WHEREAS
We, the inhabitants of the Town of Brewster, in
the one hundred and seventy-first Annual Town Meeting
assembled March fifth, one thousand nine hundred and
seventy-three record this tribute to the life of our
late Town Clerk and Treasurer, Donald P. Consodine and
WHEREAS:
We know our lives are enriched by having known this
selfless and sensitive individual whose quiet dignity
and concern for our welfare lives on
BE IT RESOLVED
that we extend to his family our deepest sympathy
and our sense of personal loss following his passing on
February twenty-seventh, 1973. His contributions to
town management, interests toward historic, professional
and recreational aspects of the town together with his
deep reverence for antiquities and respect for the new
leave for us a most valued legacy, Perhaps his respect
for history and deep love for the natural beauty of this
community will be remembered longest in our memory of this
friend, neighbor and public official$ and be it
FURTHER RESOLVED
that a copy of this Preamble and Resolution be
affixed to the official records of the Town of Brewster
attesting our grateful appreciation for a life of dedication.

Greetings:
n the name of the Commonwealth of �':assachusetts, you are hereby
directed to notify and warn the inhabitants of the Town of Brewster
qualified to vote in town affairs to meet at the Our Lady of the Cape
Church Auditorium on Monday evening, May 7, 1973 at 7:30 P. M., then and
there to act upon the following articles:
ARTICLE 1 . To see if the Town will vote to raise and appropriate
4" the sum of One Thousand ($1 ,000.00) Dollars for the current year of
1973 .for advertising the advantages of the Town in accordance with the
provisions of Chapter 475, Acts of 1969. (By Request) .
ARTICLE 2. To see if the Town will vote to raise and appropriate
and add to the street lighting budget the sum of Sixteen ($16.00)
Dollars to install and maintain a street light on pole number 6/30
between the Water Departmert Building and the Highway Garage.
ARTICLE 3. To see if the Town will vote to raise and appropriate
the sum of Six Hundred ($600.00) Dollars to be added to the Town.
Landings Expense Account for additional repairs to drainage on Breakwater
Beach.
ARTICLE 4. To see if the Town will vote to raise and appropriate
the scam of Five Thousand Two Hundred Eighty ($5,280.00) Dollars to be
added to the Town Roads Account for the painting of a white center strip
along fifty (50) miles of roadway in the Town.
ARTICLE 5. To see if the Town will vote to amend the Personnel By-
Law, Section XI 2.3 to read Increments Based on Merit - The payment of
step rate increments provided for in the Compensation Pian shall be based
upon merit and become effective on the first Monday in July following
the anniversary date of employment, subject to the recommendati
ARTICLE 11 . To see if the Town will vote to raise and. approp-
riate Seven Hundred Fifty ($750.00) Dollars for appraisal fees in
connection with the enlargement of the present town disposal area
and possible Conservation Area.
ARTICLE 12. To see if the To-m vi.li vote to raise and approp-
riate the sung of Twenty Five Hundred ($2,500.00) Dollars for survey
fees in connection with the enlargement of the present town disposal
area and possible Conservation Area.
ARTICLE 13. To see if the Town will vote to accept the provisions
of Chapter 40, Section 65 of the General Laws, establishing a fund
for the purchase of stormy weather clothing for towns employees.

