7 a quorum.
8 CHAIRMAN TOENJES: Thank you. I appreciate
9 that. My name is Leonard Toenjes and I am the chair of
10 the Rate Commission of the Metropolitan St. Louis Sewer
11 District and will serve as chair of this proceeding.
12 Present are the Rate Commissioners who just identified
13 themselves during the roll call.
14 The Charter Plan of the District was approved
15 by the voters of St. Louis and St. Louis County at a
16 special election on February 9, 1954, and amended at a
17 general election on November 7, 2000. The amendment to
18 the Charter Plan established a Rate Commission to review
19 and make recommendations to the District regarding changes
20 in wastewater rates, stormwater rates and tax rates
21 proposed by the District.
22 Upon receipt of a Rate Change Notice from the
23 District, the Rate Commission is to recommend to the Board
24 of Trustees changes in a wastewater, stormwater, or tax
25 rate necessary to pay (i) interest and principal falling

1 due on bonds issued to finance assets of the District,
2 (ii) the costs of operation and maintenance and (iii) such
3 amounts as may be required to cover emergencies and
4 anticipated delinquencies.
5 Further, any change in a rate recommended to
6 the Board of Trustees by the Rate Commission is to be
7 accompanied by a statement that the proposed rate change
8 is (i) consistent with constitutional, statutory or common
9 law as amended from time to time; (ii) enhances the
10 District's ability to provide adequate sewer and drainage
11 systems and facilities, or related services; (iii) is
12 consistent with and not in violation of any covenant or
13 provision relating to any outstanding bonds or
14 indebtedness of the District; (iv) does not impair the
15 ability of the District to comply with applicable Federal
16 or State laws or regulations as amended from time to time;
17 and (v) imposes a fair and reasonable burden on all
18 classes of ratepayers.
19 The Rate Commission received a Rate Change
20 Notice from the District on February 26, 2018. Under
21 procedural rules adopted by the Rate Commission, any
22 person affected by the Rate Change Proposal had an
23 opportunity to submit an application to intervene in these
24 proceedings. An application to intervene was filed by the
25 Missouri Industrial Energy Consumers.

1 The Rate Commission originally had until June
2 26, 2018 to issue its report on the proposed Rate Change
3 Notice to the Board of Trustees of the District. The Rate
4 Commission requested an additional 45 days to issue its
5 report, and on May 1st, 2018 the District Board of
6 Trustees granted the Rate Commission's request. The Rate
7 Commission must now issue its report on or before August
8 10, 2018.
9 Since February 26th, 2018 the Rate Commission
10 has received testimony from district staff, the intervenor
11 and the rate consultant. The parties have also engaged in
12 discovery requests. Technical conferences were held on
13 April 4th, 2018, May 17th, 2018 and June 7th, 2018. At
14 each of these the participants and the Rate Commission
15 were given an opportunity to ask questions of those
16 submitting testimony.
17 A pre-hearing conference for the purpose of
18 identifying any issues raised by the rate setting
19 documents and the prepared testimony submitted was
20 conducted on the record on June 21st, 2018. Each
21 participant in the pre-hearing conference submitted on or
22 before June 28, 2018 a pre-hearing conference report
23 describing the issues raised by the rate setting documents
24 and the prepared testimony, together with a brief
25 description of such participants' position, if any, on

1 each issue and the rationale therefore.
2 The public hearing was commenced on June 29th,
3 2018. The Rate Commission heard comments from the public
4 and received closing statements from the District, counsel
5 for Intervenor, Missouri Industrial Energy Consumers, and
6 from the Rate Commission's legal counsel. Exhibits
7 previously submitted were entered into the record.
8 In accordance with the revised procedural
9 schedule adopted on May 27th, 2018, the District, MIEC and
10 the Rate Commission's legal counsel filed their
11 pre-conference reports on June 28, 2018. Since these
12 reports were submitted the day before the final public
13 hearing, the public hearing was left open so that
14 commissioners could more thoroughly review the reports and
15 ask additional questions of the participants. Who is here

22 and Brian Malone of Lashly Baer, legal counsel to the Rate
23 Commission. Are there any procedural matters? Hearing

