CITY OF TEMPLE CITY

NOVEMBER 25, 1963
INITIATION:
1. The regular meeting of the City Council of the City of Temple
IICity was called to order by Mayor Nunamaker at 7:30 P. M. City
2. Manager Woollett gave the invocation, followed by the Mayor
3. leading the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker
ABSENT: Councilman - Dickason
ALSO PRESENT: City Attorney Shatford and City Manager Woollett
APPROVAL OF MINUTES: Councilman Merritt moved to approve the
minutes of the regular meeting of November 11, 1963, as mailed
subject to a correction to a roll call vote to be corrected at
the next Council meeting, Councilman Fitzjohn seconded, roll
call vote to carry as follows:
AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilman - Dickason

UNFINISHED BUSINESS:
6. ORDINANCE NO. 63 -116: Second Reeding
City Attorney Shatford read title to Ordinance No. 63 -116
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DE
CLARING ITS INTENTION AND DESIRE TO HAVE CERTAIN TERRITORY WITH-
IN ITS BOUNDARIES ANNEXED TO THE CONSOLIDATED COUNTY FIRE PRO-
TECTION DISTRICT. Councilman Tyrell moved to waive further
reading, Councilman Fitzjohn seconded, roll call to carry as
follows: -
AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilman - Dickason
Councilman Tyrell moved to adopt Ordinance No. 63 -116, Councilmar:
Fitzjohn seconded, roll call vote to carry as follows:
AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT.: Councilman - Dickason
CONTINUED PUBLIC HEARING: 7:30 P. M. Appeal zone variance Case
#63 -62, Walter A. Sawyer and Emory F. Sawyer
City Attorney Shatford advised he had met with Mr. Sawyer and
his attorney John Shaw and they are willing to withdraw their
apps 1providing they can work out a sub- standard subdivision,
and it appears that it can be worked out and the City might call
for some adjustments which might be beneficial to the City. For
this reason he requested the Council to continue this to the
next meeting, to give them additional time to wotk this out with
the surveyor and engineer. Councilman Tyrell moved to continue
the public hearing to the next meeting at 7:30 P. M., Councilman
Merritt seconded, roll call vote to carry as follows:
AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilman - Dickason
8. INSTALLATION OF RAISED ISLAND ON LAS TUNAS DR. BETWEEN ROWLAND
AND BALDWIN:
The City Manager advised this recommendation from the Traffic
Commission was based upon the necessity for the new entrance
signs. Subsequent to the last meeting he talked to the City of
Arcadia and the sign will be placed on the existing island.
Councilman Tyrell moved to approve the use of the existing island
Councilman Fitzjohn seconded, roll call vote to carry as follows:
AYES: Councilmen- Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None

