Tiffin Planning and Zoning Commission and City Council
A joint meeting of the Tiffin Planning and Zoning Commission and City Council for the
City of Tiffin was brought to order 6:30 p.m. October 12, 2005 at the Tiffin Fire.Station.
Meeting brought to order by Mayor Glenn Potter. Planning and Zoning members
present: Stephanie Surine, Melvin Reeve and Ruth DeMuth. Absent: Steve Berner and
Terry Richardson. City Councilmembers present: Mike Gericke, Karin Dils, Jim Bartels
and Mark Petersen. Absent: None. .
Doug Frederick and his assistant were present with Jim Angstrom of Regency High
Development to explain zoning and subdivision requests before the city. Discussion
concerning road improvements that will be required in the subdivision area. Developers
had said that road costs would hopefully be paid with 50% Rise funds and 50% developer
funds. Developers mentioned that hopefully road costs would be paid with 50%Rise
funds, 25% developer costs and 25% city funds. Roadwork would include turning lanes
and curb, gutter and sidewalks with approval of a Rise grant by the state. Without a Rise
grant for Jasper Avenue the developer expected that seal coat would be proposed for
Jasper. McDonald Family mentioned that this area was protected in forest conservancy
and that they would request street or easement into the west end of the 55 acre property
for the future. The family would expect a 30 year trust with perhaps a change after that
time.
Gary Kee noted that the plan had been changed to omit a cul-de-sac to serve his home
and the home of O'Connor that includes about 10 acres. It is possible that this single
family area could one day be used in more dense fashion and that he would request that
this cul-de-sac be placed back in the plan.
Frederick explained that zoning and subdivision plans include a turning lane on Ireland
Avenue up to the location of the Clear Creek bridge. Easement space is included within
the subdivison plans for a third turning lane. Mr. Dolezal`commented that the four lanes
will be needed and they should be part installed. Dave responded that he could
understand that future use might warrant wider transportation lanes, that he would expect
a traffic engineer to advise them,in this matter and that he would agree that additional
needs and costs associated should be assessed to the adjoining parcel owner. At this time
the city has no ready mechanism for assessing these traffic load requirements.
Public Zones area included for the water tower area and for park space along Clear
Creek.
Planning and Zoning asked that the request downzone the proposed R-4 to R-2 in the east
end of the subdivision in consideration of single family homes already existing in this
location. Doug Frederick explained that he could recognize that many subdivision
questions remained unresolved at this time, and petitioners did not expect to get a
response at this time on the subdivision request.

Motion Reeve, second Surine to provide a recommendation to the Tiffin City Council to
approve a zoning request from Regency High Development for rezoning request as
proposed with inclusion of Public Zones, and change from R-4 (residential quad)to R-2
(residential duplex) on the east sector of the proposal. Ayes: Surine, Reeve, and
DeMuth. Absent: Berner and Richardson. Nays: None. Motion carried.
Resignation`received from Ruth DeMuth.
No action by city council. Motion Surine, second Reeve to adjourn. Motion carried.

A regular meeting of the Tiffin City Council was brought to order by Mayor Glenn R.
Pbtter, 7:05p.m. at the Tiffin Fire Station, October 12, 2005. Councilmembers present:
Mike Gericke, Mark Petersen, Karin Dils and Jim Bartels. Absent: None. Also present:
Engineer Mike Hart and City Attorney Stephen Greenleaf.
Motion Dils, second Petersen to approve printed minutes and agenda. Ayes: Gericke,
Petersen, Bartels, and Dils. Motion carried.
Mayor Glenn Potter requested discussion upon appointment of Ruth DeMuth to fill the
unexpired term of office vacated by Sandy Huedepohl. Council provided no input in
proposed appointment and Mayor Potter appointed Ruth DeMuth to fill the unexpired
term of office vacated by Sandy Huedepohl.
Duane Hoschetetler explained that the trailer court was interested in the city taking
billing work on for the trailer court. He also described meter readings of the last three
months, and would like help. Mayor Potter suggested that Hochstetler set a time that
would work for him to come in and review the information. Hochstetler this would be
agreeable to him. The city has a count of 52 trailers at the court since 1991. Mr. Riggan
had indicated that the court had 70 trailers and Duane Hoschstetler said there were only
61 trailers. Public Works has not counted the units. Duane also explained that the city
uses the
Gary Wehr was present with Karla Davis of Timber Ridge View Subdivision. He is
planning to purchase several lots to begin construction of homes. Street work is underway
but is incomplete at this time. Davis expected work to be finished by the end of this next
week. Attorney Greenleaf explained that final plats might be ready upon completion of
paper work and either improvements or performance bond held for improvements.
Werley also asked if the city allowed temporary construction trailers. He explained that
the trailer would be temporary, and not any location more than a few weeks at a time.
Final Plat for Timber Ridge Subdivision request will be placed on the agenda of October
19, 2005, 6:30 p.m. for the Tiffin City,Council with anticipation that all is in order at that
time.

