HomeMy Public PortalAboutRES2004-01_Sale of Real Property_11012004RESOLUTION Zoog _ 0 A RESOLUTION PROVIDING FOR THE SALE OF REAL PROPERTY OWNED BY THE CITY OF IONA, IDAHO, PURSUANT TO THE PROVISIONS OF TITLE 50, CHAPTER 14, IDAHO CODE; PARTICULARLY DESCRIBING SAID PARCELS; DECLARING THE CITY'S INTENT TO SELL CERTAIN REAL PROPERTY AT PUBLIC AUCTION FOR NOT LESS THAN A CERTAIN MINIMUM PRICE; SETTING A DATE FOR A PUBLIC HEARING PRIOR TO SAID SALE; AUTHORIZING SALE OF PROPERTY ON NEGOTIATED BASIS IF NO BIDS ABOVE THE MINIMUM PRICE ARE RECENED. BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Sale of Real Property. The City of Iona hereby declares its intent to sell and convey the following described parcel or parcels of real property owned by the City, but not used or needed for public purposes, pursuant to the provisions of Title 50, Chapter 14, Idaho Code, said real property being located in the City of Iona, Bonneville County, Idaho, and described as follows: Beginning at a point that is N. 00°04100"E. along the Section line 1395.856 feet and East 544.82 from the southwest Corner of Section 6, Township 2 North, Range 39 East of the Boise Meridian; running thence East 99.73 feet; thence North 147.43 feet more or less to the south Right -of -Way line of Rockwood Avenue; thence S 85°45'00" W. 100.00 feet more or less to a point that bears North from the Point of Beginning: thence South 140.02 feet more or less to the Point of Beginning. TOGETHER, with all improvements, easements, hereditaments, and appurtenances thereto, and subject to such rights, easements, covenants, restrictions, and zoning regulations as appear of record or used upon the premises. 51011.e . The City Council hereby declares the value or minimum price that will be accepted as consideration for the conveyance of such property as the sum of $60,000. Section 3. Publication of Notice. The City Clerk is hereby directed to publish a summary of the action contemplated by this Resolution in the Post Register and shall further publish a notice of a public hearing to consider the proposed sale of such property at public auction. Such notice shall be published at least once, not less than fourteen (14) days prior to the date of the hearing. Section 4. Sale of Property at Public Auction. Following such public hearing, the City Council may order that such parcel or parcels of property be separately sold by the City Clerk at public auction for cash to the highest bidder. The date and time of such public auction shall be determined by the City Clerk, provided the City Clerk shall first publish in the Post Register a "Notice of Sale of Public Property", which Notice shall contain a legal description of the property, its street address and the date, terms and conditions of the public auction. Such notice shall be published at least once, not less than fourteen (14) days prior to the date of the auction. Notwithstanding the foregoing, the City Council may reject any and all bids. No bid shall be accepted at such auction for less than the declared value or minimum price as set forth above. Further, the City Council reserves the right to reject any and all bids. Section 5. Failure to Receive Minimum Sales Price. In the event no bids are received equal to or in excess of the declared or minimum sales price of the property, the -2- City Council may sell the property either for cash or under contract under such terms and conditions as it deems in the best interest of the City and as permitted by law.
