Case N o . P15002 -200 Block of Bridge Creek Road, Voluntary Annexation, Zoning Plan,
and Comprehensive Plan Amendment. Application filed by L&L Investments LLC , property
owner, for the following :
1. Voluntary annexation of 15.01 acres, pursuant to Section 71 .012 RSMo.
2. Approval of a zoning plan for the property to be zoned RA-2 High Density Residential.
3. An amendment to the development plan map of the comprehensive plan to show the
property as high density residential.
The property is located east of the intersection of Bridge Creek Road and Chapel Hill Road , 1500
feet east of Scott Station Road , and is described as Part of the West Half of the Northeast
Fractional Quarter of Section 4, Township 44 North, Range 12 West, Jefferson City, Missouri
(Central Missouri Professional Services , Consultant).
Mr. Barron described the proposal and e x plained that the property owner intends to develop this
property into a multi-family residential (senior housing) development. He stated that the preliminary
plans show a development of five 8 unit buildings and two 6 unit buildings on the southern portion
of the property, with no current development plans for the northern portion of the property. Mr.
Barron explained that the purpose of the request is to incorporate the subject property into the city
limits of the City of Jefferson with an RA-2 zoning designation in order to accommodate the planned
development. He stated that an amendment to the Development Plan Map of the Comprehensive
Plan would be necessary to support the requested zoning designation. Mr. Barron explained that
currently, the incorporated portion of this property is identified as intended for low density residential
development on the Development Plan Map of the Comprehensive Plan . He stated that the
Comprehensive Plan was adopted prior to development of the Chapel Hill Commons senior living
development and has been successively amended as various phases of the Chapel Hill
development were brought forward. Mr. Barron explained that the area is ideal for multifam ily
development as it serves as a buffer between the low density residential areas to the north and east
and the light industrial uses to the south and has direct access to Scott Station Road via Chapel Hill
Road. He stated that the further enlargement of the area intended for high density residential would

match the existing development pattern for the area with little impact on adjacent uses. Mr. Barron
ex plained that the property owner has submitted a request to annex the property into the city limits
of the City of Jefferson with an RA-2 zoning designation. He stated that the property is contiguous
to the current city limits and the property lends itself well to incorporation and multi -family residential
zoning.
Mr. Chuck Pierce, 713 lhler Road, spoke regarding this request. Mr. Pierce is serving as a
financial consultant for the owner/developer on this proposal. He explained that this is a
continuance of the Chapel Hill Commons Senior Development. Mr. Pierc e stated that the owner has
been tentatively approved for Phase Three of this development. He explained that in order fo r this
prop osed development to move forward the voluntary annexation and zoning plan would need to be
resolved . Mr. Pierce stated that there is currently a 40 person waiting list to get into the other two
properties. He explained that these developments are regulated by the Missouri Housing
Development Commission and residents are subje ct to age and income limits. Mr. Pierce explained
that at this time 9.5 of the 15 acres will be developed.
Mr. Paul Samson , Central M issouri Professional Services , 2500 E. McCarty Street, spoke
regarding this request and explained that the proposed development will consist of 52 two-bedroom
apartments, as well as , a community building. Mr. Samson distributed a packet depicting the
architects rendering of the proposed development. He stated that the buildings will consist of either
six or eight units per building. Mr. Samson explained that the units will be located on either side of a
private driveway so there will be no extension of the city ,street. He stated that access will be from
Chapel Hill Road . Mr. Samson explained that this is not a pl)ased development and construction
will begin this summer.
Ms . Audrey Halvorson , 3409 Rock Beacon Road , inquired whether the city will take over the last
couple of blocks of Chapel Hill Road maintained by the county. Mr. Barron explained that the city
limit line crosses Chapel Hill Road at Rock Beacon Road . He stated that it goes along the southern
boundary of Chapel Hill Road all the way to the subject property. Mr. Barron ex plained that the City
has been in consultation with the Cole County Public Works Department and the condition of the
road is such that the City's Public Works Department is not in favor of taking over the roadway until
it has been improved . He stated that it is on Cole County's road improvement schedule. Mr. Barron
explained that the intention is to come back later with an annexation of the road right-of-way after
Cole County has had an opportunity to bring it up to City standards. He stated that the same goes
for the section of roadway adjacent to the subject property.
Mr. William Hagood, 242 Madelines Park Circle, expressed concerns that the natural watershed ,
that runs to the very back of his property, not be removed as it would cause significant flood ing and
it also acts as a natural sound buffer. Mr. Wade stated that he will have Mr. Don Fontana, the City's
Stormwater Engineer, contact Mr. Hagood .
Correspondence regarding th is proposal was received from William and Carole Hagood, 242
Madelines Park Circle .
Mr. Barron gave the Planning Division staff report.
Mr. Nunn moved and Mr. Jordan seconded to approve the Comprehens ive Plan Amendment in
order to show the property as High Density Residential on the Development Plan Map of the
Comprehensive Plan ,. The motion passed 8-0 with the following votes:
Aye : Cotten, Deeken , Dutoi , Fitzwater, Jordan, Nunn, Thoenen, Vaughan

