AN ORDINANCE: TOWN OF LEESBURG IN LOUDOUN COUNTY, VIRGINIA PRESENTED February 10, 1982 82-0-6 ADOPTED February 10, 1982 AMENDING THE LEESBURG ZONING ORDINANCE TO REVISE SECTION 1-3, ANNEXATIONS WHEREAS, the Leesburg Zoning Ordinance does not adequately provide regula- tions for all of the uses and conditions which may exist in a newly annexed territory; and WHEREAS, the temporary application of a zoning ordinance is permitted by Section 15.1-491(b) of the Code of Virginia; and WHEREAS, it is in the best interest of both the town and any newly annexed areas to temporarily continue the regulations and zoning district designations of the zoning ordinance of Loudoun County until the town revises its plan to accomodate newly annexed areas and amends its zoning ordinance appropriately; and WHEREAS, this Council initiated amendment of the Leesburg Zoning Ordinance to revise Section 1-3, Annexations, on January 13, 1982 and gave notice of a joint public hearing of the Town Council and Planning Commission held February 10, 1982 at which time interested persons were given an opportunity to express their views; and WHEREAS, the Planning Commission on February 10, 1982 determined that the pub- lic necessity, convenience, general welfare and good zoning practice required amend- ment of Section 1-3 of the Leesburg Zoning Ordinance:- THEREFORE, RESOLVED by Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 1-3 of the Leesburg Zoning Ordinance is amended to read as follows: -2- Sec. 1-3 Unzoned Property and Annexations. (a) In case any property has not been included specifically within one dis- trict or another, such property shall be classified automatically in the "R-i" district until reclassified. (b) The Zoning Ordinance of Loudoun County, as effective on the date this section is adopted, is made a part of this ordinance by reference as if fully set out herein to provide temporary zoning regulations applicable only to property which may be annexed or otherwise added to the incorporated area of the town pend- ing the orderly amendment of the Leesburg Zoning Ordinance following such annexation or addition. Ail property annexed or otherwise added to the incorporated area of the town shall be automatically classified in the same zoning district as the pro- perty was classified under the Zoning Ordinance of Loudoun County as adopted here- in and shall be governed by the provisions of the Zoning Ordinance of Loudoun County including any existing proffered conditions. Whenever reference is made to a particular officer, department, board, commission or other agency in the Zoning Ordinance of Loudoun County adopted herein, such reference shall be construed as referring to the comparable officer, department, board, commission or other agency of the town. Fees to be charged for applications for zoning permits, variances, special exceptions and interpretations of the zoning district map, appeals to the Board of Zoning Appeals and petitions for amendment of the zoning map pertaining to all property annexed or otherwise added to the incorporated area of the town shall be as set out in the Leesburg Zoning Ordinance. Any amendments of the Loudoun County Zoning Ordinance between the effective date of this section and the effective date of any annexation shall be considered by the Planning Commission for adoption by reference herein.