riate the sum of Five Hundred ($500.0{}) Dollars to the Highway
Clothing Account.
ARTICLE 15. To see if the Town will rescind the previous vote
on Article 5 of the Special Town Meeting held on July 10, 1972 and
authorize the Selectmen to acquire by purchase, eminent do n or
other dse, for Town disposal purposes the fee or any lesser interest
in certain parcels of land adjacent to and east of the present Town
Disposal. Area all as shown on a survey plan entitled "Plan Showing
Extension of Towns Dump in Brewster, Mass. wade for Town of Brewster
December 1972 Nic1mrson & Berger, Inc.", a' copy of which is on file
with the Town Clerk, the same beim Parcel 1 comprising 13.80 acres,
more or less; Parcel 2 comprising 11 .50 acres, more or less; Parcel
3, comprising 11 :00 acres and Parcel. 6 comprising .31 acres more or
less, all as shown on said plan; and to raise and a-D ropri ate the sum
of One Hundred Fifty Thousand Eight Hundred Fifty ($150,850.00) Dollars
for this purpose and to determine whether any such appropriation shall
be raised by taxation, by transfer,from available funds, by borrowing
or otherwise, .
A_RTICIL 16. To see if the Town will rescind the previous vote on
Article 5 of the Special Town Meeting held on July 10, 1972 and
authorize the Selectmen and, in the alternative, the Conservation
Commission, to acquire by purchase, eminent domain, or otherwise, for
conservation purposes the fee or any lesser interest in certain parcels
of land adjacent to and east of the present Town Disposal Area all as
shown on a survey plan entitled "Plass Showing Extension of Town D=p
in Brewster, Mass. made for Town of Brewster, Decenber 1972 Nickerson
& Berger, Inc.t1, a copy of which is on file with the Town Clerk, the
same being Parcel 4, comprising 18.55 acres, more or less, and Parcel
5, comprising 6.30 acres, more or less, all as shown on said plan; and
to raise and appropriate the sums of Sixty Five Thousand Three Hundred
($65,300.00) Dollars for this purpose, and to determine whether any
such appropriations shall be raised by taxation, by transfer from
available funds, by borrowing or otherwise.
ARTICLE 17. To see if the flown will vote to raise and approp-
riate the sum of Twelve Thousand ($12,1300.00) Dollars for engineering
fees to establish a sanitary landfill area in the new town disposal
district.
ARTICLE 18. To see if the Towyn will vote to ratify and confirm
the action of the Town taken under Articles 58, 59 and 60 of the 1973
Annual Town Meeting raising and appropriating the: sums of $3,900,
$6,200 and $80,500, respectively, for the extension of water mains as
described therein and to vote to raise said appropriations by borrowing
pursuant to Chapter 44, Section 8, of the General. Laws.
ARTICLE 19. To see if the Town will vote to amend the Zoning By-
Law amended March, 1972 as follows: Section VI. Table 2 - District R-L
delete "25,000, 135" and substitute 1140,000, 150f1 so that it will read,
"10,000 plus 15,000 for the second dwelling unit of a duplex, 150".
District R-H - delete P115,000, 10,000, 100, 30, 20, 2011 and substitute
1425,000, 15,000, 135, 40, 25, 25" so that it will read, 1125,000 plus
15,000 for the second dwelling unit of a duplex, 135, 40, 25, 25.14

ARTICLE 20. To see if the Town will vote to amend the Zoning
By-Law (amended March 1972) as follows: Section VI, Table 2. - C-H-
Multifamily dwellings - delete 1110,000 per building unit, 100, 30, 20,
20" and substitute "50,000 for the first three dwelling units, plus
10,000 for each additional dwelling unit, 150, 40, 30, 30" so that it
will read "50,000 for the first three dwelling units plus 10,000 for
each additional dwelling unit, 150, 40, 30, 30." (By Petition)
ARTICLE 21 . To see if the Town will vote to amend the Zoning By-
Law (amended March, 1972) as follows: - Section VI - Table 2. - C -H
and C-S - Hotel and Motel - delete "20,000, 30, 15, 30" and substitute
"50,000, 40, 30, 30" so that it will read "50,000 plus 2,000 per unit,
150, 40, 30, 30." - Section V, Table 1 - Retail and Service 6. Hotels
and Motels - delete "PP" and substitute "SS" so that it will read

ARTICLE 22. To see if the Town will vote to amend the Zoning By-
Law (amended March, 1972) as follows: - Section X, C - Planned Unit
Developments - 5. 1 . - delete "Motel or hotel with customarily
accessory retail, dining and service facilities". 7. Delete "five
units" and substitute "two dwelling units" so that it will read, T'The
average density of residences sha1,1 not exceed two dwelling units per
acre of land which is devoted to residential use, as defied in 6b above."