9. ORDINANCE NO. 63 -117: Urgency Ordinance
City Attorney Shatford read title to Ordinance No. 63 -117 AN
ORDINANCE OF THE CIT-Y OF TEMPLE CITY EXTENDING THE EFFECTIVENESS
OF ORDINANCE NO. 63 -110 TO PERMIT FURTHER CONSIDERATION OF ZON --
ING TO BE APPLIED TO A PORTION OF THE AREA LYING BETWEEN CLOVER -
LY AVENUE ON THE WEST, TEMPLE CITY BLVD. ON THE EAST, LAS TUNAS- -
DRIVE ON THE SOUTH, AND WOODRUFF AVE. ON THE NORTH. He explain-
ed this extension of time was necessary to give the City Council
ample time to consider matters coming before the Hearings being
held before the City Council on the Master Plan and the time
has run out on this zone freeze. We are very close to complet+nc
studies and on Nov. 19 the Planning Commission made recommenda-
tions to the Council. The Council must hold at least one public
hearing and will consider this subject area. The City is trying
to create a parking district encompassing a portion of this area
and a larger area and certain people residing in this area have
objected to their property being included therein. The present
area effected by this ordinance still includes lots #254, #253, -
and the north half of #252. This ordinance is enacted as a re-
sult of the Government Code as a result of the Legislature
adopting a law in the Government Code which permits cities to
hold zoning. Under the law we are allowed to do this to hold a
certain type of zoning until the Council can consider it. The
maximum period under the law that this can be frozen is one
year.
The Mayor announced 312% had signed up and promises made which
would make approximately 56% and it takes 60 %, and that is the
reason for this time extension. The City Attorney read in full
Ordinance No. 63 -117. Councilman Fitzjohn stated the prime in-
terest is parking interest and he believed it a good plan and
would approve this ordinance. Councilman Tyrell questioned
the good faith of this action and requested definite figures and
facts to support this action, Councilman Dickason stated he was
for progress in the City, and he felt the shopping area needs
improvement and he would be back of this. Councilman Merritt
stated you have to have an idea, and you have to have faith in
the idea, you have to have a start and he was in favor of this
now rather than later when the City would have to buy apartment
houses rather than old residences as at present, and he would
approve. Mayor Nunamaker made a motion to adopt urgency ordi-
nance No. 63 -117, Councilman Fitzjohn seconded.
At this time B. L. Meek, 6004 Rosemead, spoke in protest to
this ordinance, and questioned legality of this council meeting.
City Attorney Shatford advised this was a regular meeting of the
City Council and perfectly legal, and the Council can discuss
anything. There followed lengthy discussion by the Councilmen.
The Mayor called for the vote prior to which the City Attorney
read Ordinance No. 63 -117 in full. The Ordinance was adopted
as an urgency ord-i -nance by the following roll call vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker
NOES: Councilman - Tyrell
ABSENT: Councilmen -None
NEW BUSINESS:
10. PARKS & RECREATION COMMISSION RECOMMENDATION:
Item 5. Revised policy for the use of the picnic shelter at
Live Oak Park. Al Lindberg, Commissioner, advised the Commissir
on recommend approval. Following discussion of the various
recommendations on this item Councilman Tyrell moved to approve
Councilman Fitzjohn seconded, and carried..
11. PLANNING COMMISSION RECOMMENDATIONS:
1. Adoption of revised zoning map for the entire City.
The City Manager advised after four public hearings the Planning
Commission has recommended adoption of the map for new zoning
map, and recommended at this time before holding any ;discussions
concerning this matter that the Council solicit opinions of
the property owners, and set two hearings, one December 3, for
the portion of the City west of Temple City Blvd. and the second
on December 10 for the portion of the City east of Temple, Ci ty

Blvd. Councilman Tyrell moved to set the Public Hearings as
recommended, Councilman Fitzjohn seconded, and carried,
2. Zone Chance Case #63 -69, to change area west of Arden, - -south
of Freer, eest of Glickman, and north of Green St., from A -1-
1 acre to R -1. The City Manager recommended the Council set for
Public Hearing this request for the next regular meeting on Dec.
9, 1963, at 7:30 P. M. Councilman Tyrell so moved, Councilman
Dickason seconded, and carried.
3. Tentative Tract #29148:
Ray Cushman, Planning Advisor, advised the zone change set for
Public Hearing is co- terminus to this Tract. This tentative
tract is recommended by the Planning Commission for approval
with amendments. Following discussion Councilman Fitzjohn
moved to approve the Tentative Tract #29148 with the conditions;
as amended, Councilman Merritt seconded. City Manager Woollett
advised this does not become effective unless the zone change
is approved. Rol+ call vote to carry the motion as follows:
AYES: Councilmen — Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker.
NOES: Councilmen -None

