Dear City of Tybee Island Council Members:
On behalf of TCF International Productions, Inc. 1 would like to respectfully request permission from
the Council Members of the City of Tybee Island, Georgia for access to the North Beach and North
Beach Parking Lot to film scenes for a motion picture.
TCF International Productions would like the support of the City Council by allowing the following:
1) Closure of the North Beach Parking Lot The production company will reimburse the city for
the average historical revenue from this lot for the specific time of year.
2) Recreational vehicular use of the existing beach cross -overs from the North Beach Parking Lot
to the North Beach to transport equipment and personnel to and from the set. The production
company acknowledges that its use of these crossovers in this manner will require restoration
upon completion of the filming project The production company will have the city assess the
wear and tear upon the completion of the project and reimburse the city for the cost of repair
to the crossovers.
3) Temporary waiver of noted city ordinances (see attached) to allow the special needs of the
production company to be met
4) Temporarily allow the production company to close a portion of the North Beach for public
safety concerns. The temporary installation of the filming set will require heavy vehicles such
as truck and cranes on the beach and the movement of large set pieces thus creating a need to
have control of the entire area for safety concerns.
5) Use of `off duty" Tybee Police Department personnel for security at the North Beach to
maintaining the beach closure and security of the North Beach Parking Lot. TCF understands
that its security needs may exceed that of the "off duty" Tybee Police Staff and will also
contract with a bonded and insured private security company to help in the security needs of
the production company
Due to the ongoing creative nature of this project, the production company anticipates needs that may
not be addressed in the above request, therefore we would like to be able to work with the City
Manager to request permission on a "per issue" basis for the duration of the filming activity.
In addition to this official request to the city, TCF International Productions, Inc. will also be requesting
of Letter of Permission (LOP) from the Georgia Department of Natural Resources (DNR) for permission
to impact the dune and beach areas under specific guidelines that include a guarantee to restoration to
these areas upon completion of filming and monitoring of said restoration for 1 year.
TCF understands that the North Beach is a public beach and that our activities will invite many
questions from the local residents. We would like to coordinate with the city leaders to hold a "public
meeting" to inform the residents of Tybee Island about our project.

The City of Tybee Island recognizes that special events play a significant role in the life of the community. Special events
enhance the community by providing recreation, cultural and educational opportunities to residents and tourists and they
attribute to the economic health of the community. It is our goal to assist event organizers in planning safe and successful
events that have a minimal impact in the areas surrounding the event. By keeping the public's best inter persons I t o
organizations wishing to host a special event upon public property or private property requiring City Services, special
permitting and / or vendors must first be granted approval from the City Council and / or the City Manager. The Special Event
application shall be completed with all requested information included and submitted for consideration at least sixty (60) days
prior to event
Events with 75 or more people upon public property or private property requiring City Services, special permitting and / or
vendors require approval from the City of Tybee Island. In order to ensure a smooth review process for permission to have a
Special Event, the applicant will receive direction from applicable City Departments, City Manager and Better Hometown
Coordinator. Prior to the application being considered by City Council (if necessary), all concerns and details must be handled.
Note: Applicant must meet with the Better Hometown Coordinator or her designee at time of submitting application.
Additional meetings may be required.

SECTION5: ADDITIONAL REQUIREMENTS
A required non - refundable Special Events application fee is required at time of application submittal. The
application will not be processed without the application fee of $50.00. Checks should be made payable to the
City of Tybee Island. If the applying organization is tax exempt, a GA Tax Exempt Certificate must be submitted
with the application.
- A site plan showing the layout of the event is due with application. The site plan must include the location of
every booth, ride, public facility, etc.
- A preliminary budget is due with application.
Insurance, as indicated below, is required at least two (2) weeks prior to the Event. Failure to provide insurance
will resul in the cancellation of event.

SECTION 6: INDEMlFICAT1ON AGREEMENT AND ACCEPTANCE
TO ADHERE TO APPLICATION REQUIREMENTS
I, individually and as the Agent representing the Event Organization, do hereby agree to indemnify and hold harmless the City
of Tybee island, Georgia, its officers, agents, employees and contractors from and against any and all loss, damage, claim,
demand, liability or expense by reason of any damage or injury to property or person which may be claimed to have arisen as a
result of or in connection with the occupancy or use of listed event premises during the time period of said event.
Such obligation to indemnify and hold harmless shall continue notwithstanding any negligence or comparative negligence on
the part of the City relating to such loss or damage, except for loss or damage arising from the sole negligence or willful
misconduct or gross negligence of the city, and shall include all costs, expenses and liabilities incurred by the City in
connection with any such claim, suit, action or cause of action, including the investigation thereof and the defense of any action
or proceeding brought thereon and any other judgment or decree which may be entered in any such action or proceeding or as a
result thereof. These provisions shall survive the expiration or earlier termination of the use of premises. Nothing in this
Agreement shall be construed to affect in any way the City's rights, privileges, and immunities as set forth in Georgia Statutes
and/or the Constitution of the State of Georgia. /

