AN ORDINANCE: ADDING A NEW SECTION 10-158.1 TO THE TOWN CODE CONCERNING DISPOSITION
OF INOPERABLE AB~iNDONED VEHICLES
ORDAINED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. Chapter 10 of the Town Code is amended by adding a new Section to
be known as Section 10-158.1 to read as follows:
Sec. 10-158.1. Disposition of inoperable abandoned vehicles.
(a) As used in this article the worm "abandoned motor vehicle" means a motor
vehicle, trailer, or semitrailer or part thereof that:
(1) Is inoperable and is left unattended on public property for more
than 48 hours, or
(2) Has remained illegally on public property for a period of more than
48 hours, or
(3) Has remained without consent on private property, including but not
limited to any commercial parking place, motor vehicle storage facility, or
establishment for the service, repair, maintenance or sale of motor vehicles,
whether or not such vehicle is brought onto or left at such property with or
without the consent of the owner or person in control of the property for more
than 48 hours.
(b) Notwithstanding any other provision of this Chapter, or the provisions
of Section 46.1-88 of the Code of Virginia, as amended, when in the opinion of the
Chief of Police, any abandoned motorvehicle, trailer, semitrailer orparttb~reof 'which is
inoperable and which, by virtue of its condition, cannot be feasibly restored to
operable condition, may be disposed of to a demolisher, without the title and without
the notification procedures, by the person, firm, corporation, or political subdivision
on whose property or in whose possession such motor vehicle, trailer or semitrailer
is found. The demolisher, upon taking custody of such motor vehicle, trailer or
semitrailer, shall notify the Division of Motor Vehicles, on forms and in the manner
prescribed by the Commissioner and, notwithstanding any other provision of law, no
other report or notice shall be required in such instance.
This ordinance shall be in full force and effect from and after
