A RESOLUTION: AWARDING THE CONTRACT TO MADIGAN CONSTRUCTION, INC.
FOR THE WEST MARKET STREET - AYR STREET TO MORVEN
PARK ROAD SIDEWALK IMPROVEMENTS PROJECT AND MAKING
A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $270,000
WHEREAS, the West Market Street - Ayr Street to Morven Park Road Sidewalk
Improvement project is a funded capital project in the Fiscal Year 2020—2025 Capital Improvement
Program(CIP); and
WHEREAS,this project addresses the 2019 Accessibility Survey that identifies a number of
physical barriers on this section of sidewalk that prevent compliance with the 2010 Americans with
Disabilities Act (ADA) standards; and recommends that these barriers be removed in their entirety
in order to reduce the Town's exposure to liability resulting from awareness of unresolved
compliance concerns; and
WHEREAS, in response to a public solicitation for construction of this project, the Town
received two responsive bids on February 25,2020 from the following firms:
• Madigan Construction, Inc. $1,579,790.00
• Crown Construction Service, Inc. $1,823,167.82
WHEREAS, Madigan Construction, Inc. was determined the lowest responsive and
responsible bidder; and
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the contract price; and
WHEREAS, the Director of Public Works and Capital Projects recommends awarding the
construction contract to Madigan Construction,Inc.; and
WHEREAS, existing funding for the project is Northern Virginia Transportation Authority
Local 30% funding for the sidewalk construction, and the Utilities Town-wide Waterline
Improvements and Repairs Capital Improvements Project for the watermain replacement; and

A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $270,000
WHEREAS, additional funds are required for this project in the amount of $270,000
comprised of $110,000 for dry utility relocations associated with Washington Gas and Verizon
required to complete the project and$160,000 to provide a 10% construction contingency; and
WHEREAS, a supplemental appropriation is needed to assign the required funds to this
project; and
WHEREAS, on March 4, 2020, the Town Zoning Administrator provided an official
interpretation regarding the use of proffered contributions as part of the rezoning application
Crescent Place,TLZM-2012-0013,as an appropriate use of the monetary proffers within the Proffer
8.0, Capital Facilities Contribution.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that:
1. The Town Manager is hereby authorized to execute a contract in a form approved by
the Town Attorney with Madigan Construction, Inc. in the amount of$1,579,790.00
for construction of the West Market Street Sidewalk Improvements - Ayr Street to
Morven Park Road project; and
2. The West Market Street Sidewalk Improvements - Ayr Street to Morven Park Road
project within the Capital Improvements Program is hereby amended and a
supplemental appropriation of$270,000 of proffered contributions from TLZM-2012-
0013 Crescent Place Proffer 8.0 Capital Facilities Contribution is made in the amount
of$270,000 for the fiscal year beginning July 1, 2019 and ending June 30, 2020.
