HomeMy Public PortalAbout15525 Geyer Sanitary Relief and Windsor Springs P-521 Storage (Big Bend Blvd to Windsor Springs Dr (12175)ORDINANCE NO. 15525 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Geyer Sanitary Relief and Windsor Springs P-521 Storage (Big Bend Blvd to Windsor Springs Dr) (12175) in the Cities of Kirkwood and Sunset Hills, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Kirkwood and Sunset Hills, St. Louis County, Missouri within the Lemay/RDP Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Geyer Sanitary Relief and Windsor Springs P- 521 Storage (Big Bend Blvd to Windsor Springs Dr) (12175) hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #4 A 5.00 FOOT SEWER EASEMENT, being part of the Common Ground of Brooksgate Manor Plat Book 187, Page 30 of the St. Louis County Records and located in the City Kirkwood, St. Louis County Missouri, being more particularly described as follows: COMMENCING at the Northwest corner of said Common Ground also being the intersection of the Southern Right of Way of Big Bend Boulevard (variable width) with the East Right of Way line of Geyer Road (variable width); THENCE along the Western line of said Common Ground and the East Right of Way line of Geyer Road, South 33 degrees 57 minutes 28 seconds West, 16.15 feet to the POINT OF BEGINNING of the herein described 5.00 FOOT WIDE SEWER EASEMENT; THENCE departing said Western line of Common Ground along a line, North 72 degrees 12 minutes 57 seconds East, 8.07 feet to a point; THENCE, South 33 degrees 57 minutes 28 seconds West, 19.71 feet to a point in the West line of said Common Ground and the East Right of Way line of Geyer Road, THENCE North 07 degrees 18 minutes 41 seconds East, 11.15 feet to a point, THENCE North 33 degrees 57 minutes 28 seconds East, 3.40 feet to the POINT OF BEGINNING, containing 58 square feet or 0.001 acres more or less. Also, a TEMPORARY CONSTRUCTION EASEMENT, for use during construction of any sewer in the above described 5.00 FOOT WIDE SEWER EASEMENT, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: A TEMPORARY CONSTRUCTION EASEMENT A TEMPORARY CONSTRUCTION EASEMENT COMMENCING at the Northwest corner of said Common Ground also being the intersection of the Southern Right of Way of Big Bend Boulevard (variable width) with the East Right of Way line of Geyer Road (variable width); THENCE along the Western line of said Common Ground and the East Right of Way line of Geyer Road, South 33 degrees 57 minutes 28 seconds West, 16.15 feet to a point; THENCE departing said Western line of Common Ground along a line, North 72 degrees 12 minutes 57 seconds East, 8.07 feet to the POINT OF BEGINNING of the herein described TEMPORARY CONSTRUCTION EASEMENT; THENCE North 72 degrees 12 minutes 57 seconds East, 35.42 feet to a point; THENCE South 07 degrees 18 minutes 41 seconds West, 16.06 feet to a point; THENCE North 82 degrees 41 minutes 19 seconds West, 18.00 feet to a point, THENCE South 07 degrees 18 minutes 41 seconds West, 40.95 feet to a point; THENCE North 82 degrees 41 minutes 19 seconds West, 22.92 feet to a point in the West line of said Common Ground and the East Right of Way line of Geyer Road, THENCE North 07 degrees 18 minutes 41 seconds East, 24.37 feet to a point; THENCE departing said Western line of Common Ground along a line, North 33 degrees 57 minutes 28 seconds East, 19.71 feet to THE POINT OF BEGINNING, containing 1,144 square feet or 0.026 acres more or less. THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described sewer construction. Parcel #6 A 10.00 FOOT SEWER EASEMENT, being part of a tract of land conveyed in Deed Book 16319, Page 171 of the St. Louis County Records and located in the West 1/2 of the Northwest 1/4 Section 12 Township 44 North, Range 5 East in the City of Kirkwood, St. Louis County Missouri, being more particularly described as follows: A 10.00 foot wide SEWER EASEMENT being the North 10.00 feet, parallel and adjacent to the North line of said tract of land conveyed in Deed Book 