1 MS. MYERS: Do you -- go ahead.
2 MS. STUMP: Mr. Chairman, we would like to
3 note that there were additional exhibits that have been
4 added, and MSD 77 is the exhibit list as of July 2nd, so
5 we would like to include the exhibits up to that date.
6 Also, there was an exhibit, Rate Commission 78, which was
7 a sales and use tax rate that was also filed. And then
8 finally, we would like to note for the record that there
9 will be two additional transcripts that have not yet been
10 provided. MSD 79 will be the transcript of the June 21st
11 pre-hearing conference, and MSD 80 will be the transcript
12 of the June 29th public hearing, and then finally if we
13 reserve MSD 81 to be the transcript from today's public
14 hearing.
15 CHAIRMAN TOENJES: Thank you, Ms. Stump. Any
16 comments from the Rate Commissioners on those exhibits?
17 All right. All the documents identified will be admitted
18 into evidence in this rate change proceeding.
19 This is the final opportunity for the Rate
20 Commissioners to ask questions. Upon the conclusion of
21 this public hearing session, the 2018 stormwater rate
22 change proceeding will be closed and the Rate Commission
23 will begins its deliberations. So I'll ask at this time
24 do any Rate Commissioners have any final questions for any
25 of the various parties regarding any issue or element of

1 the proposed rate change?
2 COMMISSIONER BROCKMANN: I have a question.
3 CHAIRMAN TOENJES: Mr. Brockmann.
4 COMMISSIONER BROCKMANN: Ms. Myers, the last
5 time we met you made a distinction between this group
6 considering fair and reasonable versus what's most fair
7 and reasonable. What's the difference in the criteria
8 between those two in your evaluation?
9 MR. MYERS: The reason I made a distinction
10 between fair and reasonable and most fair and reasonable
11 is because I think the Commission here has heard there are
12 different ways of measuring and developing an impervious
13 rate to be used, and so the District has chosen a method
14 that we thought was best for us for the District and for
15 our ratepayers to use, and we feel that that method is
16 fair and reasonable.
17 In addition, that there are other methods out
18 there to be considered, but we decided that the method
19 that we proposed was what was most fair and reasonable for
20 our district.
21 COMMISSIONER BROCKMANN: Thank you.
22 CHAIRMAN TOENJES: Any other questions or
23 comments from any of the other Rate Commissioners? I have
24 one question for Mr. Hoelscher. At the last public
25 hearing there was some discussion about changes that were

1 ongoing with the consent decree and the impact that that
2 may have on future rate proceedings as we move away from
3 stormwater back to wastewater. Could you just provide a
4 current up-to-date status report of where that -- where we
5 are in the consent decree and any changes ongoing?
6 MR. HOELSCHER: The situation is essentially
7 the same as what I described -- as I last described. The
8 judge has issued the order that has put the consent decree
9 change into place. I'll be very brief. We've moved up by
10 five years work that needs to be done on solids handling
11 with incinerators, supposed to start in 2026, will now
12 start in 2021, and we've taken the tunneling work as part
13 of the CSO program that was supposed to start the
14 additional tunnels in 2021, moved those back to start
15 2026.
16 We've also added those five years onto the
17 edge of the schedule since those tunnels were the last
18 piece that was supposed to be done. We know it's going to
19 have a positive impact on the rate projections that we
20 provided the Rate Commission in the last wastewater
21 proposal. At the last Wastewater Rate Commission meeting
22 when we set the rates for 2017 to 2020, I think we
23 projected getting close to about a 50 percent increase
24 over four years from 2020 to 2024. Right now we believe
25 that's going to be significantly less for a lot of

1 reasons, one of those being the change in the consent
2 decree.
3 We are right now starting the process of
4 developing the wastewater rate proposal, so I don't have
5 any detailed numbers. That's the best I can give you
6 right now. We know it will have a positive effect. I
7 think the one thing that was indicated in the consent
8 decree approval by the judge that we know is positive is
9 that we're not looking at any more double digit increases
10 for the duration of the consent decree and I believe that
11 was stated in the document.
12 CHAIRMAN TOENJES: Thank you. Anyone else
