HomeMy Public PortalAbout05-19-2008PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, MAY 19, 2008 The Common Council of the City of Richmond, Indiana met in regular session Monday, May 19, 2008 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PARKER President Parker presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. APPROVAL OF MINUTES Councilor Wissel moved to approve the minutes of the meeting of May 5, 2008, with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ To date, the income for 2008 is down $1.7 million ■ The Comprehensive Plan was unveiled on May 15 ■ 107 warrants have been issued for tall grass ■ The last week of the Spring Clean -Up produced 55 -58 tons of trash ■ Veterans will be selling their poppies for Memorial Day REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 1 & 8, 2008 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS Councilor Quinn asked about materials being stolen from the Veteran's Memorial site. Mayor Hutton reported that additional security measures will be taken. Councilor Quinn also asked what measures departments are taking to conserve fuel. The Mayor stated that part of the pledge of the City when designated a CLEAN City was to reduce the use at least ten percent overall. The Police Department will be making a decision about cruisers being taken home by officers by next week. Councilor Wissel reported the Chamber of Commerce asked if Common Council will adopt a street — NW 5t" Street from Richmond Avenue to the National Road. President Parker said this subject will be discussed and brought back at the next meeting. Councilor Elstro moved to suspend the rules and read Ordinance Nos. 37 & 38 -2008 on first reading by title only with a second by Councilor Quinn. Upon a vote viva voce, the motion passed. ORDINANCE NO. 37 -2008 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -3 ONE -EIGHT FAMILY RESIDENTIAL DISTRICT TO R -3 SPECIAL USE DISTRICT (2116 East Main Street) The Clerk read Ordinance No. 37 -2008 on first reading by title only. Presented by Scott Zimmerman, City Planner, this Ordinance is a petition to rezone the property at 2116 East Main Street from R -3 One -to -Eight Family Residence District to R -3 One -to -Eight Family Residence Special Use District in order to allow the owner to develop the property as a bed and breakfast. Ordinance No. 37 -2008 was referred to the Richmond Advisory Plan Commission for public hearing at its meeting on May 29, 2008. Common Council Minutes May 19, 2008 Page 2 of 2 ORDINANCE NO. 38 -2008 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION (Safe Routes to Schools) The Clerk read Ordinance No. 38 -2008 on first reading by title only. Presented by Scott Zimmerman, this Ordinance would authorize the City of Richmond to submit a grant application to the Indiana Department of Transportation through its program, Safe Routes to Schools. The City would also be authorized to accept said grant funding in an amount up to Ninety -Six Thousand Five Hundred Ninety -One Dollars ($96,591). If awarded, said funds would be appropriated for the construction of sidewalks in the City of Richmond. Councilor Welch moved to advance Ordinance No. 38 -2008 to second reading and to suspend the rules and read by title only with a second by Councilor Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 38 -2008 on second reading by title only. Council President Parker declared Ordinance No. 38 -2008 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 38 -2008 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 38 -2008 to third and final reading and suspend the rules and read by title only with a second by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 38 -2008 on third reading by title only. Ordinance No. 38 -2008 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 26 -2008 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM C -2, COMMERCIAL DISTRICT, TO C -4, GENERAL BUSINESS DISTRICT (4500 National Road East) The Clerk read Ordinance No. 26 -2008 on second reading by title only. Presented by Councilor Wissel, this Ordinance is a petition to rezone the property at 4500 National Road East, more commonly known as paved property behind the current Wetzel Family Ford dealership, from C -2 Commercial District to C -4 General Business District in order to allow the owner to operate the property for outdoor sales and display. This Ordinance was heard at the April Richmond Advisory Plan Commission which voted unanimously to recommend approval. Council President Parker declared Ordinance No. 26 -2008 on second reading and public hearing. Speaking in favor was Steve Rabe, Attorney for the McKinny Family Trust. There being no comments against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 26 -2008 with a second by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 26 -2008 to third and final reading and suspend the rules and read by title only with a second by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 26 -2008 on third reading by title only. Ordinance No. 26 -2008 was adopted with a 9 -0 roll call vote.