COMPREHENSIVE PLAN AMENDMENTS
Excerpt from Section 35-74 Legislative Approval-Development
Permits Ordinance No. 13361
A. Whether there was error in the original Comprehensive Plan adoption in that the Platming and Zoning
Commission failed to take into account then existing facts, projections or trends that were reasonably
foreseeable to exist in the future.
The property is not currently in the city limi.ts, and as such is designated Low Density
Residential in the Comprehensive Plan. The adjacent property to the south is in the city limits
and is designated Commercial and Industrial. The Comprehensive Plan made no attempt to
transition between the Commercial and Industrial uses to the south and the Low Density
Residential uses to the north.
B. Whether events subsequent to the Comprehensive Plan adoption have invalidated the Commission's
original premises and findings made upon plan adoption.
In the time since the Comprehensive Plan was adopted, adjacent properties to the west
have been annexed into the city. The newly annexed properties have been classified as High
Density Residential to create a transition area between the Commercial and Industrial uses to
the south and the Low Density Residential uses to the north.
C. Whether the change is consistent with the goals, objectives and policies of the Plan.
The proposed change is consistent with the existing plan in that it continues the transition
area between the Commercial and Industrial uses to the south and the Low Density Residential
use to the north.
D. Whether events subsequent to the Comprehensive Plan adoption h ave changed the character and/or
condition of the area so as to make the application acceptable.
The character of the properties to the south continue to be of a Commercial and Industrial
nature. Newly annexed areas to the west have been developed as High Density Uses. Recent
constnaction on properties to the north which are outside of the city limits have been developed
as two-family attached dwellings. The proposed change to the Comprehensive Plan is consistent
with the recent development in the area.
E . Whether the change is needed to improve consistency bet\veen the Comprehensive Plan and other
adopted plans.
The proposed change is not needed to improve consistency between plans.
F. Whether public and community facilities, such as utilities , sanitmy and storm sewers , water, police and
fire protection, schools, parks and recreation facilities, roads, ·libraries, solid waste collection and
disposal, and others are adequate to serve development for the type and scope suggested by the
proposed zone. !futilities are not available, whether they can be e xtended rea sonably.
Public facilities and utilities are available to the area and can feasibly be extended to
serve the subject property's proposed land use.
G . Whether there is an adequate supply of land available in the subject area and the surrounding
community to accommodate the zoning and community needs.
The supply of land on, and adjacent to the subject property have more than adequate
available land to accommodate the proposed zoning and land use. The maximum density for
RA-2 is 24 units per acre, the proposed development is approximately 7 units per acre.
H. Whether there will be benefits derived by the community or area by the proposed zone .
There is cun-ently an unmet need for low income senior housing. The existing phases of the
development currently have a waiting list of approximately 40 people. Expansion of the
development will help to accommodate that unmet need.

JEFFERSON CITY PLANNING AND ZONING COMMISSION
January 15, 2015
Case No. P15002 -200 Block of Bridge Creek Road, Voluntary Annexation, Zoning Plan, and
Comprehensive Plan Amendment. Application filed by L&L Investments LLC, property owner, for
the following :
l. Voluntary annexation of 15.01 acres, pursuant to Section 7l.012 RSMo.
2. Approval of a zoning plan for the property to be zoned RA-2 Hi gh Density Residential.
3. An amendment to the development plan map of the comprehensive plan to show the property as
high density residential.
The property is located east of the intersection of Bridge Creek Road and Chapel Hill Road, 1500 feet
east of Scott Station Road , and is desc ribed as Patt of the West Half of the Northeast Fractional Quarter
of Section 4, Township 44 North , Range 12 West, Jefferson City, Missouri (Central Missouri
Professional Services, Consultant).
Nature of Request
The property owner intend s to develop this property into a multi-family residential (senior housing)
development. The preliminaty plans show a development of five 8 unit buildings and two 6 unit
buildings on the southem portion of the propetty, with no current development plan s for the n01thern
portion of the property. (see preliminary site plan)
The purpose of the request is to incorporate the subject property into the city limits of the City of
Jefferson with an RA-2 zoning designa tion in order to accommodate the platmed development. An
amendment to the Development Plan Map of the Comprehensive Plan would be necessary to suppmt the
requested zoning designation.

Staff Recommendation
Comprehensive Plan Amendment:
Surrounding Uses
Agriculture
Light Industrial I Residential PUD
Single Family Residential Subdivision
Senior Housing I Residential (Duplex and SF)
Staff recommend s approval of the Comprehensive Plan Amendment. Currently, the incorporated portion
of this propetty is identified as intended for low density residential development on the Development
Plan Map of the Comprehensive Plan. The Comprehensive Plan wa s adopted prior to development of
the Chapel Hill Commons senior living development and ha s been successively amended as various
phases of the Chapel Hill development were brought forward. The area is ideal for multifamily
development as it serves as a buffer between the low den s ity residential areas to the n01th and east and
the light indu strial uses to the south and has direct access to Scott Station Road vial Chapel Hill Road.
The further enlargement of the area intended for high density residential would match the existing
development pattem for the area with little impact on adjacent uses.
Voluntary Annexation and Zoning Plan:
The propetty owner has submitted a request to annex the propetty into the city limits of the C ity of
Jefferson with an RA-2 zoning designation. The propetty is contiguous to the current city limits and the
propetty lends itself well to incorporation and multi-family residenti al zoning. Staff recommends
approval of the annexation and zoning plan.
Staff recommends the following:
l. Approval of the Comprehensive Plan Amendment in order to show the property as High Density
Re s id ential on the Development Plan Map of the Comprehensive Plan.
2. Approval of the annexation request and zoning plan establi shing an RA-2 zoning for the
unincorporated portion of the prop erty.

