The regular meeting of the City Council of the City of Temple City was called to order by Mayor Nunamaker at 7:35 P. M. 2. Father Lenihan of St. Lukes Catholic Church of Temple City gave the invocation, following which the Mayor led the Pledge of 3. Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford and City Manager Woollett 5. APPROVAL OF MINUTES: a. Minutes of November 11, 1963. Councilman Merritt corrected item 18 page 5 to show Councilman Merritt seconding last item. b. Minutes of November 25, 1963. The City Manager corrected item 14 by adding "building" as follows: "advised this building was completed " and also item 19 the next meeting to be held on Dec. 9, 1963. Councilman Fitzjohn moved to approve as corrected, Councilman Merritt seconded, roll call vote as follows to carry: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: PUBLIC HEARING: CON'T. Appeal zone variance Case #63 -62, Walter A. Sawyer & Emory F. Sawyer The City Attorney recommended the appeal be denied without pre - judice to a future application which will involve subdivision rather than a lot split, and without future fee for subdivision Councilman Tyrell so moved, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford will draw a resolution denying the appea! without prejudice. 6. PRESENTATION OF DONATION: L. A. County Fire Fighters Assn. Capt. Brook of the Los Angeles County Fire Fighters Assn. pre- sented to the City for Parks & Recreation of the City a check in the sum of $250.00 to add to the youth program. Mayor Nunamaker accepted for the City with appreciation. PUBLIC HEARING: 7:30 P. M. CURB &'GUTTER A. Daines Dr. north side between Pal Mal & E.1 Monte. B. Daines Dr. south side between Pal Mal & El Monte. C. Grand Ave. south side McClintock to City Limits. Councilman Fitzjohn moved to open the Public Hearing, Councilman Tyrell seconded, and carried. City Manager Woollett advised on A that 390 lin. ft. of 628 lin. ft. or 62.1% had signed the pe- tition. On B 357 lin. ft. of 583 lin. ft. or 61.2% had signed and on C 115 lin, ft. of 182 lin. ft. or 63.1% had signed. Mayor Nunamaker asked if anyone wished to speak for or against and no one came forward. Councilman Merritt moved to close the Public Hearing, Councilman Tyrell seconded, and carried. Councilman Merritt moved to determine the improvements to be in the public interest and instruct the Supt, of Streets to cause the work to be done, Councilman Tyrell seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 544 Council Minutes, page 2, December 9, 1963 7. RESOLUTION NO. 63 -329: re- occurrence of needless traffic ac- cidents. The City Attorney read in full Resolution No. 63 -329 Councilman Tyrell moved to adopt Resolution No. 63 -329, Coun- cilman Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 8. RESOLUTION NO. 63 -330: Re- bicycle racks City Attorney Shatford read title to Resolution No. 63 -330 a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ES7 TABLISHING LIMITED BICYCLE PARKING ON CERTAIN POSTED BLOCKS PUR- SUANT TO SECTIONS 3330, THROUGH 3330.4 OF THE TEMPLE CITY MUNI- CIPAL CODE. Councilman Tyrell moved to adopt Resolution No. 63 -330, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None. ABSENT: Councilmen -None APPOINTMENT OF PARKS & RECREATION COMMISSIONER: The City Manager advised the term of John Clemson as CommissionE expires on Dec. 29, 1963, and recommended that he be re-appoint- ed for a four year term beginning on Dec. 29, 1963. Councilman Dickason moved to re- appoint John Clemson for a four year term,' Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None. ABSENT: Councilmen -None 10. PLANNING COMMISSION RECOMMENDATIONS: 1. Resolution No. 63 -51PC re- proposed precise zoning plan for Temple City. City Manager Woollett recommended the Council receive this Re- solution from the Planning Commission and utilize the contents in the Public Hearings on the Zoning Map. Councilman Tyrell moved to receive, Councilman Fitzjohn seconded, carried. 2. Resolution No. 63 -53PC recommending zone change from A -1 -1 acre to R -1 Zone Case #63 -69, property west side of Arden Drive between Randwick Dr. and Green St. City Manager Woollett recommended this be set for Public Hearinc on Dec. 23, 1963. Councilman Tyrell so moved, Councilman Fitz- john seconded, and carried. 3. Recommended potential zone M -1 and M -2 zone on new Zoning Map in area bounded by Rosemead Blvd., Lower Azusa Ave., Eaton Wash, & Encinita Ave. and recommend to you careful consideration during Public Hearings, and due to high cost of securing area possibly could not be developed to proposed potential use. William Harker, Planning Commissioner, explained in full the thinking of the Commission regarding this potential zoning. Councilman Merritt moved to receive the information for the Public Hearings, Councilman Fitzjohn seconded, and carried. 