ARTICLE 23. To see if the Town will vote to request the Selectmen
to layout Crosby Lane and raise and appropriate the sum of Three
Thousand ($3,000.00) Dollars for engineering purposes.
ARTICLE 24. To see if the Town will vote to raise and approp-
riate the sum of Twelve Hundred ($1200.00) Dollars for the period
from July 1 , 1973 to June 30, 1974, under the provisions of Chapter 9",
Sections 1 and 2, Acts of 1971 , an•lact providing that cities and
towns grant an annual pension to certain retired teachers and that the
Commonwealth reimburse said cities and towns for the amount of all such
pensions.
ARTICLE 25, To see if the Town will vote to authorize the Selectmen
of the Town of -Brewster to give a confirmatory deed to Morena L. Ellis of
a parcel of land conveyed by the Selectmen of the Town of Brewster to
Enoch E. Walker by deed dated August 18, 1925 and recorded at the Barnstable
Registry of Deeds in Book 34 at Page 62 and later conveyed by Sarah J. Walker,
widow of Enoch E. Walker, Ida W. Baker, and Morena L. Ellis, all the heirs
of Enoch E. Nalker, to Morena L. Ellis by deed dated September 30, 1964,
and recorded-at the Barnstable Registry of Deeds in Book 1278 at Page 144.
ARTICLE 26. To act on any other business that may legally come
before this meeting.
And you are directed to serve this Warrant with your doings thereon
to the Town Clerk at the time and place of said meeting as aforesaid.

the MRD District.

1973 enclosing the approval of Attorney General Quinn as of April 10, 1973
of Articles 32, 33 and, 55 of the 1973 Amml Toast Meeting to do v&th zoning

In accordance with the S^Jarrant the meeting was held in the Our Lady of the
Cape Auditorium on Noonday evening, May 7, 1973 at 7:30.
The meeting was called to order by thie Moderator, Stephe<: Doyle 'With tellers,
Fain C. Sylver, Gladys Curtis, Doris Powell, Dorothy Grenier, and J. �Dgden
Tyldsley, Jr. and registrars, Dorothea Dugan and Jean Gage. Because not all
of the registered voters could be admitted t& the null deae to overcrowded
conditions, it was moved and voted that the meeting be adjourned and re-
convened at Nausea Middle School dymnasiume on Tueday nig7:t, May 8, 1973 at
7:30 p.m.
The meeting was called to order at 7:30 pr=.— at the Nauset Middle School by
the Moderator, Stephen Doyle. There was a cTuo.nm present. the Moderator
c.lied for a :mor-ent of silent meditation.
The Warrant was read by the Town Clerk, Ruth N. Eddy, :-i.th exception of the
articles which were read as they were being considered.
ARTICLE 1 . To see if the Town- will vote to raise and appropriate the sum of
One Thousand ($1 ,000.00) Dollars for the current year of 19,3 for advertising
the advantages of the Town in accordance -with the provisions of Chapter 475,

and subject to the approval of the Selectmen acting as a Personnel Board.
Upon the discretion of the Personnel. Board, the employment period may be
shortened for the purpose of approving a step-rate increase to six months
prior to the first Monday in July,.
VOTED that the Town amend the Personnel By-Law, Section XI 2.3 to read

March 23 1965 that specified the time for holding the An-nual. Town Meeting
and Election, and. that the ar,nual :own Meeting of the inhabitants of the
Torn of Brewster be veld on the Second Monday of lay and the Annual Town
Election at 10:00 A.M. on. the Monday following in each year beginning

be commended for their public spirited action on behalf

carefully examining every article in the Warrant, prejDarin�
the budget and keeping track of expenditures of the various
Town Departments and transfers out of the deserve Fund.
Beim Chairman of this Committee sets one uo as a
spokesman of the c�roun and he or she, esnecia.11y, has to
be well informed about not only finances but local
F eogra.phy, Town. Bir--Laws and the operation of the various
Town Departments . Sometimes the Chairman has to sneak for
the majority opinion of the Committee, even though he,
himself, does not ar^ree with the majority,
Bill has always shown good logic, consideration, for

trvin7 situations when a lesser man would have "blown his
cool" , Brewster is a better To-vTn because of his vast efforts
on its behalf.

