HomeMy Public PortalAboutResolution 62-247RESOLUTION NO. 62 -247 A RESOLUTION OF THE CITY OF TEMPLE CITY VACATING LIGHT AND AIR EASEMENT NOT USED FOR OVER FIVE YEARS FOR THE PURPOSE FOR WHICH DEDICATED THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. There is presently existing an easement for light and air upon the real property legally described as fol- lows: An easement for light and air over the southerly 30 feet of lots 36, 37, 38, 39 and 40 and the northerly 30 feet of lot 34 and the easterly 30 feet of lots 34, 33, 32 and 31, tract 10553, recorded in book 178, pages 4 and 5 of Maps, included within certain strips of land 30 feet wide lying between lines designated as "building setback lines," such strips to be kept open and free from building and structures of any kind except irrigation and sprinkling systems and appurtenances thereto as shown upon and as designated by the map of tract 10558, and an easement designated as a "future street" over the northerly 30 feet of lot 1 and the westerly 30 feet of lots 1, 2, 3 and 4 of tract 11699, map book 21t, page 49 as shown upon and as dedica- ted by the map of said tract 11699, in the office of the county recorder of Los Angeles county. SECTION 2. That the easement legally described in Sec- tion 1 above is shown upon a map on file with the City Clerk, referenced as the "Weber Tract Map." SECTION 3. The easement for light and air referenced in Section 1 has not been used for the purpose for which it was dedicated for five consecutive years last past. SECTION 4. Based on the foregoing sections 1, 2 and 3 the City Council of the City of Temple City does hereby declare the hereinabove described light and air easement vacated, effec- tive as of the date of this resolution.