Mayor Potter opened a Public Hearing for the Rezoning Request from Regency High
Development. No written comment received by the city. Gary Kee noted that the street
extending to the south end of his property had been omitted in'this most recent platting
work and he would want to repeat that it was his opinion and the opinion of his neighbor
that this access street be included in the plat as it had been before.
Motion Gericke, second Petersen to close the Public Hearing of at 7:48 p.m. Ayes:
Bartels, Dils; Gericke, DeMuth and Petersen. Motion carried.
Mayor Potter opened a Public Hearing for the Subdivision Request for the Regency High
Development. Developer agreed that there are remaining issues in this, and did not
anticipate response from the city at this time. Citizen input had been received during the
joint meeting of the PZ and City Council, there was no further discussion of subdivision
request. No written comment received by the city.
Motion Petersen; second DeMuth to close the Public Hearing of the Tiffin City Council
at 7 :48 p.m. Ayes: Gericke, DeMuth, Dils, Bartels and Petersen. Motion carried.
Motion Dils, second Bartels to introduce a Ordinance No. 2005-273, AN ORDINANCE
AMENDING THE ZONING ORDINANCE FOR THE CITY OF TIFFIN, REZONING
THE WOMBACHER-SCHNEIDER PARCELS TO COMMERCIAL, RESIDENTIAL
AND PUBLIC ZONES AND AMENDING THE OFFICIAL CITY OF TIFFIN
ZONING MAP. Ayes: Bartels, Dils, Gericke, DeMuth and Petersen. Absent: None.
Nays: None. Motion carried. Whereupon the ORDINANCE NO. 2005-273 was
introduced and read by title only for the first time.
The right of way vacation request from Frank and Nancy Schneider was set for Public
Hearing on November 9, 2005, 6:30 p.m. at the Tiffin Fire Station. The request would
return a 66 foot right of way easement held by the City of Tiffin adjacent to Interstate 80
to the Schneider family.
Ned, Ann and Greg Allen were present in regard to an erosion concern that has developed
on their property directly west of a lot in Songbird. The city storm sewer plan was
changed by action of builder Mike Gericke when he extended a storm sewer line with
ADS piping. Greg Allen asked that Mr. Gericke contact him with some kind of plan that
could correct the problem. Allen said the tube put in by Gericke should not have been on
this property as Gericke did not check with the city on this change. Allen said Sold the
bull that cost $2,750 for$432 and paid $106 for vet costs and $760 for service fees
required due to the loss of the bull. Allen said he would like a response from Gericke
within 10 days or he would need to contact a lawyer for suit on correction of the drainage
problem. Mayor Potter recommended that Gericke check his insurance to cover the
damage loss of the bull.

Library report received from Director Shirely Yeries 04-05 year of the Springmier
Community Library. Also correspondence from Kris Petersen, President of the Friends
of the Springmier Community Library with information on summer reading program run
by the Neighborhood Center of Johnson County.
CCA Superintendent Paula Vincent visited with city'officials on upcoming need of the
school district. The superintendent expects need for a new high school on the present
campus and moving the middle school to the present high school building. The district
anticipates the need for one elementary school now in a location somewhere on the east
side of the district. The district expects a second elementary will be needed before
another 10 years passes if growth continues at current pace. Vincent voiced recognition
on the need to improve streetway extending Ireland from I-80 to Hy6. Mayor Potter
noted this as a primary need for the community with hopes that traffic problems can be
alleviated by improving traffic movement in the high school area with the creation of
turning lanes on both the west and east side of the current building.
Mayor Potter also noted that the community has grave concerns for crosswalk safety on
Hy6. Petersen asked if school personnel could take the duty of placing and removing the
rolling sign that the school has stored at this time. Vincent admitted that the district was
not excited about placing school personnel on the Hy6 for traffic guard. City officials
noted that leaving children to their own safety was probably an even worse alternative.
The State of Iowa has approved a reduction of speed on the west side of the city as
approaching the school district and a rolling stop sign. Vincent agreed that the school
would listen and consider all suggestions for safety°of children.
Vincent expressed appreciation to Mr. Bartels who has participated in facility study
meetings.
Fire Chief Gary Kee asked if the volunteer fire could make use of the area between the
sewer and water plant for fire drill activities. City officials saw no problem with drill
activities in this location.
Motion DeMuth, second Petersen to approve a RESOLUTION NO. 2005-25,
APPROVING CITY STREET FINANCIAL REPORT submitted to the Iowa Department
of Transportation by the city clerk. The report includes $85,807 of road use tax receipts
and including $770,818 of Rise expenditures with tax increment financing for city
matching funds.. Ayes: Gericke, Bartels, Dils, DeMuth and Peteresen. Motion carried.
DeMuth reported eight trees to be purchased from Carew Landscaping including
planting. DeMuth'said the trees would need to be watered. Mehmen said they could get
the trees watered. Ann Allen is donating two new trees for Potter Street Park in the area
of the footbridge.

Motion Gericke, second Dils to approve purchase of$1,000 for eight trees from Carew
Landscaping. Ayes: Gericke, Bartels, Dils, DeMuth, Petersen.
Mayor Potter thanked Ned, Ann Allen and Ruth DeMuth for the many hours of weeding
work and tractor work completed at the east park. The native plantings on the east
entrance sign look outstanding because of their work.
Brett Mehmen and Brian Detert provided information to council on costs for a new truck.
Mehmen did not think the tonner could push the snow if we were to get a bad winter.
The last two winters we have been fortunate to receive little snow and warm weather. The
grader will require $5,000 of repair costs and still probably not run. Council agreed on a
white truck and Public Works should get additional information for next meeting.
Flood information has been received from FEMA and the city clerk will get this
information to Mike Hart, city engineer for response.
Motion Gericke, second Petersen to accept receipts and clerk/treasurer's report and pay
bills. Ayes: Petersen, DeMuth, Dils, Bartels and Gericke. Motion carried.
