Absent: None. Tiffm City Council present: Dave Shaffer, Karin Dils and Jim Bartels. Absent: Rodney Walls, and Mike Gericke. Also present: Mayor Glenn R. Potter,Attorney Stephen Greenleaf. Rick Dvorsky and R. J. Moore arrived at 6:13 p.m. Meeting called to order by Chair Steve Berner at the Tiffm Fire Station. Board of Supervisors Terrence Neuzil and Mike Lehman arrived at 6:30 p.m. Fringe area agreements are in place for Coralville,North Liberty and Iowa City. County staff are working on Lone Tree, Oxford, West Branch and Swisher. Hills is still working on zoning ordinances. Rick suggests what supervisors have review prior to this meeting to suggest that both the county and Tiffin select a committee consisting of two PZ members, two council members and city staff, two county PZ members, two board of supervisors members and county staff to formulate a plan that can be returned to each government entity for review and approval or nonapproval. This suggestion from Rick sounded good to all present. R. J. Moore explained that the county's first concern is to protect agricultural land in the county, to avoid increasing taxes in the county and to reduce the cost of services when ground is annexed into cities. The county is encouraging joint planning to help cities. Moore explained that the county has adopted a building code in the past year, and is the same code used by Tiffm. Moore explained that the current county plan took about five years to complete and is mainly aimed at protecting agricultural ground and increase density population rates inside cities, reducing sprawl in other parts of the county. Moore explained that the various 28 E agreements that the county has extended in the past makes some confusion about what government entity is to receive notification in planning affairs. He explained that the state code could not be violated unless a superseding 28 E agreement were in place. If the county found itself in conflict with a plan for Tiffin and a previous plan with another governmental plan, either Tiffm would have to alter their plan or a Tiffm/Johnson County agreement would have to be left incomplete. State code does regulate this question in absence of a 28 E agreement. The code says that whichever governmental entity is geographically closer is the entity that receives notice. Tiffm Planning and Zoning &Tiffm Council 1/2/02 Page 2 Motion Reeve, second Richardson to recommend approval of the committee plan for drawing up a fringe area plan that can then be submitted to both city and county for review,revision and eventual approval or disapproval, and that City Planning and Zoning committee members be Melvin Reeve and Steve Berner. Ayes: Reeve,Richardson, and Berner. Nays: None. Motion Dils, second Bartels to approve the committee plan for drawing up a fringe area plan that can then be submitted to both city and county for review, revision and eventual approval or disapproval. Ayes: Shafer, Bartels, and Dils. Absent: Walls, and Gericke. Motion carried. Mayor Potter appointed Dave Shaffer and Karin Dils to represent the City of Tiffm on the planning committee to create a plan a fringe area plan with Johnson County that can be submitted to both city and county for review, revision and eventual approval or disapproval. Johnson County Planning and Zoning is set for January 14, and members for this working committee will not be selected until after this date. Mayor Potter requested the Johnson County Board Members to stop action by the City of Coralville to take county and Clear Creek Amana tax collections for use in a conference city proposed to be owned by the City of Coralville. The City of Tiffinis especially concerned about school requirements that will be necessary for this growing area. Mayor Potter thanked Board Members Neuzil and Lehman, Rick Dvorsky and R. J. Moore,Johnson County Zoning staff members for attendance at the meeting. Joe Johnston, Chad Freeman and Greg Stevens were in attendance to consider possible plans for the parcels situated between Main and Grant from Third Street to Marengo Road. Joe has a poor building and he has to decide whether to patch it minimally for use as a rental, or to attempt to gain rezoning that would allow placement of a newer higher density more valuable building. Mr. Johnston explained that at this point, it doesn't matter to him which way he will go with his plans. Commercial zoning for the entire block area was also considered. Greg Stevens volunteered that he did not believe with the new mall two miles down Hwy#6 that it was any time soon that commercial property would be in demand in the Tiffm area. Stevens did not see a need to zone this entire area commercial at this time, and does not desire to hold commercial property that no one is willing to purchase. Motion Berner, second Richardson to receive the oral application from Joe Johnston for a R 2.5 zoning request for the lot at the southeast corner of Third and Main to the second lot south of Hwy# 6 along the east side of Main Street. Application materials to follow Tiffin Planning and Zoning 1/02/02 Page 3 Tiffin City Council with Attorney Greenleaf to secure city paperwork requirements in this matter. This east side of Main Street between Third and Hwy# 6 already has multiple units on the east end of these lots. Ayes: Berner, and Richardson. Nay: Reeve. Absent: None. Greg Stevens indicated approval of this kind of plan. Councilmember Bartels left the meeting at 8:02 p.m. Zoning change for business use in residential area, no requestor present. Motion Reeve, second Richardson that no change in zoning be recommended a business use within residential zoning. Ayes: Reeve,Berner, and Richardson. Nay: None. Motion carried. Motion Richardson, second Reeve to recommend approval of Johnson County request #501048 from Marty Beckler, Beckler Subdivision Farmstead Split on 340th Street west of Ireland and Ivy Avenue in the county. Ayes: Reeve, Richardson and Berner. Nay: None. Motion carried. Review of JCCOG question on cooperative committee work on location of communication towers in the area. Motion Reeve, second Berner that a effort for the City of Tiffm to work with a committee of county people to determine tower locations not be recommended for approval by the City Council. Ayes: Berner, Reeve and Richardson. Nay: None. Motion carried. Motin Richardson, second Berner that minutes with correction be approved. Ayes: Reeve, Richardson, and Berner. Motion carried. Motion Reeve, second Berner to adjourn. Motion carried to adjourn. Planning and Zoning Commission adjourned 8:30 p.m. Motion Shafer, second Dils to adjourn.
