Motion to authorize the Town Attorney and staff to settle the case of the Exeter
Homeowners Association Inc. v. the Town of Leesburg, Virginia, case number
102499, in accordance with the terms and conditions recommended by the Town
Attorney and outside counsel and discussed by Council in the Closed Session. I
further move that Council appropriates the settlement amounts discussed in Closed
Session from the Town’s Unassigned Fund Balance and that the Mayor is authorized
to execute any and all agreements and the documents necessary to settle the matter so
long as approved by the Town Attorney.