4. Recommend property on south side of Las Tunas Dr. between - Eaton Wash and westerly City limits be zoned C -M, this indica- tion to be added to proposed new zoning map and considered with it. The Council received the information for future reference at the Public Hearings on the Zoning Map. 11. TRAFFIC COMMISSION RECOMMENDATION: Item 9. Recommend restricted parking east side of Temple City Blvd. between Lower Azusa Rd. & Olive St. from 11 :00 P. M. on Dec. 31, 1963, until 5 :00 A. M. on Jan. 1, 1964, and authorize use of pre-warning reflector prior to restricted area for Rose Parade Float route. Chairman Dick Sale of the Traffic Commis- sion presented the recommendation. Race Track signing on Baldwin Ave. between Daines Dr. & Lower Azusa Rd. during racing season from approximately 11:15 A. M. to 1 :15 P. M. on the east side, and approximately : :15 P. M. to 6:30 P. M. on the west side. Councilman Dickason moved to approve item 10, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Item 11. 2b. Recommend installation of additional red curb pave- ment marking on Woodruff Ave. west of Temple City Blvd. for safety turning movements to alley and driveway. Councilman Dickason moved to approve, Councilman Merritt seconded, roll cal vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Item 12. 2C. Recomment installation of STOP and stop bar pave- ment markings on Emperor Ave. at Oak Ave. Councilman Merritt moved to approve, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. AUTHORIZATION FOR FICKES & FICKES TO PROCEED WITH CONSULTING SERVICE: Resolution No. 63 -332 The City Manager recommended adoption of this Resolution to authorize the expenditure of $1,000. for design work on the Master Plan of Temple City Park and consideration of existing school district maintenance center for development as a park. Councilman Tyrell moved to adopt Resolution No. 63 -332, Council- man Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 13. REPORT ON CURRENT STATUS ON BUS BENCHES: The City Manager advised it is the recommendation of the staff that the Council approve the bus locations as listed in order that permits may be issued, stating this reduces the number by fourteen of bus benches. Councilman Fitzjohn moved to approve, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None lit. Daines Dr. north side, Double Drive to Welland The City Manager recommended these two petitions be set for Public Hearing for 7:30 P. M. on January 13, 1964. Councilman Tyrell so moved, Councilman Merritt seconded, and carried. 15. REPORT FROM LIBRARIAN: City Manager 400llett advised pursuant to request of the Council he had communicated with the Librarian discussing under what conditions the library.could be opened additional hours. Accord- ing to the Library Dept. circulation has increased over the wildest estimates at the new Library. It would cost the City $90.88 per day for an 8 hr. shift of three people which does not include custodial expenses. Councilman Dickason felt the library should be open Sundays and holidays to take better ad- vantage of the library. Don Elder, representing the student body at Temple City High School, spoke favoring the library being kept open to 10 or 10:30 P. M. and it could be used to 51+6 Council Minutes, page 4, December 9, 1963 great advantage on Sundays as most of them put off their studies until Sunday, and also on minor holidays. He also suggested the use of the meeting room of the library for student gather- ings where they could talk and hold committee meetings, etc. Lt. Baker referred to the curfew hour of 10 P. M. which would not interfere if they had transportation and went home from there. Councilman Dickason referred to all these holidays the County and State have, and which he felt were excessive. Mrs. Bertha Rains of Temple City, who is a member of the Advisory Council of the County Library, advised the Council to be cau- tious in spending money for very many additional hours, and if not used would be difficult to cut back. Very few libraries are open on Sunday and very few open after 9 :00 P. M. She also stated the public library is not a school library for students to do their home work. This is a school function and not a library function. The public library supplements the school library and does not serve for reference work for their home work. Also in some instances school libraries have opened for students to study, and it would be much better for them to go to the High School to study where they would not interfere with other people as the library can be really enjoyed by older people. Also in the meeting room they plan to have art exhibits etc., and anything in there would be on loan and must be kept under security conditions. Also holidays such as Lincolns & Washingtons birthdays if not observed as national holidays we could have the State consider a change and have the students observe the holidays in school as when let out for observance it does not serve any purpose and it defeats the reason for the holiday. If just used for students you are paying for a staff' to supervise home work. Staff hours are determined by circula- tion. There followed considerable discussion with it finally agreed that the staff research this further and come up with some statistics regarding use of the library, and by whom. 16. RESOLUTION NO. 63 -331: Warrants & Demands Councilman Fitzjohn moved to approve Resolution No. 63 -331 in the sum of $11,976.77, Demand Nos. 4363 through No. 4434, Councilman Merritt seconded, carried by following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 17. COMMUNICATIONS: a. Los Angeles County Boundary Commission: the City Manager read a letter regarding proposed annexation #57, City of So. El Monte. Councilman Fitzjohn moved to receive and file, Councilma. Merritt seconded, and carried. 18. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Edw. Raith, 9803 Garibaldi, spoke regarding curb and gutter and sidewalk on Golden West between Garibaldi and Flaherty. He ad- vised he represented 339 ft. of frontage and these owners wish to request the Council to consider deletion of sidewalks. From . Garibaldi to Woodruff the people did not want them. They did not know there was a 40 ft. right of way and 2 ft each side will be taken off the property, with a 6" curb, and 5 ft. parkway, which would put sidewalk up against the fences. When sidewalks are authorized between Garibaldi and Woodruff he advised they woul&go along with the installation. He requested the Council to withhold the sidewalks until they can be heard. Following discussion it was recommended with the approval of the City Attorney that a public hearing be set for January 27, 1963, at 7:30 P. M. to consider this request, Councilman Tyrell so moved, Councilman Dickason seconded, and carried. 19. MATTERS FROM CITY OFFICIALS: The City Manager read a letter from the Boy Scouts Troop #161 of the Methodist church requesting permission to sell candles and bags of mistletoe at three locations, at the Market Basket on Rosemead and Longden, the Shopping Marton Las Tunas and Clover - ly, and the Pinzow Shop at Las Tunas and Primrose, from 9 A. M. to 5:30 P. M. December 14, 1963, Councilman Merritt moved to 547 Council Minutes, December 9, 1963, page 5 approve, Councilman Fitzjohn seconded, and carried. A request from the Camp Fire Girls to sell candy from January 17, through February 3, 1964, was considered by the Council. Coun- cilman Fitzjohn moved to approve, Councilman Merritt seconded, and carried. The City Manager called the attention of the Council to the Treasurers Report. Also to the packet with information for the public hearings on the zoning map which might be of great a assistance at the Public Hearings. The City Manager presented a request from the property owner of the northwest corner of Workman & Temple City Blvd. to re- move two trees which the owner would replace at his expense. There are two sycamores causing damage to the roof structure of the commercial building and he asks the City to remove, and if the Council approves to authorize the cost of removal estimated at about $40. Councilman Merritt moved to approve the removal at estimated cost of $40. Councilman Tyrell seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford advised the new owner of the Jolly Coach- man had contacted him and had agreed that the matter be set for public hearing regarding the dance and entertainment licenses. Following discussion Councilman Merritt moved to set the Public Hearing for 7 :30 P. M. on December 19, 1963, at the City Hall, Councilman Fitzjohn seconded, and carried. The City Attorney advised he had been contacted by representa- tives of Proctor & Gamble regarding distribution of free samples of Crisco Oil. He advised according to our present ordinance these could not be distributed. However if the Council so wishe they could amend the ordinance to allow this but by doing so would be setting a precedent. Following discussion the Council decided to leave the ordinance as it is and so no further action was taken. Councilman Dickason asked regarding the tree planting program and the City Manager advised we have the trees and are ready to plant as soon as the weather is favorable. Councilman Merritt advised the red light on Las Tunas near En- cinita had been replaced with amber which is also a violation. Also he reported a rotating amber light on the southeast corner of Oak and Las Tunas Dr. He also asked about the portion of Golden West and Lower Azusa Road acquired from the County. The City Manager advised we got the strip from the County and a pe- tition is being circulated asking property owners to indicate willingness to dedicate and put in curb and gutter, and then it will come back to the Council requesting the City to pay for the pavement. Mayor Nunamaker reported Parking District #1 now has 542% sign- ed with only 52% to go. Parking District #2 they now have 522% signed with only 72% to go with enough promised to make this up. Also the American Savings & Loan have purchased the northeast corner of Camellia to build a new building and are in the'pr.oces of buying the parking lot and also the second lot behind Fisher Drug store being bought for parking purposes. 20.