On August 28, the Board of Selectmen of Brewster
together with the Board of Selectmen of Harwich,
Massachusetts, Mssrs,. Krapohl and Sawtelle of Brewster
and Greenhalgh and Hemeon of Harwich present , did
perambulate the bounds of the two towns in compliance
with Chapter 42 of the Massachusetts General. Laws,
In the presence of the Harwich Town Engineer,
Mr. Martin Doran, we did locate the Brewster-Harwich
mar.Kee on Rte. 2$ as well as the ItthreeA-town" point
on the beach: -thence westerly to the Brewster-Harwich
marker on Chime Pond (not located) through the ponds
to witness marker #7 on the south shore of Seymours
Pond (found) . Whence Southerly to Hinckl.eys Pond to
witness marker #8 (found) . Thence westerly to the
Brewster-Harwich--Dennis bound near Little Fields
Pond or Francis Washburn' s bog so-called. Being in
a bog area, tinder water due to heavy rains.., we did
not persue the search. We agreed to make a diligent
attemtt to locate the bound next year vith Dennis,
hopefully in drier times
In all, it was a pleasant experience to share
with the Harwich Board some of the more remote areas
of our common border. Even the most dedicated urbanist
could not help but appreciate the peace and tranquility
such places afford.

In the name of the Commonwealth of Massachusetts, you are hereby
directed to notify and warn the inhabitants of the Town of Brewster
qualified to vote in town affairs to meet at Our Lady of the Cape
Church Auditorium on Monday evening October 1 , 1973 at 7;30 P. M.,
then and there to act upon the following articles:
ARTICLE 1 . To see if the Town will rescind the By-Law as stated
in Article 54 of the Warrant for the Town Meeting of March 2, 1965,
pertaining to the dates for holding annual Town Meeting and election
of town officers, which was adopted at that meeting, and substitute the
following:
The annual meeting for the transaction of all business of the Town,
other than such matters as are by law to be determined by ballot, shall
be held on the second Monday in May, and the annual meeting for the
election of town officers and such matters as are by law to be determined
by ballot shall be held on the third Monday in May, beginning with May
1974, the town officers whose terms expire that year to remain in offices
until their successors take office, in accordance with the provisions of
Chapter 766 of the Acts of 1971 and amendments thereto.
ARTICLE 2. To see if the Toum will vote to authorize the Selectmen
to lay out Beach Plum Lane, providing that all requirements of the Town
By-Law governing acceptance of private roads by the Town are met.(By request)
ARTICLE 3. To see if the Toum will vote to raise and appropriate
the sum of forty-nine thousand, five hundred ($49,500.00) dollars to
correct the areas of violation at the existing Town Bump, cited by the
State Department of Public Health in findings on file in the office of the

action relative thereto,

position of Health Agent, as follows:-
Health Agent: Qualifications: A Registered Sanitary Engineer or Certified
Public Health Officer.
One, who under the supervision of the Board of Health, has
responsibility to advise the Board on policies to protect the general
health and welfare of the inhabitants of the Town of Brewster. He shall
carry out a program of inspection and education in relation to the handling
of food, beverages, ,water supplies, drainage and sewage disposal and
other sanitary problems. He shall enforce and interpret the State Sanitary
Code and local health regulations, to include representing the Town in
legal action and testify when necessary on health law violations. He shall
be responsible for issuance of sewage disposal permits and to insure their
compliance with the State Sanitary Code. He shall make periodic inspections
to advise all licensees of the Board of Infractions and Violations found,
and inspect public food serving establishments and advise the licensing
board regarding equipment of these establishments prior to the issuance of
a common vi.ctualer's or innholder's licenses. He shall collect water
samples from ponds, swisming pools, public beaches, domestic water supplies
and shellfish to determine minimum health safety standards. He shall keep
informed as to possible sources of pollution and shall develop and recommend
policies to prevent same. In the performance of his duties, he shall
investigate all health and sanitary complaints and take legal action in
accordance with the General Laws of the Commonwealth on all violations of
by-laws, rules and regulations of the Town relative to the public health.
ARTICLE 12. To see if the Town will vote to transfer from available
Revenue Sharing Funds in the treasury the sum of nine thousand three
hundred sixty ($9,360.00) for the salary of the Health Agent from October
1 , 1973 to ,Tune 30, 1974.
ARTICLE 13. To see if the Town will vote to raise and appropriate

added to the highway Vacation, Holiday and Sick Leave Account for an
operator-maintenance man for the Water Department.
ARTICLE 24. To see if the Town will vote to accept the provisions
of Chapter 40, Sections 42A, 42B, 42C, 42D, 42E and 42F relating to
the transfer of overdue and unpaid bills for water service to the

