AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA, AMENDING
CHAPTER 21, ARTICLE II, SECTION 21-77 OF THE
CITY OF OPA-LOCKA CODE OF ORDINANCES,
ENTITLED `SCHEDULE OF RATES GENERALLY"
BY AMENDING PROVISIONS RELATED TO
WATER, SEWER AND STORMWATER RATES FOR
FISCAL YEARS 2014-2015, 2015-2016, 2016-2017, 2017-
2018 AND 2018-2019; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR
SEVERABILITY AND CODIFICATION; PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the City of Opa-locks ("City") provides water, sewer, and storm
water utility services to consumers within the boundaries of the City as well as to
consumers outside the City boundaries; and
WHEREAS, the City Commission of the City of Opa-locka ("City
Commission') is charged with the duty and responsibility of setting the rates for
water, sewer and storm water utility services so as to provide revenues sufficient to
recover the full cost of water, sewer, and storm water utility services and to meet all
contractual obligations of the City in relation to the operation, expansion, repair, debt
obligations, and future improvement of the said system; and

WHEREAS, the City Commission desires to amend Chapter 21, Article II,
Section 21-77 of the City of Opa-locka Code of Ordinances entitled "Schedule of
Rates Generally", relating to water, sewer and storm water rates for the City; and
WHEREAS, at a Public Hearing all persons desiring to present evidence, ask
questions, or who wish to advise the City Commission as to the necessity and proper
rates for water, sewer and storm water services have been heard pursuant to notice.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA:
Section 1. The recitals to the preamble are hereby incorporated by
reference.
Section 2. The City Commission of the City of Opa-locka hereby amends
Chapter 21, Article II of the City of Opa-locka Code of Ordinances entitled "Service
Rates and Charges", by amending Section 21-77 entitled "Schedule of Rates
Generally" as set forth herein:

Fire hydrant service charges. A fire hydrant service charge as specified in the
City of Opa-locka schedule of rates, fees and charges for water and sewer service,
shall apply for all customers within the City's service area. This charge covers the
cost of installation, replacement, repair and maintenance of fire hydrants, in addition
to the cost of upgrading water mains to provide required fire flows. The charges are
as follows:

Section 3. All ordinances or parts or ordinances in conflict herewith are
hereby repealed.
Section 4. The ordinance shall, upon adoption, be codified in the City of
Opa-locka Code of Ordinances.
Section 5. If any section, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity of the remaining
portions of this Ordinance.

Section 6. This ordinance shall become effective as provided by law.

Description: The City of Opa-locka engaged Burton & Associates Consulting firm to perform a rate
study of the City's Water, Sewer, and Storm Water funds. Recommendations were made
for rates to cover the cost of service as well as debt obligations.
Financial Impact: 8% annual increase in water and sewer rates. For a customer using 5,000 gallons, the
change is $3.27. Storm water rate will increase by $2.10 in FY 2015.

Recommendation(s): Staff recommends approval.
Analysis: There are several key issues directly impacting the water, sewer and storm water utility rates.
• Miami Dade County entered into a consent decree with the United States of America, State of Florida,
and Florida Department of Environmental Protection to eliminate sanitary sewer overflows and
prohibited bypasses throughout the County. This resulted in an initial 13.9% increase in wholesale
sewer rates in FY 2014. In FY 2015, both the water and sewer rates increased by 4%. We anticipate
rates will continue to increase annually for the foreseeable future. Water purchase and sewer treatment
costs account for approximately 45% of water and sewer fund expenses.
• The State Revolving Loan Fund (SRF) approved a close to $40 million low interest loan for Drinking
Water, Wastewater, and Stormwater improvements. The projects will be complete in the next three to
five years.
• Operating cost inflation. Increases in Health Insurance, Retirement, Fuel etc.
• The Storm water rate has not been adjusted since 1993.
Once all of the capital projects are completed, we will see a decrease in operating costs. Once the projects are
completed and reduction in operating expenses determined, we can look at possibly reducing the water, sewer,
and storm water rates.

WHEREAS, municipalities may enact reasonable regulations to promote the health,

WHEREAS, the City Commission of the City of Opa-locks ("City Commission") desires
to amend Chapter 21, Article II, Section 21-77 of the City of Opa-locka Code of Ordinances
entitled "Schedule of Rates Generally", relating to water and sewage rates for the City of Opa-
Iocka ("City"); and
WHEREAS, the City Commission has determined that it will be in the best interest of
the City to amend Section 21-77 entitled "Schedule of Rates Generally" relating to increases in
water and sewage rates for the City.
THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS:
Section 1. The recitals to the preamble herein are incorporated by reference.

For years after FY 2013, rates will increase by either the consumer price index (cpi) or the rate at
which Miami Dade County increases the cost to provide water and treat wastewater, whichever
is greater.
Fire hydrant service charges - A fire hydrant service charge as specified in the City of Opa-
locka schedule of rates, fees and charges for water and sewer service, shall apply for all
customers within the city's service area. This charge covers the cost of installation, replacement,
repair and maintenance of fire hydrants, in addition to the cost of upgrading water mains to
provide required fire flows. The charges are as follows:

Section 3. All ordinances or Code provisions in conflict herewith are hereby
repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions of this Ordinance.

