Home My Public Portal About1992-13 Amendment: Planning and ZoningORDINANCE NO. 1992 -13 AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE CHAPTER 820 -5(b) WHEREAS, the Plan Commission of the City of Greencastle, has initiated and prepared this ordinance to amend the Greencastle Planning and Zoning Ordinance; WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on March 30, 1992, after timely notice of the hearing was given by publication in the Banner - Graphic Greencastle, Indiana, on March 20, 1992; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the factors enumerated in IC 36 -7 -4 -603 in consideration of the ordinance and determination of a recommendation made to the Common Council; WHEREAS, the Greencastle Plan Commission has certified this is ordinance to the Common Council with a favorable recommendation by a majority vote in favor of adoption; and WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in IC- 36 -8 -4 -603 before acting on this ordinance; WHEREAS, the Common Council has determined that this ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. Therefore, BE IT ORDAINED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA: is SECTION I. Chapter 820 -5(b) is amended to read as follows: (b) Accessory structures shall not be located closer to a side or rear lot line than the greater of five (5) feet or any otherwise required side or rear yard, shall not exceed tcr� fifteen (15) feet in height, and shall be placed behind the rear of the principal structure, except that swimming pools, antennas (including TV satellite receiving dishes) , tennis courts, pet houses, hot tubs, and signs shall never be located closer to any rear lot line than ten (10) feet. SECTION II. This Ordinance shall take effect immediately upon passage.
