AN ORDINANCE: TOWN OF LEESBURG IN LOUDOUN COUNTY, VIRGINIA 76-0-19 PRESENTED October lBt 1976 ADOPTED October 13~ 1976 REGARDING THE DISSEMINATION OF CRIMINAL HISTORY RECORD INFORMATION FOR THE PURPOSE OF GENERAL INVESTIGATION OF APPLICANTS FOR MUNICIPAL EMPLOYMENT. BE IT ORDAINED by the Council of the Town of Leesburg, Virginia, as follows: SECTION I. That the Town Code is hereby amended by adding a new section to be numbered Section 14-7, which shall read as follows: Sec. 14-7. Officers to provide record information of applicants for municipal employment. (a) As used in this section the words "criminal history record information" shall mean records and data collected by Criminal Justice Agencies on adult individuals consisting of identifiable descriptions and notations of arrest, detentions, indictments, informations, or other formal charges, and any disposition arising therefrom. The term shall not include juvenile record information which is controlled by Chapter 8, of Title 16.1 of the Code of Virginia. (b) The chief of police, police clerk and such other police officers as the chief of police may designate are autho- rized and directed to furnish criminal history record informat- ion to individuals authorized by the town manager to perform personnel functions, for use during general investigations of applicants for employment by the municipality, to determine if the past criminal conduct of such applicants is compatible with the nature of the employment. SECTION II. That an emergency exists and this ordinance shall be in full force and effect from and after its passage. PASSED this 13th day of October , 1976.
