A RESOLUTION: AMENDING THE FISCAL YEAR 2020 GENERAL FUND BUDGET TO
AUTHORIZE A SUPPLEMENTAL APPROPRIATION IN THE
AMOUNT OF $38,000 FROM THE PROCEEDS OF LETTERS OF
CREDIT AND AWARDING A CONSTRUCTION CONTRACT TO
TOTAL DEVELOPMENT SOLUTIONS, LLC IN THE AMOUNT OF
$29,665 TO COMPLETE THE ECHO DEVELOPMENT PROJECT
WHEREAS, the Town's Department of Public Works and Capital Projects is responsible
for the bonding and inspection work on developer projects; and
WHEREAS, the ECHO Parcel 1B (DPR 6-111-2F-3.00) and the ECHO Entrance Road
and Waterline Extension (DPR 6-110-2F-3.0)projects were never completed and punch list work
remains; and
WHEREAS, the bank holding the letters of credit refused to renew those letters of credit;
and
WHERAS, the Town received the proceeds of those letters of credit in the amount of
$74,770 for the completion of the punch list work; and
WHEREAS, in response to a public solicitation for bids for the construction of the
ECHO/Leesburg Business Park Punch List Work Completion project, the Town received six (6)
bids on February 11, 2020 from the following firms; and
• Total Development Solutions, LLC $29,665.00
• Finley Asphalt& Sealing, Inc. dba Finley Asphalt & Concrete
$47,135.50
• Jeffrey Stack, Inc. dba JSI Paving and Construction $59,697.00
• TMG Corporation $74,186.00
• Arthur Construction Co., Inc. $77,630.00
• The Kauffman Group, Inc. non—responsive
WHEREAS,the bids were evaluated by the Director of Public Works and Capital Projects
and the Chief Procurement Officer in accordance with the Town Procurement Policy; and
WHEREAS, Total Development Solutions, LLC was determined to be the lowest
responsive and responsible bidder; and

TOTAL DEVELOPMENT SOLUTIONS, LLC IN THE AMOUNT OF
$29,665 TO COMPLETE THE ECHO DEVELOPMENT PROJECT
WHEREAS,this is a unit price contract and the estimated quantities multiplied by the unit
price have established the contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS,no additional funding is needed to award this contract; and
WHEREAS, any remaining funds from the proceeds of the letters of credit not needed to
complete the work will be returned to the bank that held the original letters of credit for funds to
be returned to the appropriate developer; and
WHEREAS, Town Council approval of the contract is required in accordance with Section
V(l)(d) of the Town Procurement Policy since this is an unbudgeted contract.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as
follows:
I. The General Fund operating budget is hereby amended and a supplemental
appropriation is authorized in the amount of $38,000 for the Department of Public
Works and Capital Projects for the fiscal year beginning July 1, 2019 and ending June
30, 2020.
II. The Town Manager is authorized to execute a contract in a form approved by the Town
Attorney with Total Development Solutions, LLC in the amount of$29,665 for the
construction of the ECHO/Leesburg Business Park Punch List Work Completion
project.
