HomeMy Public PortalAbout3237-1977- AUTHORIZING SPECIAL USE IN ONE FAMILY RESIDENCE DISTRICTORDINANCE NO. 3237-1977 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN AN R-1 AND R-2 ONE -FAMILY RESIDENCE DISTRICT, OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 22, Section 22,01 and more speci- fically provided in Article 48 of Ordinance No. 2325-1968, commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described use of the following described real estate is allowed as a Special Use for a Planned Unit Development for the con- struction of twelve (12) units for elderly housing, at 109 Henley Road, in the City of Richmond, Indiana; more particularly described, to wit: Part of the northeast quarter of Section 3, Township 13 North, Range 1 West, bounded and described as follows: Commencing at the south quarter stone of Section 34, Township 14 North, Range I West and running thence east 20 rods to an iron pin; thence south 6.16 rods to a stake, thence west parallel with the north line of Section 3 to the centerline of said road to the north line of said Section 3; thence east 4.01 rods, more or less to the place of beginning, containing 1 acre more or less; ALSO, a part of the southeast quarter of Section 34, Township 14 North, Range 1 West, and commencing at the southwest corner of said quarter; running thence due east along the section line 20 rods; thence north 8 rods; thence west 20 rods; thence south 8 rods to the place of beginning containing l acre. SECTION 2. As a condition of the aforesaid Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using such real estate. SECTION 3. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of , 1977, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. Ordinance No. 3237-1977 Page 2 SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending the passage of Ordinance No. 3237-1977. SECTION 5. The Planning Director of the City of Richmond, Indiana, is hereby authorized and directed upon passage of this Ordinance, to record and approve the issuance of an Improvement Location Per- mit for the establishment of the use herein allowed. SECTION b. This Ordinance shall be in full force and effect from and after its passage and approval as by law required.
