HomeMy Public PortalAboutORD15371 BILL NO. 2014-116 SPONSORED BY COUNCILMAN Graham ORDINANCE NO. / 3 -7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN THE 200 BLOCK OF BRIDGE CREEK ROAD; DESCRIBED AS PART OF THE WEST HALF OF THE NORTHEAST FRACTIONAL QUARTER OF SECTION 4, TOWNSHIP 44 NORTH, RANGE 12 WEST, IN THE COUNTY OF COLE, STATE OF MISSOURI; AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of Jefferson desires to annex the unincorporated area of land described in Section 1; and WHEREAS, the property is adjacent to the current City boundary; and WHEREAS, a public hearing concerning the annexation was advertised in advance of the hearing in the Jefferson City News Tribune. NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has an ability to furnish normal municipal services to this area. Section 3. A public hearing was held on March 2, 2015 as provided by law, concerning the annexation of the unincorporated area described in Section 1. Section 4. The land described in Section 1 shall be zoned RA-2 until such time as the zoning may be changed in the manner provided for by State Statute and City Code. Section 5. The effective date of this Ordinance and the annexation of the area described in Section 1 will be immediately upon passage, provided that no written objections to the proposed annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not become effective until such time as the annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo. The property is located east of the intersection of Bridge Creek Road and Chapel Hill Road , 1500 feet east of Scott Station Road , and is described as Part of the West Half of the Northeast Fractional Quarter of Section 4, Township 44 North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional Services , Consultant). Mr. Barron described the proposal and e x plained that the property owner intends to develop this property into a multi-family residential (senior housing) development. He stated that the preliminary plans show a development of five 8 unit buildings and two 6 unit buildings on the southern portion of the property, with no current development plans for the northern portion of the property. Mr. Barron explained that the purpose of the request is to incorporate the subject property into the city limits of the City of Jefferson with an RA-2 zoning designation in order to accommodate the planned development. He stated that an amendment to the Development Plan Map of the Comprehensive Plan would be necessary to support the requested zoning designation. Mr. Barron explained that currently, the incorporated portion of this property is identified as intended for low density residential development on the Development Plan Map of the Comprehensive Plan . He stated that the Comprehensive Plan was adopted prior to development of the Chapel Hill Commons senior living development and has been successively amended as various phases of the Chapel Hill development were brought forward. Mr. Barron explained that the area is ideal for multifam ily development as it serves as a buffer between the low density residential areas to the north and east and the light industrial uses to the south and has direct access to Scott Station Road via Chapel Hill Road. Mr. Barron ex plained that the property owner has submitted a request to annex the property into the city limits of the City of Jefferson with an RA-2 zoning designation. He stated that the property is contiguous to the current city limits and the property lends itself well to incorporation and multi -family residential zoning. Mr. Chuck Pierce, 713 lhler Road, spoke regarding this request. Mr. Pierce is serving as a financial consultant for the owner/developer on this proposal. He explained that this is a continuance of the Chapel Hill Commons Senior Development. Mr. Pierc e stated that the owner has been tentatively approved for Phase Three of this development. He explained that in order fo r this prop osed development to move forward the voluntary annexation and zoning plan would need to be resolved . Mr. Pierce stated that there is currently a 40 person waiting list to get into the other two properties. He explained that these developments are regulated by the Missouri Housing Development Commission and residents are subje ct to age and income limits. Mr. Pierce explained that at this time 9.5 of the 15 acres will be developed. Mr. Paul Samson , Central M issouri Professional Services , 2500 E. McCarty Street, spoke regarding this request and explained that the proposed development will consist of 52 two-bedroom apartments, as well as , a community building. Mr. Samson distributed a packet depicting the architects rendering of the proposed development. He stated that the buildings will consist of either six or eight units per building. Mr. Samson explained that the units will be located on either side of a private driveway so there will be no extension of the city ,street. He stated that access will be from Chapel Hill Road . Mr. Samson explained that this is not a pl)ased development and construction will