12: PRESENTATION OF DONATION TO THE CITY BY LOS-ANGELES COUNTY FIRE
FIGHTERS ASSN,
The City Manager advised the Assn, requested this be held over
until our next meeting.
13. APPEAL ZONE VARIANCE CASE #63 -64: Benj. Boyd, 10520 Key West.
The City Manager requested the City Council to set a Public
Hearing for 7:30 P. M. on December 23, 1963. Councilman Tyrell
so moved, Councilman Merritt seconded, and carried.
CANCELLATION BOND #33S- 56614BC in the amount of $244,650, secur-
ed by Shepard & Morgan from Aetna Casualty & Surety Co.
The City Manager advised this was completed and deeded to the- -
County and requested authorization to cancel the faithful per -
formance bonds. Councilman Fitzjohn so moved, Councilman Tyrell
seconded, and carried by the following roll call vote:
AYES: Councilmen—Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
15, RESOLUTION NO. 63 -328: warrants & Demands
Councilman Tyrell moved to adopt Resolution No. 63 -328, warrants
& demands in the sum of $56,252.20, demand Nos. 4339 through
4362, Councilman Fitzjohn seconded, carried by the following
roll call vote: —
AYES: Councilmen —Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
16. COMMUNICATIONS:
City Manager Woollett read a letter of request for a charitable
solicitation permit from the First Lutheran Church of Temple
City to sell Christmas cards on Nov. 29 in front of Gilbert --
Kell's and the Band Box, and also advised a certificate of in-
surance had been furnished. Councilman Tyrell m;vdd to grant,
IICouncilman Merritt seconded, and carried.
17, TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: —
Mrs. Those Hamilton, 4905 Kauffman asked for information regard-
ing what precise R -4 is and the Planning Advisor Ray Cushman
answered her questions.
A. L. Lindberg, 8932 E. Nadine, spoke regarding the tragic events
of the past week -end, and read an editorial commending the cour-
age and bravery of Mrs. Jacqueline Bouvier Kennedy. He recommenc
ed the City Council send letters to our Congressmen requesting
the Congress to act in haste and present the higheat award —
possible to bestow on a woman. Councilman Tyrell moved accord-
ing to the recommendation to send letters to investigate the
possibility of such action, Councilman Fitzjohn seconded, carries

City Manager Woollett presented an Agreement for execution be-
tween the City and the L. A. County Flood Control District con-
cerning the final pavement on Golden West Ave. which the City -
has requested be held up until the-City completes the installa-
tion of curb, gutter and sidewalk, and to transfer the funds .
necessary for this pavement to this City to be used for final
pavement when the above installation has been completed. He
requested the City Council to approve and instruct the Mayor and
City Clerk to sign the Agreement. Councilman Tyrell so moved,
Councilman Dickason seconded, roll call vote to carry as follows;

The City Manager recommended at this time that the Council re-
lease the faithful performance bonds posted by Jack Brkich with
reference to Temple City Improvement District #1. Councilman
Dickason so moved, Councilman Tyrell seconded, roll call vote
to carry as follows:
AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
City Manager Woollett presented a request of Alpha & Omega
Girl's organization requesting permission to conduct a food sale
in front of Fishers & Leibergs on Saturday, December 7. Coun-
cilman Fitzjohn moved to approve with insurance conditions,
Councilman Tyrell seconded, and carried.
Councilman Fitzjohn asked when the cross arms in the street
would come down and was advised by City Manager Woollett that
they are the property of Mr. Foley who has advised they will be
taken down very shortly.
Councilman Merritt advised the light at the corner of Kauffman
and La Rosa was damaged. Also the light at Oak and Woodruff
was reported damaged, and the red light in the area of Las Tunas
Dr. and Encinita was still operating. These will all be taken
care of.
Councilman Tyrell stated he.felt The City should recognize the
Lion's Club who put up flags and also, had black ribbons on them.
He felt it made the City look much better, and Mayor Nunamaker
also advised people were much impressed by this display.
Councilman Tyrell asked how the new zoning map will affect the -
horses and Planning Advisor Cushman advised there is a-particu-
lar period of time for normal abatement period for non- conform-
ing use and it is tied to the structure involved.
Councilman Tyrell advised the meeting called this morning he
did not acquiesce to as he felt the timing highly inappropriate
when the world is in mourning to schedule a Council meeting at
the time the President was being buried.
ADJOURNMENT:
Councilman Dickason moved to adjourn and carried. Council ad-
journed at 9:05 P. M. until the next regular meeting to be held
on December 7, 1963, at 7:30 P. Mo at the City Hall, 9664 E.
Las Tunas Dr., Temple City.
