HomeMy Public PortalAbout1992-230 ORDINANCE NO. 1992 -23 AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE CHAPTER 801 -05 CHAPTER 807 -15 WHEREAS, the Plan Commission of the City of Greencastle, has initiated and prepared this ordinance to amend the Greencastle Planning and Zoning Ordinance; WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on October 27, 1992, after timely notice of the hearing was given by publication in the Banner - Graphic Greencastle, Indiana, on October 16, 1992; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the factors enumerated in IC 36 -7-4 -603 in consideration of the ordinance and determination of a recommendation made to the Common Council; WHEREAS, the Greencastle Plan Commission has certified this ordinance to the Common Council with a favorable recommendation by a majority vote in favor of adoption; and WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in IC- 36 -8-4 -603 before acting on this ordinance; WHEREAS, the Common Council has determined that this ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. Therefore, BE IT ORDAINED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA: r� L SECTION I. DEFINITIONS That the City of Greencastle Planning and Zoning Ordinance, Chapter 801 -5 of the City of Greencastle Code, is hereby amended by adding the following definition: GUEST HOUSE/ CARETAKER'S RESIDENCE An accessory residence located to the rear of an existing single - family residence to provide temporary housing for guests or permanent housing for employees serving the primary residence. Subject to the following restrictions: 1. A guest house /caretaker's residence may not be rented to the public. 2. A minimum lot size of five (5) acres is required. 3. All property development standards of the District must be met. 4. The guest house /caretaker's residence must have a separate lateral connection to the sanitary sewer (if located within the City) or a separate septic tank system meeting all State and County requirements. SECTION II. • That the City of Greencastle Planning and Zoning Ordinance, Chapter 807 -15 is hereby amended by adding the following special exception use: 23. Harmless Mayor ATTEST: 1 Ju ith Be rry, C r- Treasurer SYNOPSIS This ordinance amends the Greencastle Zoning Ordinance to establish a definition for a guest house%aretaker's residence and establishes property development standards for such use; it further makes guest house%aretaker's residence a special exception use in AG Districts. 40
