AMENDING CHAPTER 2.1, AIRPORT, OF THE TOWN CODE TO
PROVIDE FIXED BASE OPERATORS FEES.
WHEREAS, Section 5.1-44 of the State Code authorizes
establishment of fees for use of municipal airports; and
WHEREAS, Chapter III, Section 12, Paragraph 9, of the
Leesburg Airport Rules requires airport fixed base operators to
pay fees for services provided at the Leesburg Airport; and
WHEREAS, the town annually budgets and expends funds for
the operation and improvement of the airport for the benefit of
fixed base operators and other users:
ORDAINED by the Council of the Town of Leesburg, Virginia,
as follows:
SECTION I. Chapter 2.1 of the Town Code is hereby
amended by adding a new section to be numbered Section 2.1-6, to
read as follows:
Sec. 2.1-6. Fixed Base OperatOrs Fees
(a) Before any person is issued a fixed base operators
license under Chapter 3, Section 12, of the Leesburg Air-
port Rules, he shall pay to the town all of the
fees as determined herein. Fees collected shall
be credited to the Airport Fund in the accounts of the
town and used exclusively to pay the cost of operating
the airport and making improvements to it for the benefit
of the fixed base operators and other users.
(b) Fees for a fixed base operator's first
year of operations shall be based on estimates of gross
receipts from operations and adjusted after the close of

the fiscal year for actual receipts. Fees for the
following years shall be based on gross receipts of
the preceding years.
(c) Every person who is conducting, operating or
engaging in any of the following services for profit
at the Leesburg Airport shall pay to the town all of
the fees hereinafter provided:
(1) Aircraft sales. For each aircraft sales
license, $20.00 plus 0.25% of the licensee's gross re-
ceipts from aircraft sales.
(2) Parts and accessories sales. For each
parts and accessories sales license, $20.00 plus one
percent of the licensee's gross receipts from parts
and accessories sales.
(3) Charter operationst etc. For each char-
ter operations license, which includes, without limi-
tation, passenger or "air taxi", freight or delivery,
photography, aerial survey, agricultural spraying,
$20.00 plus one percent of the licensee's gross re-
ceipts from such operations.
(4) Aircraft rental. For each aircraft ren-
tal license, $20.00 plus one percent of the licensee's
gross receipts from aircraft rental.
(5) Flight instruction or ground schools.
For each flight instruction or ground school license,
$20.00 plus one percent of the licensee's gross re-
ceipts from flight instruction or ground schooling.
(6) Maintenance services. For each mainte-
nance service license, $20.00 plus one percent of the
licensee'~ ~ross receipts from maintenance services.
7 Line services. For each line services
license, $20.00 plus one percent of the licensee's
gross receipts for line services.
(8) Aircraft storage. For each aircraft
storage license, $2.00 per month for each occupied
outdoor aircraft storage space and $3.00 per month
for each occupied inside aircraft storage space.
SECTION II. An emergency is declared and this ordinance
shall be in effect from the date of its passage.
