HomeMy Public PortalAbout3234-1977 - ANNEX TO THE CITY CERTAIN TERRITORY DESCRIBING,PROVIDING AND FIXING THE TIME80h parkf y , s 6077 1 ORDINANCE NO. 323419ZZ AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN TERRITORY CONTIGUOUS THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL " TAKE EFFECT. BE IT ORDAINED by the Common Council of the City of Richmond, In- diana. SECTION 1. That the following described territory, adjacent to its corporate boundaries, be annexed to and declared to be a part of the said City of Richmond, Indiana: being located in Wayne Town- ship, Wayne County, State of Indiana, and more particularly described at Exhibit "A" attached hereto and made a part hereof, containing a total rea of 14.97 acres, more or less, and subject to all ease- ments and rights -of -way of record. SECTION 2. The terms and conditions applicable to the annexation of the aforementioned and specifically described real estate in Section 1 are as follows: A. That the total real estate annexed hereby, being more particularly described at Exhibit "A" which is attached hereto and made part hereof, shall be annexed to the City of Richmond, Indiana, and simultaneously therewith zoned C-2, Community Business, as defined and described in Article 31 of the Zoning Ordinance of the City of Richmond, Indiana. B. That Richmond Water Works service be extended to the said real estate set out at Exhibit "A" which is attached hereto and made a part hereof in accord- ance with all rules and regulations applicable there- to, both federal, state and city, at no installation costs to the City of Richmond, Indiana. C. The aforementioned owner of said property, or subsequent owner or owners, shall provide for storm sewer drainage, if necessary. SECTION 3. The terms and conditions applicable to this annexation as set forth in Section 2 above are deemed just and reasonable. SECTION 4. This ordinance shall be in full force and effect from and after its passage and approval by the Mayor and the publication as by law required. AT THE REGULAR JULY 11, 1977 MEETING BE IT RESOLVED that the officers and Board of Trustees of the Elks Richmond Lodge No. 649 B.P.O E. are unan- imously in favor of the annexation and rezoning of the real estate immediately to the south of our Country Club and Golf Course, and presently owned by Mildred L. Zurwell and consisting of 14.97 acres for the pur- pose of construction of a regional sales and business office by Belden Corporation. Be it further resolved that this Lodge shall send representatives to any public hearings before the City of Richmond Common Council and the City of Richmond Planning Commission at such time that said bodies shall hold public hear- ings in regard to the aforementioned annexation and rezoning. THIS INDENTURE MADE this llth day of July, 1977, by and between ELKS RICHMOND LODGE NO. 649 B.P.O.E. of Richmond, Indiana, hereinafter referred to as "GRANTOR", and MILDRED L. ZURWELL, hereinafter referred to as "GRANTEE", WITNESSETH: That it is the intention and agreement of Grantor to provide Grantee or her successors and assigns an easement over and across the entire frontage of all real estate owned by Grantor on U. S. 27 South of Richmond, Indiana, for the purpose of constructing, maintaining and using sanitary sewer and Richmond water lines, said easement to include all real estate fronting U.S. 27 South of Richmond, Indiana, presently owned by Grantor, same to be 30 ft. in width, it being further agreed that Grantee shall receive a temporary easement for the purpose of construction of said sewer and water lines. Grantor agrees to grant, convey and warrant to the Grantee an easement for the said construction, maintenance and use of sewer and water lines and said easement is to be perpetual. It is specifically understood and agreed that subsequent to the annexation and rezoning of the real estate immediately to the south of Grantor's real estate and consisting of 14.97 acres owned by Mildred L. Zurwell that a specifically described easement will be presented for acceptance and that same shall be granted, conveyed and warranted to the same extent as if said description were specifically included as a part of this agreement. It is specifically agreed that this easement is null and void at the expiration of any option agreements by and between Grantee and Belden Corporation. This agreement to remain in full force and effect in the event that the said aforementioned option agreements are properly exercised by Belden Corporation. This agreement is executed pursuant to Resolution adopted by the Board of Trustees of Elks Richmond Lodge No. 649, Richmond, Indiana, authorizing it to execute same, which Resolution remains in full force and effect as of this date, and has not been amended, altered or revoked in any part or manner thereof.