City of Tybee Island, Georgia Ordinance Waiver Request
TCI Productions International, Inc respectfully request the following City of Tybee Island,
Georgia temporarily waive the ordinances below from September 13 to December 31, 2010 for
the purposes of supporting motion picture filming at North Beach.
(1) Swimming area. It shall be unlawful for any person to swim outside of the area extending
50 yards from the water's edge. TCF request a temporary waiver from t'1. Ts orally' : armeee for the
purpose of serving the needs of the flnn production company.
(3) Glass or breakable containers. It shall be unlawful for any person to take or carry upon the
beaches or structures erected thereon any glass or breakable containers. TCF request a
temporary waiver from this ordina 1 ce for purpose of serving the needs of the film
production company.
(4) Pets. It shall be unlawful for any person who owns, is in control of, or is in charge of, any
dog or other pet, to allow or take that dog or other pet upon the beaches or structures erected
thereon. This does not include properly certified guide dogs, or similar animals assisting the
blind, deaf, or other physically handicapped persons. TCF Request a waiver from this
ordinance for the exception of ani 's used for the sole purpose of filming scenes in the
motion picture.
(5) Motorized vehicles. It shall be unlawful for any person to take any motorized vehicle on to
the beaches or structures erected thereon. This includes automobiles, trucks, motorcycles, all -
terrain- vehicles and similar motor driven vehicles and craft. This does not include properly
marked emergency vehicles while in the course of an emergency operation, or
maintenance /utility vehicles in the employ of the city or similar governmental entity and engaged
in a legitimate operation. TCF Request a waiver from this ordinance for the access by $°al.....
production vehicles and that of its contractors for the purpose of serving the needs of the
film production company.
(6) Motorized watercraft. It shall be unlawful for any person to operate any motorized
watercraft, such as a jet ski, motorboat, and similar craft, within 1,000 feet of the waterline on
any part of the beach between the north and south rock jetties. TCF Request a waiver from this
ordinance for the access by film production watercraft and that of its contractors for the
purpose of servi g the needs of the film production co id p :.n ny.
(7) Fires. It shall be unlawful for any person to build or maintain any type of open fire on the
beach, including any type of charcoal fire, whether or not in a grill or similar container. TCF
Request a waiver from this ordinance for the purpose of usi ° g pyrotechnics and other
flamed devices such as welding torches and other fla ed devices necessary for the purpose
of serving the needs of the production company.
(8) Disturbing dune vegetation. It shall be unlawful for any person to pick, gather, remove,
walk in the dunes, or otherwise disturb the vegetation present on sand dunes, including sea oats.

Department of Natural r esources and will be der the guidance of the DNR and the City
of Tybee I(sla:I d, Georgia for the appropriate restoration of the impacted areas.

SCHEDULE AND ACTIVITY OF WORK
TCF Productions International Inc.
The following is an outline of proposed dates and work for TCF International Productions, Inc.
regarding temporary access to the North Beach and North Beach Parking Lot of Tybee Island,
Georgia. These dates and activities are subject to change.
TCF International Productions, Inc understands the sensitive environmental nature of its
activities on the North Beach and is working with the Georgia Department of Natural Resources to
establish a plan that will allow for the restoration of all impacted areas upon completion of
filming activities with the provision to monitor such restoration for up to year following its
completion.
September 13 - 119, 20110
) Temporary closure of North Beach from Jetty - Gulick - Railway Access Road begins.
o Place fencing and barricades in areas to temporarily prevent all public access to
area while company is preparing /filming /restoring area.
) Access to North Beach Parking Lot
o Temporarily place office trailer
o Temporarily have Georgia Power provide or remove necessary services.
o Begin delivery and parking of production vehicles
o Begin 24 hour security on parking lot
o Temporarily place signage notifying public of closures

crossovers

o Company would like permission to utilize the 3 wooden deck crossovers with utility
vehicles to access /egress the set area on the North Beach. Company will restore
and /or replace (as necessary) the crossovers upon completion of filming
