AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING A
PORTION OF A PUBLIC ALLEYWAY BETWEEN CASE AVENUE AND UNION
STREET NEAR MONROE STREET.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue and forever vacate the following public
right-of-way, finding the following described right-of-way surplus property of the City and
no longer needed for any public purpose:
Part of a 10.0 ft. wide Alley, being part of Morris Subdivision, of a part of
Outlot No. 86, in the City of Jefferson, Cole County, Missouri, as per plat
of record in Plat Book 3, Page 5, Cole County Recorder's Office, and
being more particularly described as follows:
BEGINNING at the northeast corner of Lot 26 of said Morris Subdivision;
thence North 41 degrees, 07 minutes, 54 seconds East, 10.0 feet to the
southerly line of Lot 5 of said Morris Subdivision; thence North 48
degrees, 52 minutes, 06 seconds West, along the southerly line of said
Lot 5 and Lot 4, 44.16 feet to the boundary of the previously Vacated
Alley, per Ordinance No. 11375, recorded in Book 320 Page 010, Cole
County Recorder's Office; thence South 42 degrees, 08 minutes, 06
seconds West, along the boundary of said Vacated Alley, 10.00 feet to a
point on the northerly line of Lot 27 of said Morris Subdivision; thence
South 48 degrees, 52 minutes, 06 seconds East, along the northerly line
of Lot 27 and Lot 26, 44.34 feet to the POINT OF BEGINNING of this
description.
Above description shown on Attached EXHIBIT A.
Section 2. All that portion of the above vacated Alley right-of-way described in
Section 1 is hereby retained as a perpetual easement for the construction,
maintenance, repair, relocation and operation of sanitary sewers, surface water
drainage and all public utility facilities, and no permanent buildings shall be located
within or upon said easement without the prior written consent of the City.
Section 3. The Alley right-of-way described in Section 1 is hereby relinquished,
and the statutory rights of reversion are hereby confirmed, as provided by the laws of
the State of Missouri.
Section 4. The Mayor and City Clerk of the City are hereby authorized to execute
any necessary legal documents required to confirm the relinquishment of the City's
interest in the tract described in Section 1, and confirming the reversionary rights
therein, subject to the easement rights being retained as per Section 2.
Section 5. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
