Tiffm City Council And Tiffm Planning and Zoning Commission May 25, 2005 A special meeting of the Tiffin City Council and Tiffin Planning and Zoning Commission was brought to order by Mayor Glen R. Potter, 6:30 p.m. at the Tiffm Fire Station, Wednesday, May 25, 2005. Council members present: Jim Bartels, Mark Petersen, Mike Gericke, Sandy Huedepohl; and Karin Dils. Planning and Zoning Members present: Ruth DeMuth, Melvin Reeve, Stephanie Surine, Terry Richardson, and Steve Berner. Also present: Engineer Dough Frederick of Hart Frederick Consultants and Karla Davis on behalf of Braxton Nieman developer of proposed Timber Ridge View Subdivision. Also present: Thomas E.Roling, Mike and Rhonda Evans, Robert L. Ruppert,Bill Ruppert,Bob and Judee Reihman,Heidi and John Crow,Joe Schrock, Scott and Karla Gealow,'Travis Stratton, Richard Dolezal, Joe and Dee Macri, Bill Grace. Doug Frederick reviewed the preliminary plan for Timber Ridge View Subdivision. Tom Roling explained that he had left North Liberty because of the hodge podge of development that had occurred there by the°desires of builders who also participated in governing. The government leaders were also the people making money on the new ,... homes and this made for a mixture of buildings and a predominance of high density:; Roling said Tiffin has one of the nicest family developments of the area.' Karla Davis explained that the duplexes proposed for Lot 48 would most likely be sold to t one builder and'sold under a condo association that would have responsibility for upkeep of the entire lot and roadway maintenance for the entire lot. This kind of association would most likely provide for good upkeep, conformity of fences and performance of maintenance items of the lotto a higher standard than might occur otherwise. Heidi Crow said she has lived in Songbird and had not received a notice and asked.what - list had been used. Mayor Potter noted that the Pioneer Republican of Marengo was the official newspaper and all legal notices are•publishedthere and notices are also posted at .the Amoco,the Solon State Bank and Morgan's Service. • Dolezal said he had lived in condos in Iowa City and Coralville and they become instant slums in 10 years. Dolezal had moved to Tiffin because Songbird had been zoned R-1 and he thought that Songbird might well be the nicest subdivision in the area and probably hi all of Johnson County. Bartels explained that the council had decided to hold the reading of the ordinance in more than one meeting to provide an opportunity-for citizens to give input and comment. Dolezal asked if the developer were from Texas. Karla Davis explained that Braxton Nieman was from Texas, and had been here for the past,two meetings of the city. The concept plans had been before planning and zoning and city a number of times. Braxton grew up,in Iowa City and his parents resided in Iowa City. Bob Reihman noticed that the plans drawn by Frederick showed nine duplexes on Lot 48 and asked if there was any way to limit to less than nine duplexes. Frederick said those plans had not been made. Davis said that once the lot was sold, plans would be drawn up' that would be subject to city ordinances, city review and approval in the form of a - planned area. Davis indicated that any site plan would have to meet the approval of the city at that time. Citizen asked if the developer could create a problem and leave the area. Attorney Greenleaf explained that subdivision requests must follow numerous constraints of the city's regulation concerning zones, subdivision regulations and building. Thecity subdivison ordinance provides for posting bond for work in the subdivision that must be i:,e completed,the proposed subdivider's agreement additionally provides for improvement work to be completed prior to issuance of any occupancy permits in the subdivision. Bill Ruppert asked why the Oakdale required R-2 zone adjacent. Frederick explained that the Oakdale Boulevard as part of the future plan for the city was a roadway that the city has proposed to have a limited number of accesses. The city is planning that each home will not have a driveway to exit into the street for safety of traffic. The use of one exit for multiple dwellings allows for vehicles to drive forward into-Oakdale,but not back into Oakdale. Dolezal asked the location of detention area. Frederick said they were not certain which side of Roberts Ferry would catch storm water, and perhaps both sides would catch water. Petersen thought the condominium association on Abby Court and Terra Court in North Liberty seemed to be positive arrangements in North Liberty and he envisions that these in Timber Ridge View,will be similar and be good for Tiffin. Gericke thought the duplexes exiting on Oakdale would be ok, but the site plans would need to be reviewed carefully for.fire truck access to the