Section 5. This Ordinance shall be codified in the Code of Ordinances when the code
is recodified.
Section 6. This Ordinance shall upon adoption, become effective immediately.

AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA,
ESTABLISHING RATES FOR WATER, SEWER,
STORMWATER UTILITY SERVICE AND FIRE
HYDRANT CHARGES WITHIN AND WITHOUT THE
CITY LIMITS; MAKING FINDINGS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Opa--locka provides water, sewer
and stormwater utility services to consumers within the
boundaries of the City as well as to consumers outside the
City boundaries; and
WHEREAS, the City Commission of the City of Opa-locka
is charged with the duty and responsibility of adjusting
rates for water, sewer and stormwater utility services so as
to provide revenues in sufficient amounts to recover the
full cost of water, sewer and stormwater utility services
and to meet all contractual obligations of the City in
relation to the operation, expansion, repair, funding of
bond issues and future improvement of the said system; and
WHEREAS, the City Manager of the City of Opa-locka has
submitted to the City Commission rates for water, sewer and
stormwater utility services necessary to provide revenues
sufficient for the foregoing city purposes; and
WHEREAS, at a Public Hearing all persons desiring to
present evidence, ask questions, or who wish to advise the
City Commission as to the necessity and proper rates for
water, sewer and stormwater utility services furnished by
the water, sewer and stormwater utility systems of the City
have been heard pursuant to notice; and
WHEREAS, the City Commission has examined the Fiscal
Year 1993-94 Budget for the water, Sewer and Stormwater
Utility Fund together with the recommendations of the City
Manager; and
WHEREAS, the City Commission finds that the said budget
and recommendations are correct and that the proposed rates
for water, sewer and stormwater utility services constitute
a necessary and proper charge for said water, sewer and
stormwater utility services furnished by the City both
within and without the City limits; and
WHEREAS, the City Commission finds that more than 90%
of the gross revenues generated by the proposed water, sewer
and stormwater utility rates are derived from consumers
within the boundaries of the municipality and the rates are
uniformly applied to consumers inside and outside the
municipal boundaries.
NOW THEREFORE, BE IT DULY ORDAINED by the City
Commission of the City of Opa-locka, that:
Section 1: The water, sewer and stormwater utility
rates for fiscal year 1993-94 are hereby reestablished as
follows:
1. Water Rates (as per Section 21-77 of the Code of
Ordinances)
(a) Within and without the City, the following rates
and charges are hereby adopted and established:
(1) Minimum per month:

(2) Consumption Rates above service charge:
All water bills within and without the City shall
be computed at ninety-six cents ($.96) per one
thousand (1,000) gallons or prorated portions
thereof.
II. Sewer Rates (as per the formula set forth in Section
21-167 of the Code of Ordinances):
(a) The sewer charges to be paid by the owner, tenant
or occupant of each such lot or parcel to whom the bill
shall be rendered for water furnished by the water
works system of the City and used on or about such lot
or parcel shall consist of a minimum monthly charge of
three dollars and ninety-four cents ($3.94) per
Equivalent Residential Connection and a volume charge
of one dollar and twenty-one cents ($1.21) per one
thousand (1,000) gallons or prorated portions thereof,
furnished monthly within or without the City, whether
such water bill shall be rendered on a monthly or on a
quarterly basis.
III.Stormwater Utility Charges (as per the formula set
forth in Section 21-195 of the Code of Ordinances)
(a) The rates to be charged for stormwater management
for each residential developed property shall be
one dollar and ninety cents ($1.90) per
equivalent residential unit (ERU) as defined by
Section 21-193 of the Code of Ordinances, to wit:
single family residence, apartment, mobile home,
condominium or other single-family dwelling unit.
(b) The rates to be charged for non-residential
properties as defined by Section 21-193 of the Code
of Ordinances, to wit: all other occupants other
than provided for in paragraph 1 herein, shall be
the rate established in paragraph 1 ($1.90)
multiplied by the number of single family
equivalent units. Single family equivalent unit
equals the total square footage of impervious area
of the property divided by 1,548 square feet
(statistically developed average for single family
residences in the City of Opa-locka). Single
family equivalent units will be rounded to the
nearest unit.
IV. Fire Hydrant Service Charges
(a) A fire hydrant service charge, as specified in the
City of Opa-locka schedule of rates, fees and charges
for water and sewer service, shall apply for all
customers within the City's service area.
This charge covers the cost of installation,
replacement, repair and maintenance of fire hydrants,
in addition to the cost of upgrading water mains to
provide required fire flows.
The charges proposed are as follows:

Section 2: The said rates shall be charged for use
and consumption of water, sewage, stormwater utility and
fire hydrant service beginning with the first monthly
billing after the effective date of this ordinance for a
period not to exceed twelve (12) months.
Section 3: All ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4: If any section, sentence, clause or
phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction,
then said holding in no way affects the validity of the
remaining portions of this ordinance.
Section 5: That this ordinance shall take effect
October 1, 1993.