"A minimum of 20% of every lot, regardless of size, shall be reserved

and shall be used for landscaping and storm drainage purposes only. All
standing trees of four inches or more in diameter shall.- be preserved
in these green areas for future growth.. Green areas shall be designated
on a site plan. A plan for development of the entire tract shall be
submitted to the Planning Board for advice, recommendation, and approval..
The Planning Board will forusrd the plan to the Architectural Advisory
Committee for advice and recommendation. Said committee shall within
30 days provide a report to the Planning Board. This plan shall be
prepared by a registered architect and a registered professional
engineer. The development plan shall include the following:
a. The location and acreages of areas to be devoted to
specific uses.
b. A thoroughfare plan and a public utility plan.
c. Proposed residential density of development in terms
of dwelling units per acre and proposed commercial uses
in square footage.
d. Maps to a scale of 1" = 1001 including the tract and
surrounding arra within 100 feet,

row houses, an internal sewage collection system which shall be of
sufficient size and design to collect all sewage from all present and

REPORT OF THE SPECLAL TOUN MEETING
October 1 , 1973
In accordance with the Warrant the meeting was held in the Our Lady of
the Cape Auditorium on Monday evening, October 1 , 1973 at 7:30 p.m.
The meeting was called to order by the Moderator, Stephen Doyle, who
asked for a moment of silent meditation. The Registrars were Dorothea
Dugan_ and Jean Gage. The Tellers were Paul C. Sylver, Gladys Curtis,
DorothyGrenier, Doris Powell, and J. Ogden Tyldsley, Jr,, n quorum was
present.
The Warrant was read by the Town Clexlc,Ruth N. Eddy, with the exception
of the articles which were read as they were being considered.
ARTICLE 1 . To see if the Town will rescind the By—Lwi as stated in
Article 54 of the Warrant for the Town Meeting of March 2, 1965, per—
taining to the dates for holding annual Town ?Fleeting and election of
town officers, which was adopted at that meeting, and substitute the
following:
The annual meeting for the transaction of all business of the Town,
other than such matters as are by law to be determined by ballot, shall
be held or. the second Monday in May, and the annual meeting for the
election of town officers and such matters as are by law to be determined
by ballot shall be held on the third Monday in May, beginning with Play
1974, the town officers whose teras expire, in accordance with the pro—
visions of Chapter 766 of the Acts of 1971 and amendments thereto.
An amendment was voted to read "and substitute the following by—law:"
VOTED that the Town rescind the By—Law as stated in Article 54 of the

ARTICLE 20. To see if the Town will vote to raise and appropriate the sum
of five hundred ($500.00; dollars to be added to the Highway Garage Expense
Account.
VOTED that the Town raise and appropriate the sum of five hundred ($500.00)
dollars to be added to the Highway Expense Account.
ARTICLE 21 . To see if the Town will vote to raise and appropriate and -
add to the Street Lighting Budget a sum of money sufficient to install
and maintain a street light on pole #196/3 on Fox Meadow Drive.

ARTICLE 22. To see if the Town will vote to accept the following By—Law
relating to the call of Special Town Meetings in the Town of Brewster:
No warrant for the holding of a Special Town Meeting shall be issued by
the Board of Selectmen_ of the Town of Brewster unless it provides a notice
of not less than twenty—one (21) days, after the warrant has been
delivered to the constable for posting.
VO'T'ED unanimously that the Town accept the following By--Law relating to

ARTICLE 24. To see if the Town will vote to accept the provisions of
Chapter 40, Sections 421, 42B, 42C, 42D, 42E and 42F relating to the
transfer of overdue and unpaid bills for water service to the Collector
of Taxes, subject to the same penalties as apply to unpaid taxes.
VOTED that the Town accept the provisions of Chapter 40, Sections 42A,
42B, 42C, 42D, 42E and 42F relating to the transfer of overdue and un-
paid bills for water service to the Collector of Taxes, subject to the
same penalties as apply to unpaid taxes.
ARTICLE 25. To see if the Town will vote to transfer the sum of fifty
thousand ($50,000.00) dollars from the Water Department Construction
Revenue Account to the Water Department Installation Account.
VOTED unanimously that the Town transfer the sum of fifty thousand
($50,000.00) dollars from the Water Department Receipts Reserved for
Appropriation to the Water Department Installation Expense Account.
ARTICLE 26. To see of the Town will vote to raise and appropriate
by borrowing pursuant tc Chapter 44, Section 8 of the General, Laws,
a sum of money for extending water mains not less than six (5) inches
but less than sixteen (16) inches in diameter for 4,000 feet, more or
less, on Gould Drive.

