HomeMy Public PortalAbout1978_09_27_O031 TOWN OF LEESBURG IN LOUDOUN COUNTY, VIRGINIA PRESENTED September 27, 1978 ORDINANCE NO. 78-0-31 AN ORDINANCE: ADOPTED September 27, 1978 AMENDING SECTIO5~i-13 AND 11-1 OF THE TOWN CODE REGARDING MISDEMEANOR PENALTIES BE IT ORDAINED by the Council of the Town of Leesburg, Virginia, as follows: SECTION I. Section 1-13 of the Town Code is hereby amended to read as follows: Sec. 1-13. General penalty; continuing violations. Wherever in this Code, or in any ordinance or resolution of the municipality, or rule or regula- tion or order promulgated by any officer or agency of the municipality under authority duly vested in him or it, any act is prohibited or is declared to be unlawful or an offense or a misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, and no specific penalty is provided for the violation thereof, the violation of any such provision of this Code or any such ordinance, resolution, rule, regulation or order shall be punished as if guilty of a Class 1 misdemeanor, as defined in Section 18.2-11 of the Code of Virginia (1950); provided, however, that such penalty shall not exceed the penalty prescribed by the Code of Virginia for a like offense. Each day any viola- tion of this Code, or any such ordinance, resolution, rule, regulation, or other, continues shall consti- tute a separate offense. SECTION II. Section 11-1 of the Town Code is hereby amended to read as follows: Sec. 11-1. Attempts to commit misdemeanor. Every person who, within the jurisdiction of the municipality, attempts to commit an offense which is -2- a misdemeanor shall be punishable by the same punish- ment prescribed for the offense, the commission of which was the object of the attempt.