begin this summer. Ms . Audrey Halvorson , 3409 Rock Beacon Road , inquired whether the city will take over the last couple of blocks of Chapel Hill Road maintained by the county. Mr. Barron explained that the city limit line crosses Chapel Hill Road at Rock Beacon Road . He stated that it goes along the southern boundary of Chapel Hill Road all the way to the subject property. Mr. Barron ex plained that the City has been in consultation with the Cole County Public Works Department and the condition of the road is such that the City's Public Works Department is not in favor of taking over the roadway until it has been improved . He stated that it is on Cole County's road improvement schedule. Mr. Barron explained that the intention is to come back later with an annexation of the road right-of-way after Cole County has had an opportunity to bring it up to City standards. He stated that the same goes for the section of roadway adjacent to the subject property. Mr. William Hagood, 242 Madelines Park Circle, expressed concerns that the natural watershed , that runs to the very back of his property, not be removed as it would cause significant flood ing and it also acts as a natural sound buffer. Mr. Wade stated that he will have Mr. Don Fontana, the City's Stormwater Engineer, contact Mr. Hagood . Correspondence regarding th is proposal was received from William and Carole Hagood, 242 Madelines Park Circle . Mr. Barron gave the Planning Division staff report. Mr. Nunn moved and Mr. Jordan seconded to approve the Comprehens ive Plan Amendment in order to show the property as High Density Residential on the Development Plan Map of the Comprehensive Plan ,. The motion passed 8-0 with the following votes: Aye : Cotten, Deeken , Dutoi , Fitzwater, Jordan, Nunn, Thoenen, Vaughan Mr. Nunn moved and Mr. Dutoi seconded to recommend approval of the annexation request and zoning plan establishing an RA-2 zoning for the property, to the City Council. The plan is to continue the Chapel Hill Commons type development that cunently exists a long Chapel Hill Road. The Chapel Hill Commons development was statted about 2004 when the first acreage was annexed into the City, the zoning was approved, and multi-family units constructed thereafter. There was a second section in 2008 along Rock Beacon that followed the same protocol. The attached preliminary development plan shows five 8-plexes and two 6-plexes, for a total of 52 units. There are no plans to connect streets within this development to Madeleine's Park; the access will be via Chapel Hill Road. This development will "back up " against Madeleine's Park Subdivision, sharing a rear propetty line, however there appears to be a substantial setback and buffer between the building locations and the propetty line. As there is no zoning in Cole County, the City's Planning and Zoning Commission has been asked to recommend the zoning that supports the proposed development. The development will comply with the City's development standards, including subdivision, storm water regulations, zoning and site design. I believe this signal s a positive sign for Jefferson City's housing market, and also is positive that the developer finds it advantageous to annex into the City, especially since the City's development standards are so much more stringent than that of unincorporated Cole County. There is no detail in the correspondence that shows where these properties (i.e. the actual dwellings are to be built) nor does it show any roads in or out , It does not show sewer lines or power utilities location. Needless to say the neighborhood is not enthusiastic about this development for a host of reasons. There are environmental , propetty devaluation' safety and other issues that need to be addressed before any "Voluntary Annexatiqn" occurs. Is there any way we can view dwelling and other planning details BEFORE any rezoning or annexation is voted on?? This is a matter of serious concem to the individuals who live within the M adeline's Park subdivision and while we want the best for the city we do not want to stumble into this blindly. We need and request greater detail before any futther action takes place regarding this property. The drainage ditch/creek handling the mnoff tuns through our property and forms the boundary of our backyard. We purchased our home in 2009 and for several years had no problem with the drainage ditch/creek overflowing into our backyard. However, the drainage ditch/creek prutially flooded our backyard numerous times during the last 2-3 years . It is obvious to me that stormwater runoff has increased a great deal since 2009 due to development activity in the Chapel HillJBridge Creek/Rock Beacon area . I believe the proposed project will make the storm water runoff problem worse , probably much worse. If the annexation and rezoning are approved, we would like some assurance from the city and! or the developer that there will be no fmther erosion of our backyru·d and if further erosion does occur, they are willing to solve the problem in a way that is agreeable to us.