ARTICLE 27. To see if the Town will vote to false and appropriate the
sum of six hundred fifty five ($655-00) dollars for the Water Department
Office Equipment Account.
VOTED unanimously that the Torwn raise and appropriate the sum of six
hundred fifty- five ($555.00) dollars for the slater Department Office
Equipment Account.
ARTICLE 28. To see if the Town will vote to amend the Zoning By-Law
(amended May 1973) as follows: Section VI, Table 2. C-H Multi-family
dwellings - delete "10,000 per building unit, 100, 30, 20, 20" and sub-
stitute "Minimum required lot size is 130,000 square feet, 4000 per
dwelling unit, 200, 100, 30, 30" so that it will read "minimum required
lot size is 130,000 square feet, 4000 per dwelling unit 200, 100, 30, 30".
VOTED with only one opposing vote that the Town amend the Zoning By-Law
(amended May 1973) as follows: Section VI, Table 2, C-H Multifamily dwellings
delete "10,000 per building unit, 100, 30, 20, 20" and substitute
"Minimum required lot size is 130,000 squre Feet, 4000 per dwelling unit,
200, 100, 30, 30" so that it will read "Minimum required lot size is

ARTICLE 29. To see if the Town will vote to amend the Zoning By-Law
(amended May 1973) as follows: Section X-A, paragraph 11 Delete "50
percent" and substitute "35 percent" so that it will read "Multifamily
structures and accompanying lots shall not comprise more than 35'% of
the total land area of each C-H district in which they are located.,,
VOTED unanimously that the Town amend. the Zoning By-Law (amended May-
1973) as Follows: Section X-A, paragraph 1. Delete "50 percent" and

land area of each C-H district in which they are located.
ARTICLE :36. To see if the Town will vote to amend the Zoning By-Law
(Amended ?'•'Iay 1373) as follows: Section X-n. Delete Para Taph 2 and sub-
stitute: Multifamily structures shall not occupy more than 23% of the
lot on which they are built.

ARTICLE 31 . To see if the Town will vote to amend the Zoning
By-Law (amended May 1973) as follotira: Section X-A. Add paragraph 3. k
"A minimum of 20p of every lot, regardless of size, shall be reserved
for green areas. Such areas shall not be paved or hard top surfaced, A
and shall be used for landscaping and storm drainage purposes only. All
standing trees of four inches or more in diameter shall- be preserved
in these green areas for future growth.. Greer. areas shall be designated
on a site plan. A plan fqr development of the entire tract shall be
submitted to the Planning Board for advice, recommendation, and approval.
The Planning Board will forvard the plan to the Architectural Advisory
Committee for advice and recommendation. Said committee shall 'within '
30 days provide a report to the Planning Board. This plan shall be
prepared by a registered architect and a registered professional
engineer. The development plan shall include the following:
a. The location and acreages of areas to be devoted to
specific uses.
b. A thoroughfare plan.and a public utility plan.
c. Proposed residential density of development in terms
of dwelling units per acre and proposed commercial uses
in square footage. a
d„ Maps to a scale of i" = 1001 including the tract and
surrounding area, within 100 feet.
"The developer shall provide within multifamily developments, including
row houses, an internal sewage collection system which shall be of
sufficient size and design to collect all sewage from all present ander"'
probable structures in the development. The developer shall also provide
a communal sowage treatment and disposal system which roust be approved
by the tassachusetts Department of Public Health and the Brewster Board
of Health and which is of sufficient size to dispose of all sewage from
all present and probable structures within the develop=nt,"

and design as will collect, carry off and dispose of all surface water
runoff within the development determined by the rational method, for a
10-year design storm, and shall be so constructed as to conform with the

"Tho developer shall provide within multifamily developments, including
row houses, a water distribution system which shall be approved by the
Brewster Water Department and shall be of sufficient size and design to
supply potable water to each of the structures to be erected in the
development. This distribution system must be connected to and served
by the public water supply system of the town,"'

sideline and 30 feet from the near line shall be left as undisturbed
