RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY REVERSING DECISION OF THE
PLANNING COMMISSION AND DENYING THE APPLI-
CATION OF DELORES R. VAN PETTEN FOR A ZONE
VARIANCE ON THE REAL PROPERTY LOCATED AT
10048 OLIVE STREET, TEMPLE CITY.
WHEREAS, on November 7, 1962, Delores R. Van Petten, here-
inafter referred to as "Applicant ", filed an application for a
zone variance on the real property located at 10048 Olive Street,
Temple City, California; and
WHEREAS, after notice duly given pursuant to the Temple
City Municipal Code, a public hearing was held before the Temple
City Planning Commission on the Applicant's petition (Planning
Commission Case No. 62 -41) on the 19th day of November, 1962,
at 7:30 o'clock P.M. in the Council Chambers of the Temple City
City Hall, located at 9664 East Las Tunas Drive, Temple City,
California; and
WHEREAS, at the public hearing referenced above, the
Applicant and all parties desiring to speak were given an oppor-
tunity to be heard; and
WHEREAS, upon close of the public hearing on the said
November 19, 1962, the Planning Commission granted the variance
requested; and
WHEREAS, within the time prescribed an appeal was filed
with the City Clerk against the aforesaid decision of the
Planning Commission; and
WHEREAS, pursuant to the appeal, a public hearing was duly
noticed and held on January 14, 1963, at 8:00 o'clock P.M. in
the afore - described Council Chambers before the City Council; and
WHEREAS, at the aforesaid public hearing held on January 10
1963, the appellants and Applicant were given full opportunity
to be heard and it was determined by the City Council to con-
tinue the public hearing to March 11, 1963, at 8:00 P.M. in the
aforesaid Council Chambers, to permit the protestants and the
Applicant to work out a mutually satisfactory agreement to sub-
divide the Applicant's property and certain other properties
southerly thereto; and
WHEREAS, the continued public hearing of March 11, 1963,
was duly noticed, and at said hearing on March 11, 1963, all
parties were given full opportunity to be heard; and
WHEREAS, the Applicant and appellants and others owning
property in the immediate area were unable to come to any agree-
ment concerning the development of the Applicant's property and
other properties southerly thereof; and
WHEREAS, the City Council has fully and completely con-
sidered the matter,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the area in which the Applicant's property
is located in Zone Case PC -62 -41 is located in an area which
requires additional consideration as to its proper uses and
development, which consideration shall be given to it under the
Master Plan program for the City of Temple City currently being
worked upon.

SECTION 2. That due to the na:;ure of the zoning, the
nature of the particular problem attendant to the Applicant's
property and the fact that the Applicant should again have the
opportunity to present the particular matter of the application
before the City Council after such time as the City Council
shall adopt its Master Plan, or sooner in the event of any un-
reasonable delay, the City Council does hereby deny the appli-
cation for a zoning variance and expressly overrules the decision
of the Planning Commission but grants leave to the Applicant to
file her request to reopen the application now on file, without
fee, for further action, which action shall only be taken after
public hearing before the Planning Commission in the same manner
as though an original application for zone variance were before
the Planning Commission.