16319, Page 171, said North Line also being the South Right of Way line of Burlington Northern Santa Fe Railroad (variable width), containing 1,015 square feet or 0.023 acres more or less. Parcel #9 A 35 FOOT TEMPORARY CONSTRUCTION EASEMENT, being part of a tract of land conveyed in Deed Book 17920, Page 76 of the St. Louis County Records and located in the West 1/2 of Section 12 Township 44 North, Range 5 East in the City of Kirkwood, St. Louis County Missouri,35 FOOT TEMPORARY CONSTRUCTION EASEMENT, for use during construction of any sewer in Metropolitan Sewer District Project No. 12175, said 35 FOOT TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A 35.00 foot wide TEMPORARY CONSTRUCTION EASEMENT being the West 35.00 feet, parallel and adjacent to the West line of said tract of land conveyed in Deed Book 17920, Page 76, said West Line also being the East Right of Way line of Geyer Road (variable width), containing 2,875 square feet or 0.066 acres more or less. THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described sewer construction. Parcel #10 A SEWER EASEMENT, being part of Lot 1 of Cragwold Manor Plat Book 353, Page 970 of the St. Louis County Records and located in the City Kirkwood, St. Louis County Missouri, being more particularly described as follows: BEGINNING at the Southeast corner of said Lot 1; THENCE along the Southern line of said Lot 1, North 50 degrees 23 minutes 31 seconds West, 35.76 feet to a point; THENCE departing said Southern line of Lot 1 along a line, North 71 degrees 53 minutes 04 seconds East, 29.59 feet to a point in the East line of said Lot 1; THENCE along the East line, South 01 degrees 01 minutes 41 seconds West, 32.00 feet to the POINT OF BEGINNING, containing 447 square feet or 0.010 acres more or less. Parcel #12 A 10.00 FOOT SEWER EASEMENT, being part of Lot 8 of Windsor Spring Estates Addition as recorded in Plat Book 101, Page 43 of the St. Louis County Records and located in the City of Sunset Hills, St. Louis County Missouri, being more particularly described as follows: A 10.00 foot wide SEWER EASEMENT being the West 10.00 feet, parallel and adjacent to the West line of said Lot 1, said West Line also being the East Right of Way line of Geyer Road (variable width), Excepting therefrom that portion covered by the existing easements recorded in Plat Book 101, Page 43, of said St. Louis County Records, containing 1,041 square feet or 0.024 acres more or less. Also, a 20 FOOT TEMPORARY CONSTRUCTION EASEMENT, for use during construction of any sewer in the above described 10.00 FOOT WIDE SEWER EASEMENT, said 20 FOOT TEMPORARY CONSTRUCTION EASEMENTS being more particularly described as follows: A 20 FOOT TEMPORARY CONSTRUCTION EASEMENT NO. 1 A 20.00 foot wide TEMPORARY CONSTRUCTION EASEMENT being parallel and adjacent to the East side of the above described 10.00 FOOT WIDE SEWER EASEMENT, Excepting therefrom that portion covered by the existing easements recorded in Plat Book 101, Page 43, of said St. Louis County Records, containing 2,277 square feet or 0.052 acres more or less. THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described sewer construction. Parcel #15 A 10 FOOT TEMPORARY CONSTRUCTION EASEMENT, being part of a tract of land conveyed in Deed Book 22286, Page 4138 of the St. Louis County Records and located in the Section 12 Township 44 North, Range 5 East in the City of Kirkwood, St. Louis County Missouri, 10 FOOT TEMPORARY CONSTRUCTION EASEMENT, for use during construction of any sewer in Metropolitan Sewer District Project No. 12175, said 10 FOOT TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: A 10.00 foot wide TEMPORARY CONSTRUCTION EASEMENT being the West 10.00 feet, parallel and adjacent to the West line of said tract of land conveyed in Deed Book 22286, Page 4138, said West Line also being the East Right of Way line of Geyer Road (variable width), containing 1,316 square feet or 0.030 acres more or less. THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on November 12, 2020.