RE : Planning and Zoning Commission Case #P15002
Chapel Hill 2014-68 PLEX-plan 8-8-14.pdf
The application materials for Case No. P 15002 may be found via the link to the City's webpage (see below). I
have asked the planning division staff to post the preliminary development plan on the webpage today, and have
attached it for your reference. The plan is to continue the Chapel Hill Commons type development that
cunently exists a long Chapel Hill Road. The Chapel Hill Commons development was statted about 2004 when
the first acreage was annexed into the City, the zoning was approved, and multi-family units constructed
thereafter. There was a second section in 2008 along Rock Beacon that followed the same protocol.
The attached preliminary development plan shows five 8-plexes and two 6-plexes, for a total of 52 units. There
are no plans to connect streets within this development to Madeleine's Park; the access will be via Chapel Hill
Road. This development will "back up " against Madeleine's Park Subdivision, sharing a rear propetty line,
however there appears to be a substantial setback and buffer between the building locations and the propetty
line.
As there is no zoning in Cole County, the City's Planning and Zoning Commission has been asked to
recommend the zoning that supports the proposed development. The development will comply with the City's
development standards, including subdivision, storm water regulations, zoning and site design. I believe this
signal s a positive sign for Jefferson City's housing market, and also is positive that the developer finds it
advantageous to annex into the City, especially since the City's development standards are so much more
stringent than that of unincorporated Cole County.

William and Carole,
Your e -m a il is the first I had heard in regard to thi~ issue, so I have no details at this point either. In regard to
details, as part of the fmmal process you and all neighbors receiying notice will have access to all details
relative to the request for rezoning and/or annexation. There will be formal hearings in which both supporters
and those whom might oppose the changes will have an oppmtunity to testify. Prior, and subsequent to the
fmmal hearings , I will be happy to work with you to coordinate one or more neighborhood meetings as needed
to be sure everyone is aware ofthe details of the proposed changes. Typically I would invite City staff to attend
at least one of the neighborhood meetings to answer neighborhood questions or concerns. I will inquire Monday
of City staff to learn more about the project and then contact you to fmther discuss this matter with you .
Thanks!

Bob, I received a letter today as did many others in my neighborhood regarding the Planning and
Zoning Commissions meeting scheduled for January 15, at 5 :1 5pm. to discuss the plan to rezone
15 acres in this neighborhood area to a RA-2 High Density Resident~al area. The area in question
butts directly up against the Madeline's Park Circle sub-division. There is no detail in the
correspondence that shows where these properties (i.e. the actual dwellings are to be built) nor
does it show any roads in or out , It does not show sewer lines or power utilities location.
Needless to say the neighborhood is not enthusiastic about this development for a host of
reasons. There are environmental , propetty devaluation' safety and other issues that need to be
addressed before any "Voluntary Annexatiqn" occurs. Is there any way we can view dwelling
and other planning details BEFORE any rezoning or annexation is voted on??
This is a matter of serious concem to the individuals who live within the M adeline's Park
subdivision and while we want the best for the city we do not want to stumble into this blindly.
We need and request greater detail before any futther action takes place regarding this property.
The letter we have received fi:orn the city states that they will accept written comments regarding
tllis proposed annexation and rezoning but it remains difficult to provide much feedback to the
proper autholity without the details.

Without the detail of this action and without seeing ~y plans for development of this property
my response is to request that you deny the voltmtary annexation.and/or rezoning of this

Subject: case No P15002
Our home is located at 264 Madelines Park Circle and I am concemed about potential stmm water mnoff from
the proposed project. The drainage ditch/creek handling the mnoff tuns through our property and forms the
boundary of our backyard. We purchased our home in 2009 and for several years had no problem with the
drainage ditch/creek overflowing into our backyard. However, the drainage ditch/creek prutially flooded our
backyard numerous times during the last 2-3 years . It is obvious to me that stormwater runoff has increased a
great deal since 2009 due to development activity in the Chapel HillJBridge Creek/Rock Beacon area . I believe
the proposed project will make the storm water runoff problem worse , probably much worse.
If the annexation and rezoning are approved, we would like some assurance from the city and! or the developer
that there will be no fmther erosion of our backyru·d and if further erosion does occur, they are willing to solve
the problem in a way that is agreeable to us.
Sincerely, Richru·d Kaiser 893-7914