units. Scott Gealow asked what fraffic effect this might have on the area. Frederick agreed that the area now built.would be most affected during PhaseI. The completion of work in ' I Phase II and completion of Oakdale would probably divide the traffic to somewhat. All three streets ended with deadend stubs that did not hide that they might one day continue r; on with growth of the city. Citizen asked if the developer will be working with the people living next door to this new work. Karla-Davis said the developer would not attempt to cause problems to a neighbor. Concern regarding intersection issues of Oakdale Blvd, Roberts Ferry and the Ireland Avenue Y was raised, Frederick will need to do further study for safety concerns here. Mayor Potter explained that the city recognizes the Roberts Ferry safety problem. Lack of funds is the reason the city has not provided improvements. It is hoped that state S 1 + t M rt r Y + • grants can help improve Ireland Avenue to connect with Roberts Ferry. The area in the vicinity of this subdivision is planned for improvement in conjunction with this subdivision and roadwork. Roberts Ferry will have to be repaired in sections because of money issues. The City does recognize the need, and is planning to provide for improvements in stages and as possible. Nieman had explained his desire for trails in the Park area. Berner asked if Nieman would show these trails in plans and what material they would be constructed of. Davis said that Nieman would include these trail locations in construction plans, and they could be constructed of cement or wood chip or gravel material. Berner said he would want locations and material notated in plans. Frederick acknowledged that the developer understand that some lots may not built on .until the city can provide adequate water pressure for them. Citizen asked if the extension for Blue Jay would be completed. The city would not desire this responsibility at a later date. On the 25th day of May'2005,at a special meeting of the Tiffm City Council, Tiffm, Iowa, Councilperson Gericke introduced Ordinance No. '2005-272, ORDINANCE AMENDING THE ZONING ORDINANCE FOR THE CITY OF TIFFIN, and moved that it be given its second reading by title only and moved that it be given its second reading. Motion seconded by Councilperson Huedepohl. Ayes: Huedepohl, Bartels, Gericke, Dils and Petersen., Motion Dils, second Petersen that the rule'requiring a second and third reading and reading on three separate dates be waived and dismissed and that the Ordinance No. 2005-be given its third and final reading by title only. Ayes: BGDPH. Thereupon, it was moved by Councilperson Dils, and seconded by Huedepohl that Ordinance No.2005-272, ORDINANCE AMENDING THE ZONING ORDINANCE FOR THE CITY OF TIFFIN, and that it be placed upon its final passage and be adopted. Ayes: Bartels, Gericke, Dils, Huedepohl, and Petersen. Five members of the city council being present and having voted"AYE: Mayor Glen R. Potter declared the motion carried, and the Ordinance No. 2005-272 was passed and adopted. Whereupon Mayor Potter declared that Ordinance No. 2005- 272, ORDINANCE AMENDING.THE ZONING ORDINANCE FOR THE CITY OF TIFFIN be adopted and signified his approval of same by fixing his signature thereto. Passed by the council on the 25th day of May 2005 and approved by`the Mayor on the 25th day of May, 2005. Review of the Preliminary Plat and Zoning Exhibit for Timber Ridge View by the City Engineer Mike Hart was received by the City Council and includes these recommendations: 1. Lot 5,6, and 7 not available for development prior to construction of water tower by the city. 2) Lot 48 recommended change from R2.5 to R-2. 3) Outlot B fully developed street by developer including uility easements, water and sewer extension to farmost westerly point. 4) City review, legal and engineer review of protective covenant and subdiviider's agreements including administrative fees required. City Clerk has not received final document, and is included in review with city attorney and city engineer and city officials. Motion Dils, second Petersen to approve a preliminary plat including subdivider's agreement for timber Ridge View Subdivision including and allowing for the following: 1) recommendations as noted by city engineer including lack of water,pressure on certain lots, zoning of R-2 on Lot 48 and R-1 on Lots 1 —47 and public space, Outlot B included with street and utlity improvements,trail included in construction plans for park space, and material of cement, gravel or wood chip as determined by developer, that site'plan for Lot 48 shall be provided to city for review, recommendations and approval prior to development, preliminary documents has been filed with and reviewed by city officials,. final review remains to be completed by city officials including city attorney and city engineer.
