Minutes - January 4, 2019MINUTES OF THE MEETING OF THE RATE COMMISSION OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT The Members of the Rate Commission of the Metropolitan St. Louis Sewer District met on January 4, 2019, at 9:00 a.m. at the District’s Administrative Offices at 2350 Market Street, Room 109 in St. Louis, Missouri. Commissioners Bowdry, Bresnan, Brockmann, Croyle, Hawes, Mahfood, Ratzki, Schoedel, Stein, and Toenjes were present in person. Commissioners Beckmann, Palans, and Ziegler were present by telephone conference. Commissioners Goss and Mahanta were absent. Also present were Brian Hoelscher, Executive Director, and Susan Myers, General Counsel, of the Metropolitan St. Louis Sewer District (the “District”); Pamela Lemoine of Black & Veatch, Rate Consultant to the Rate Commission; and Lisa O. Stump and Brian J. Malone of Lashly & Baer, P.C., counsel for the Rate Commission. Agenda Item 1 – Call to Order Mr. Toenjes served as Chair and declared that a quorum was present and called the meeting to order. Agenda Item 2 – Approval of Minutes Ms. Stump presented the Commission with draft minutes from the Rate Commission’s meeting on December 13, 2018. A motion was made by Commissioner Mahfood to accept the December 13, 2018 minutes as presented. Commissioner Brockmann seconded the motion. A voice vote was taken. All Commissioners present voted Aye. No Commissioners voted Nay. No abstentions. The minutes from the December 13, 2018 meeting were approved and signed by Secretary Mr. Schoedel. Agenda Item 3 – 2019 Wastewater Proceedings A discussion was held regarding the draft revisions to the Rate Commission’s Operational Rules. A number of amendments to the revised Operational Rules were proposed. Guidance was provided to the Rate Commission’s legal counsel to prepare final versions for consideration at a subsequent meeting. A motion was made by Commissioner Brockmann to direct Legal Counsel to revise the Operational Rules with the amendments proposed by Commissioners at this meeting, to be submitted for final approval at the next meeting of the Rate Commission. Commissioner Mahfood seconded the motion. A voice vote was taken. All Commissioners present voted Aye. No Commissioners voted Nay. No abstentions. A discussion was held regarding the draft Procedural Schedule for the Rate Commission’s 2019 proceedings. Revisions to the draft were considered by the Commission. Guidance was provided to the Rate Commission’s Legal Counsel to prepare final versions based on the discussion for consideration at a subsequent meeting. The Rate Commission addressed a request of District staff relating to the process in general. 2 Brian Hoelscher expressed concern regarding evidence submitted late in the process, that the District be given an opportunity to comment upon or rebut any evidence considered by the Rate Commission after deliberations have begun, though he noted that no formal rule change was necessary. Agenda Item 4 – Other Business Commissioner Brockmann discussed this morning’s Public Relations Committee Meeting, and spoke of efforts to reach out to potential intervenors, and to improve community outreach in general. Commissioner Brockmann proposed reviewing the Vandiver Group’s recommendations from the previous Rate Commission proceeding at a subsequent meeting of the Rate Commission. A brief discussion was held regarding scheduling. Meetings were tentatively scheduled for 9:00 a.m. on March 4th and 8th, to review the Rate Change Proposal and for a work session with the Rate Commission’s consultants, respectively. Agenda Item 5 – Adjournment A motion to adjourn was made by Commissioner Stein. Commissioner Bresnan seconded the motion. A voice vote was taken. All Commissioners present voted Aye. No Commissioners voted Nay. No abstentions.
