APPROVING CHANGE ORDER # 1

2003 MISCELLANEOUS BASE REPAIR PROGRAM
WHEREAS, the Governing Body of the Borough of Carteret has previously
awarded a contract to the Define Contracting Company in the amount o£
$59,940.00 for the 2003 Miscellaneous Base Repair Program; an
WHEREAS, the Borough's Consulting Engineer for the project, T & M
Associates, has advised the Governing Body that a modification of thc contract is
reasonable and necessary and has recommended that the aforesaid contract be
modified in accordance with Contract Change Order #1 (See attached); and
WHEREAS, Change Order # 1 includes a change in the description of work to
reduce and increase quantities to reflect as built conditions and to add
supplemental items required for additional work; and
WHEREAS, Change Order # 1 provides for a net increase in the contract price in
the amount of $6,885.00 resulting in a revised contract price of $66,825.00,
including all previously approved Change Orders; and
WHEREAS, the Borough's Consulting.Engineer, T & M Associates has advised
that the above described changes and/or modifications to the project were
unforeseen at the time o£ the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret as follows:
1. That the Contract Change Order #1 attached hereto and made a
part hereof, resUlting in a net increase of $6,885.00 in the overall
contract price, including all previous Change Orders, resulting in a
revised contract price of $66,825.00 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to
execute Change Order #1 based upon thc recommendation of the
Borough Engineer.
3. That the Borough Purchasing Department is hereby authorized to
execute paymcnt pursuant to Payment Certification No. 1 (See
Attached).
4. A copy of this resolution and a ~lly executed copy of Change
Order #1 be forwarded to T&M Associates for distribution to
DeFine Contracting Co.
