HomeMy Public PortalAboutResolution 62-252RESOLUTION NO. 62 -252 RESOLUTION GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES IN THE MATTER OF COUNTY LIGHTING MAH'TENAQCE DISTRICT NO. 1395 PETITION NO. 114 -92 IIWHEREAS, the Board of Supervisors of the County of Los Angeles is about to commence proceedings under Division 7 of the Streets and Highways Code, for the annexation of territory to County Lighting Maintenance District No. 1395; and WHEREAS, the proposed annexation will have street lights installed in the City of Temple City; and WHEREAS, all of the land included in the proposed annexation lies within the boundary of the City of Temple City, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Temple City as follows: SECTION 1 i That the public interest, convenience and necessity require the, maintenance of a street lighting system located within said territory as shown on the maps of the annexation to County Lighting Maintenance District No. 1395 approved by the County Boundary Commission on the November 14, 1962, and on file in the office of the Road Commissioner, as set forth in the proposed Resolution of Intention of the Board of Supervisors of the County of Los Angeles for this annexation, a copy of which resolution, incomplete as to dates and similar information Iwhich can only be inserted at the time of adoption, is attached here- to and made a part hereof. SECTION 2 That this City Council hereby consents to the annexation of said territory as described in said proposed Resolution of Intention, included within the boundaries of said annexation, and lying within the boundary of the City of Temple City. SECTION 3 That this City Council hereby finds and determines that the lands included within the boundary of the proposed annexation as set forth, in said proposed Resolution of Intention, lying within the boundary of the City of Temple City, will be benefited by the said proposed annexation to the maintenance district, and hereby consents to the inclusion of said lands within the proposed annexation and to the assessment thereof. SECTION 4 That the consent of this City Council is hereby given to the commencement of the proceedings for said annexation to County Lighting Maintenance District No. 1395 by the Board of Supervisors of the II County of Los Angeles, and to the exercise of exclusive jurisdiction of said Board of Supervisors over all proceedings necessary thereto for the purpose of consummating the same, all in accordance with the provisions of Division 7 of the Streets and Highways Code. SECTION 5 That the Clerk of the City Council is hereby directed to certify and deliver two copies of this resolution to the Clerk of the Board of Supervisors of the County of Los Angeles. SECTION 6 The City Clerk shall certify to the passage of this resolution by the City Council of the City of Temple City and shall cause the 335 same to be posted in three (3) conspicuous places in tha City of Temple City, and it shall thereupon take effect. That public interest and convenience require that the bene- fited territory hereinafter described, all of which territory lies in the County of Los Angeles, be annexed to, and it is the intention of the Board of Supervisors to order that it be annexed to, included within, and hereafter be a part of County Lighting Maintenance District No. 1395, pursuant to and in accordance with sections 5837 et seq. of the Streets and Highways Code of the State of California, as amended. 2. The territory proposed to be so annexed consists of the area included within boundaries described as follows: ANNEXATION TO COUNTY LIGHTING MAINTENANCE DISTRICT NO. 1395 (PETITION NO. 114 -92) (IN THE CITY OF TEMPLE CITY) Beginning at the northwesterly corner of Lot 11 of Tract No. 26554, as shown on map recorded in Book 680, pages 86 and 87, of Maps, in the office of the Recorder of the County of Los Angeles; thence easterly in a direct line through the northeasterly corner of Lot 1 of said tract to the center line of Pal Mal Avenue, as shown on said map; thence southerly along said center line to the easterly prolonga- tion of the most southerly boundary of said tract; thence westerly along said easterly prolongation and continuing westerly along said boundary and following the same in all its various courses to the point of beginning. -2- 336 Petition i ?o. 114-92 The Board of Supervisors hereby fixes , the day of , 19 , at the hour of o'clock a.m., as the day and hour, and the Hearing Room of the Board of Supervisors, Room 381, Hall of Adminis- tration, 500 West Temple Street (corner of Temple Street and Grand IIAvenue), Los Angeles 12, California, as the place, for hearing upon the question of annexation of said territory, when and where any and all persons having objections to the proposed annexation or to the inclusion of any property within the proposed annexation, may appear before said Board of Supervisors and show cause why said proposed annexation should not be made in accordance with this resolution of intention. 1 1 The Clerk is hereby directed to cause notice of the time, place and purpose of said hearing to be published once a week for two successive weeks in the , a news- paper of general circulation which the Board of Supervisors deems most likely to give notice of said hearing to the inhabitants of said district and of said territory proposed to be annexed; and to cause notices of said hearing to be posted not less than 10 days prior to the date set for the hearing in three conspicuous places within the territory proposed to be annexed and within said County Lighting Main- tenance District No. 1395; and to cause postcard notices to be mailed to all inhabitants of the area to be annexed to said County Lighting' Maintenance District, all in the form and manner prescribed in section 5838 of the Streets and Highways Code. -3- GORDON T.
