assumed from the beginning of their work that is was all I-2 and when they found out it was R-3 everybody agreed that it had to be done.At the last month's hearing we agreed that the project itself was approved subject to rezoning this little parcel of land and that's what we are asking to do now so that we can have coherent site that reflect what the site is being used for and has been used for years. He stated there are no changes to be done on the land at all.Mr. Elio Guerrero asked how big that part of the land was and Mr. Brown said it was just shy over an acre and Mr. Raul Suarez said the rest of the property is 4.9 acres. Mr. Steven Barrett asked to staff if there was a part in the site plans for beautification. The reason for the concern is that it was next to the apartments there zoned in R-3. That was his concern that when the residents look at the site they see some type of beautification.Mr. Raul stated that they submitted a letter stating they agreed to add Planning Council Minutes 4/2/2013 Page 3 of 7 more trees and other landscaping to beautify the area beyond what the code says. Mr. Barrett asked what type of fence was on the property. Mr. Raul stated that along the east and north side of the property is block wall and on the west and south side is an iron decorative fence and that already has shrubbery and fichus trees and they are adding to those as well. Mr. Steve Barrett asked what type of landscaping was on the part that is up for recommendation of approval. Mr. Raul stated that it has a block wall and they are adding trees along that wall. Mr. Elio Guerrero asked about a building sitting in the middle of both properties and Mr. Raul Suarez stated that it was part of the project to demolish that building. Mr. Elio Guerrero ask to staff if a unification of title should it be a condition that we put or is it already understood and Mr. Brown stated that it was a condition of the site plan that was part of the approval from last month. Mr. Raul stated this is why they was asking for the rezoning so they could go ahead and get the unity of title on the whole property. Chairman Russell reiterated Mr. Barrett's question concerning the need for more landscaping and Mr. Raul Suarez agreed to add shrubs and trees along that line and around the perimeter of the whole site. Mr. Brown stated that staff would work with Delta Trucking to make sure the landscaping is incorporated in the site plans according to Mr. Barrett's question and concerns before it is brought before the City Commission. Gerald Lee, City Planner presented the Certificate of Use item stating that certi licatc of uSc process would ensure that we examine specific property use to a site as oppose to a license review that happens only on the first time and then it becomes a renewal and no examination of the actual use. It gives us better specificity to an actual license, actual property, and business as to what they're actually doing in the field. The certificate of use process is all over the state of Florida; all over the country but Miami Dade County in particular uses it in almost every city so it is something that is standard practice and we need to be onboard with that. This is why Opa-locka is left out with a question mark. We did a survey in other cities within Miami Dade County and as you can see that all the cities that we've examined small cities, larger cities and the county all use this. We recommend appro\al of the certificate of use. Chairman Russell asked if there were any questions or discussions. Mr. Elio Guerrero asked for the differences between the occupational license and the certificate of use because that was the part he was still not clear on. Mr. Brown explained that the occupational license was really just payment of tax it has no regulatory enforcement we can actually use to do something with. Some would say we use the occupational process as a regulatory process but we know through litigation we don't have the legal authority to close down businesses or require businesses to obtain compliance and those kinds of things like zoning, land use and these kinds of items so it is a difference where as the occupational license is just payment of tax and there is no certificate of use that allows us to view that property. Mr. Elio Guerrero asked that the occupational renewal process there is an inspection that goes along with that and Mr. Brown answered yes it is and that is in the building department and the inspection you are talking about is called the certificate of occupancy but the terms have been misused but what we are doing this helps us codify some of those functions in the building department. What this ordinance really does is allow zoning officials like myself, Mr. Lee, code enforcement officers to go out and make these inspections annually. To assure what was approved by the planning department in the beginning is what is occurring year after year and so if they are evolving good businesses will get the different industries that the use conforms or comports to the zoning ordinance. If they do, that's one thing but if they don't we would look and evaluate their use to see to either charge them for another business license or something making sure that they are safe. Mr. Brown further stated that we have had several episodes to occur nationally for example the explosion in West Texas and what we are trying to do is when our inspectors go out and they see something that is not consistent with the use that they've been allowed, they can ask what is that being stored over there and based on the response we know right then that we can put them through another process before we Planning Council Minutes 4/2/2013 Page 5 of 7 just say okay. This is really the biggest part of it. The other part is all legal, but it's a process that we really need as a staff and it will allow us to be able to not only protect citizens of the city but also get us out of litigations that we are currently involved in regarding certificate of use and business licenses. Chairman Russell asked if Mr. Guerrero's question was answered and he replied yes. The floor was opened for public hearing. Mr. John Cook address 14580 NW 27 Avenue represented the public by way of being a residence and business owner in the City Of Opa-locka. He stated that he was impacted more than most because he has three licenses and He was in complete agreement with Mr. Brown's effort to take back or re-claim the commercial areas of Opa-locka that has been completely destroyed by incompetence, lack of enforcement and lack of law. He diverted to the last meet ing minutes stating that the only negative thing he saw from the last meeting that this was a cost issue that you had to pay more money and owning three business licenses, he looked at it as an investment to the City of Opa-locka. With this license I am investing to make sure that the man next door to him isn't a meth lab. In the last two years we've had two grill houses in Opa-locka burn down and lie would like to know whose next to him and also that his property value is going to remain