HomeMy Public PortalAbout1980_10_22_O017ORDINANCE NO. 80-0-17 AN ORDINANCE: AMENDING THE ZONING MAP TOWN OF LEESBURG IN LOUDOUN COUNTY, VIRGINIA PRESENTED October 22! 1980 ADOPTED October 22r 1980 WHEREAS, Rezoning Application #ZM-29 by SRL Properties, Inc. was referred by this Council to the Planning Commission on July 9, 1980; and WHEREAS, the Planning Commission, on August 21, 1980, held a public hearing on the application for rezoning; and WHEREAS, the Planning Commissio~ on September 5, 1980, recommended to this Council that the proposed rezoning be favorably considered con- tingent upon certain proffered conditions; and WHEREAS, this Council, on October 8, 1980, held a public hearing on the proposed rezoning and received a proffer, in writing, from Charles A. Ottinger, attorney for SRL Properties, Inc.,:.set~ing ~orth certain cpnditions which would become a part of the rezoning request: THEREFORE, ORDAINED by the Council of the Town of Leesburg, Virginia, as follows: SECTION I. The Leesburg Zoning Ordinance is amended to revise the Zoning District Map to change from F-1 to M-i, 89,576 square feet of land, located on the north side of Catoctin Circle and bounded by Joffe Properties on the north, other lands of SRL Properties, Inc. on the east, Catoctin Circle on the south and Harrison Street Extended on the west, in accordance with a plat prepared by Bengtson, DeBell and Elkins, Inc., dated July 31, 1979, subject, however, to the following proffered conditions submitted in accordance with the provisions of Section 11-8-4 of the Leesburg Zoning Ordinance: -2- At SRL Properties, Inc. exp~nse, install an additional drainage pipe under Catoctin Circle at its intersection with Town Branch, thereby increasing the capacity for drainage on the town branch, and to con- struct an earth berm on the east side of the creek, next to the dedicated portion of Harrison Street which has not been constructed, all in accordance with the plans and specifications prepared by Bengtson, DeBell, Elkin and Titus, Consulting Engineers and Surveyors, and as reviewed and approved by the Director of Engineering. 2. Perform the essential construction for erosion and sil- tation control. 3. Provide proper performance bonding with surety, in form acceptable to the town attorney. Pay a review and inspection fee to the Town in the amount of three-quarters of one percent (3/4ths pf 1%) of costs of improvements. SECTION II. This ordinance shall be in effect upon its passage.
