PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Parker presided and the following business was conducted: ROLL CALL Councilors present were Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Howard "Jack" Elstro. APPROVAL OF MINUTES Councilor Welch moved to approve the minutes of the meeting of April 21, 2008, with a second by Councilor Quinn. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 2 -2008 — A RESOLUTION OF RICHMOND COMMON COUNCIL SUPPORTING THE RICHMOND COMMUNITY SCHOOLS FOR THEIR ADOPTION OF A STUDENT DRESS CODE This Resolution was read in its entirety by Walt Chidester, City Attorney. Councilor Welch moved to accept Resolution No. 2 -2008, with a second by Councilor Goodwin. Upon a vote viva voce, the motion passed. RESOLUTION NO. 3 -2008 - A RESOLUTION OF RICHMOND COMMON COUNCIL AUTHORIZING THE LEASE PURCHASE AGREEMENT OF ONE FIRE TRUCK FOR THE RICHMOND FIRE DEPARTMENT AND TWO STREET SWEEPERS FOR THE RICHMOND STREET DEPARTMENT Presented by Fire Chief, Mike Crawley, and Street Commissioner, Bill Smith, this Resolution would authorize the City of Richmond to enter into lease purchase agreements for one fire truck and two street sweepers. Councilor Wissel questioned the cost effectiveness of this plan because of the interest paid over the five year lease. City Controller, Tammy Glenn, explained the City would pay a lower interest rate by combining the three pieces of equipment. Councilor Quinn moved to approve Resolution No. 3 -2008, with a second by Councilor Cruse - Nicholson. The motion failed with a 2 -6 roll call vote. Dissenting were Councilors Wissel, Miller, Welch, Pappin, Goodwin and Parker. Councilor Wissel moved to create Resolution No. 4 -2008 to reflect the lease purchase of the street sweepers only, with a second by Councilor Welch. The motion passed with a 7 -1 roll call vote. Dissenting was Councilor Cruse - Nicholson. COMMUNICATION FROM THE MAYOR ■ May is Historic Preservation Month. On May 12 there will be an unveiling of a sign designating Richmond a Preserve America Community. This sign will be located at the Madonna of the Trail in Glen Miller Park. ■ The Comprehensive Plan will be introduced to the public on May 15. There will be a reception prior to the regularly schedule Plan Commission meeting. The final Neighborhood Spring Clean -Up will be Saturday, May 10 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the April 17 & 24, 2008 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS ■ Approximately 50 Richmond High School students were present. This is a requirement for credit in their Government class. ■ Visioning is hosting an Elected Officials Meeting on June 4 and the Golay Center in Cambridge City. ORDINANCES ON FIRST READING Councilor Wissel moved to suspend the rules and read Ordinance Nos. 31, 32, 34, 35 & 36 -2008 on first reading by title only, with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. ORDINANCE NO. 31 -2008 - AN ORDINANCE AUTHORIZING THE SUBMITTAL OF THE CFF APPLICATION TO THE INDIANA OFFICE OF COMMUNITY AND RURAL AFFAIRS AND ADDRESSING RELATED MATTERS (Parks Master Plan) Common Council Minutes May 5, 2008 Page 2 of 3 The Clerk read Ordinance No. 31 -2008 on first reading by title only Presented by Sonia Brock, Director of the Department of Parks and Recreation, this Ordinance would authorize the City of Richmond to submit a planning grant application for grant funding in the amount of Twenty Thousand Dollars ($20,000.00) to address a Parks & Recreation Master Plan and to execute and administer a resultant grant. Expressly subject to the City of Richmond receiving CDBG Planning funding from the Indiana Office of Community and Rural Affairs, The City would commit to provide local funds in an amount up to Three Thousand Dollars ($3,000.00), in the form of local funds, as matching funds for said program. Councilor Welch moved to advance Ordinance No. 31 -2008 to second reading and to suspend the rules and read by title only with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 31 -2008 on second reading by title only. Council President Parker declared Ordinance No. 31 -2008 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 31 -2008 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 31 -2008 to third and final reading and suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 31 -2008 on third reading by title only. Ordinance No. 31 -2008 was adopted with an 8 -0 roll call vote ORDINANCE NO. 32 -2008 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE WHITEWATER VALLEY REMC COMMUNITY TRUST INC. (Park Dept. — Summer Movies) Councilor Miller moved to strike Ordinance No. 32 -2008, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. ORDINANCE NO. 34 -2008 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION (West End Bank) The Clerk read Ordinance No. 34 -2008 on first reading in its entirety. Presented by Tony Foster, this Ordinance would authorize the City of Richmond to accept a donation from West End Bank in the amount of Six Hundred Dollars ($600.00) to be used to fund the catering for the Comprehensive Plan Implementation Open House Celebration. Councilor Welch moved to advance Ordinance No. 34 -2008 to second reading and to suspend the rules and read by title only with a second by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 34 -2008 on second reading by title only. Council President Parker declared Ordinance No. 34 -2008 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 31- 2008 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Ordinance No. 34 -2008 was adopted with an 8 -0 roll call vote ORDINANCE NO. 35 -2008 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION (RP &L) The Clerk read Ordinance No. 35 -2008 on first reading in its entirety. Presented by Tony Foster, this Ordinance would authorize the City of Richmond to accept a donation from Richmond Power and Light in the amount of Three Hundred Dollars ($300.00) to be used to fund the catering for the Comprehensive Plan Implementation Open House Celebration. Councilor Wissel moved to advance Ordinance No. 35 -2008 to second reading and to suspend the rules and read by title only with a second by Councilor Cruse - Nicholson. Presented by Tony Foster, this Ordinance would authorize the City of Richmond to accept a donation from Hill's Pet Nutrition in the amount of Three Hundred Dollars ($300.00) to be used to fund the catering for the Comprehensive Plan Implementation Open House Celebration. Councilor Welch moved to advance Ordinance No. 36 -2008 to second reading and to suspend the rules and read by title only with a second by Councilor Cruse - Nicholson. Ordinance No. 36 -2008 was adopted with an 8 -0 roll call vote ORDINANCES ON SECOND READING ORDINANCE NO. 22 -2008 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Innatech, LLC) The Clerk read Ordinance No. 22 -2008 on second reading by title only. This Ordinance is a request of Innatech, LLC for a 10 -year tax abatement for manufacturing equipment valued at $12,780,500. The Tax Abatement Committee requested Ordinance No. 22 -2008 be held awaiting additional information being obtained from the Petitioner. ORDINANCE NO. 23 -2008 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Innatech, LLC) The Clerk read Ordinance No. 23 -2008 on second reading by title only. This Ordinance is a request of Innatech, LLC for a 10 -year tax abatement for real estate valued at $2,513,574. The Tax Abatement Committee requested Ordinance No. 23 -2008 be held awaiting additional information being obtained from the Petitioner.
