HomeMy Public PortalAbout14-11 Adopting a Millage Rate for 2014-20151st Reading/public Hearing: 09/10/2014 2nd Reading/public Hearing: 09/24/2014 Continued 09/29/2014 Adopted: 09/29/2014 Effective Date: 10/01/2014 Sponsored By: City Manager ORDINANCE NO. 14 -11 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING A FINAL MILLAGE RATE PURSUANT TO SECTION 200.065, FLORIDA STATUTES, FOR FISCAL YEAR 2014 -2015, COMMENCING OCTOBER 1, 2014 THROUGH SEPTEMBER 30, 2015; SETTING FORTH PUBLIC HEARING DATES; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR REPEAL OF ALL PRIOR ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on July 30, 2014, the City Commission of the City of Opa- locka, Florida ( "City Commission ") adopted Resolution No. 14 -8832, setting the tentative millage rate of 8.9000 for Fiscal Year 2014 -2015, commencing October 1, 2014 and ending September 30, 2015, and scheduled public hearings on September 10, 2014, September 24, 2015 and September 29, 2014; and WHEREAS, a resolution setting the tentative millage rate appeared on the September 10, 2014 City Commission agenda; and WHEREAS, in order to ensure broad notice and allow for public input, public hearings were noticed and set for September 10, 2014, September 24, 2014 and September 29, 2014; and WHEREAS, the Miami -Dade County Property Appraiser has determined the non - exempt net aggregate value of taxable property (real, personal and centrally assessed properties), in the City of Opa -locka for the Fiscal Year 2014 -2015 to be $661,065,490; and WHEREAS, public hearings on September 10, 2014, September 24, 2014 and September 29, 2014, will allow for public comment on, and consideration by the City Commission of the proposed millage rate; and ORDINANCE NO. 14 -11 WHEREAS, the public and all interested parties have had the opportunity to address their comments to the City Commission regarding the millage rate; and WHEREAS, having considered the comments of the public regarding the millage rate, the City Commission of the City of Opa -locka desires to adopt a final millage rate for Fiscal Year 2014 -2015. NOW THEREFORE, THE COMMISSION OF THE CITY OF OPA -LOCKA HEREBY ORDAINS: Section 1. The foregoing recitals are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance. Section 2. The City Commission of the City of Opa -locka hereby adopts and establishes the millage rate of the City of Opa -locka for Fiscal Year 2014 -2015, commencing October 1, 2014, through September 30, 2015, at 8.5000 mills, which is $8.5000 per $1,000.00 of assessed property value within the City of Opa- locka. This represents a -0.53% decrease over the rolled -back rate of 8.5454 mills. Section 3. Public hearings are to be held by the Commission on September 10, 2014, September 24, 2014 and September 29, 2014. Section 4. The City Clerk of the City of Opa -locka is hereby directed to transmit a certified copy of this Ordinance to the Miami -Dade County Property Appraiser and the Tax Collector of Miami -Dade County. Section 5. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 6. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent ORDINANCE NO. 14 -11 jurisdiction, such portion shall be deem a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 7. This Ordinance shall, upon adoption, become effective as specified by the City of Opa -locka Code of Ordinances and the City of Opa -locka Charter. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA: Section 1. The recitals to the preamble are hereby incorporated by reference. Section 2. The proposed tax levy and millage rate for the City of Opa- locka, Florida for Fiscal Year 2014 -2015, commencing October 1, 2014, through September 30, 2015, is hereby proposed to be 8.9000 mills, which is $8.9000per $1,000.00 of assessed property value within the City of Opa- locka. This represents 4.15% increase over the rolled -back rate of 8.5454 mills, which is $8.5454 per $1,000 of assessed property value within the City of Opa- locka. Section 3.