the same because they are not out of zone and do something they are not allowed to do. The question really isn't the cost to an individual business or owner but the question is really what the cost to the city is if this isn't approved. He stated that his bottom line is that as a resident and business owner we really need to make a change because what's going on now is not working and he can't imagine anybody not feeling the same way he does because this is all about the quality of life and the city making it a better place or is it where we are going to tell people they can open a business and you don't have to be from Opa-locka and the city can't shut you down. He stated that Mr. Brown is right and everybody does this and the`;City of Opa-locka needs to implement this ordinance. Chairman Russell stated that he appreciated his efforts and the council heard him load and clearly. The public hearing was opened and there was no response and it was closed by Chairman Russell. Chairman Russell asked for a motion and Mr. Steven Barrett motioned to approve amendment to city ordinance (86-8) with discussion and Ms. Lillie Odom`second the motion. Mr. Barrett asked Mr. Brown if we will have the same power for residential properties because you have mechanic shops and so many other things that go on as well with residential properties but we didn't have the authority and this is going to cost the city. Now with this ordinance will we have the authority for residential as well. Mr. Brown answered that this particular ordinance deals with all non-residential properties so commercial property on 27 avenue, apartments we have on 22 avenue, but this does not regulate single family homes or duplexes. Mr. Barrett asked why it can't be for residential properties and Mr. Brown answered that we have the authority to react,to suspected or reported violation of our codes and we have our obligation to do that and if we receive a complaint or if we suspect something is occurring on the property our code enforcement personnel go out and they enforce the codes. Mr. Barrett asked if they are allowed to go on the property. The answer was yes we have the right of reasonable entry under the Florida Statute and where there is a life safety issue,health safety welfare,we are authorized. (ASETC) conducted a subsurface investigation at the above referenced project. The investigation was performed on December 11,2012. The purpose of the investigation was to develop preliminary information about the site and the subsurface conditions existing in the vicinity of the proposed construction. To achieve the desired objective two (2)standard penetration test borings was performed and the log is enclosed in this report. TEST METHOD: The borings were conducted in accordance with procedures outlined for standard penetrations test and split spoon sampling of soils by ASTM Method D-1586. A two (2) foot long two (2) inches 0.0. Split Spoon Sampler was driven into the ground by successive blows with 140 lb. Hammer dropping thirty (30) inches. The soil sampler was driven two (2) feet at a time then extracted for visual examination and classification of the retained soil samples. The number of blows required for a one (1) foot penetration of the sampler is designated as"N" (known as the standard penetration resistance value). The "N" value provides an indication of the relative density of non-cohesive soils and the consistency of cohesive soils. Suitable corrections are applied to this number in order to include the effects of soil overburden pressure and other • factors. A general evaluation of soils is made from the established correlation between "N" and the relative density or consistency of soils. This dynamic method of soil testing has been widely accepted by foundation engineers and architects to conservatively evaluate the bearing capacity of soils. A continuous drilling and sampling procedures was used therefore, the samples were taken at intervals of two(2)feet or at every change in soil characteristics. The types of foundation material encountered have been visually classified and are described in detail in the boring logs. The results of the field penetration tests are presented in the boring logs in numerical forms. The average ground water level at the site was found at five (5) feet six (6) inches below the existing surface (see logs). Fluctuation in the observed ground water level should be expected due to seasonal climatic changes,rainfall variation,surface water run-off and other specific factors related to the site in question. 2380 West 78th Street/Hialeah, Florida. 330161 Phone:305-888-3373 Fax:305-888-7443 Pre 2-December 13,2012 R`�Group FOUNDATION RECOMMENDATIONS: Our recommendations are based on the information provided from the client as to the type of structure planned and on our subsurface investigation performed on the proposed site. Our recommendations are as follows: 1. Excavate entire building area plus 5'-0" outside the perimeter of construction and remove all top soil and unsuitable subsurface material to the necessary depth. We anticipate an average excavation depth of approximately four(4)foot zero(0) inches,and remove marl and other deleterious material. 2. Compact excavated area to a minimum compaction of 98% of the optimum dry density as per AASHTO T-180. Verify densification procedures by taking an adequate number of field density compaction tests. The excavated area should be inspected prior to the commencement of the backfilling operation to ensure that all the unsuitable material has been removed. 3. Backfill building area, plus 5'-0" outside the perimeter of the structure to the required elevation with a clean mixture of sand and lime rock fill(or approved fill material)in compacted layers not to exceed twelve(12) inches in thickness. Compact each layer to a minimum of 98% of the optimum dry density as per AASHTO 1180. Verify densification procedures by taking an adequate number of field density tests, especially by the footing area. 4. Excavate footing trenches to the required depth from the ground elevation. 5. Compact the bottom of the footing trench to a minimum compaction of 98% of the optimum dry density as per AASHTO T-180. Verify densification procedures by taking an adequate number of field density compaction tests. DESIGN RECOMMENDATIONS: The above foundation recommendation having been achieved and verified we anticipate that the foundation and footings may be appropriately proportioned for a safe soil bearing capacity not to exceed 2000 pounds per square foot(psf). The use of spread footings and single column pads is suggested. A monolithic slab foundation may also be adopted. CONCLUSION: Regardless of the thoroughness of our geotechnical exploration there is always a possibility that conditions on the subject property (site) may be different from those at the test locations. Therefore, should any subsoil condition different from those reported in our boring logs be encountered during construction, ALL STATE ENGINEERING AND TESTING CONSULTANTS, INC.,should be notified immediately.
