HomeMy Public PortalAbout1984_02_22_O010The Town of Leesburg in Virginia PRESENTED February 22, 1984 ORDINANCE NO. 84-0-10 ADOPTED February 22, 1984 AN ORDINANCE: AMENDING THE LEESBURG ZONING ORDINANCE TO ADD PROVISIONS FOR THE SUBDIVISION OF CERTAIN LOTS WHEREAS, the Council on August 24, 1983 initiated amendment of the Leesburg Zoning Ordinance to allow the subdivision of certain lots of record on which two detached dwellings exist; and WHEREAS, the Planning Commission on January 5, 1984 conducted a public hearing according to the requirements of Section 15.1-431 of the Code of Virginia, as amended; and on January 5, 1984 recommended adoption of such an amendment; and WHEREAS, this Council on February 8, 1984 conducted a public hearing on the proposed amendments advertised in accordance with the requirements of Section 15.1-431 of the Code of Virgini~ as amended; and WHEREAS, the Planning Commission and this Council find that an amendment of the Leesburg Zoning Ordinance to provide regulations governing the sub- division of lots of record on which two detached dwellings exist is required by the public necessity, convenience, general welfare and good zoning practice because: (1) (2) (3) These subdivisions create additional home ownership opportunities in furtherance of the Comprehensive Plan; These subdivisions will not affect the existing character of the town's neighborhoods; and These subdivisions will enhance the economic viability of the structures assuring continued maintenance and repair. -2- AMENDING THE LEESBURG ZONING ORDINANCE TO ADD PROVISIONS FOR THE SUBDIVISION OF CERTAIN LOTS THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Article 8 of the Leesburg Zoning Ordinance is amended to add a new section, numbered 8-2-2.1, to read as follows: 8-2-2.1 Notwithstanding any other provision of this ordinance=, any lot of record on which two.detached single family dwellings exist at the time of enactment of this section may be subdi- vided provided that: (1) each lot created by the subdivi- sion is at least 5,000 square feet in land area; (2) each lot created by the subdivision abuts a public street; (3) each lot created by the subdivision is at least 50 feet wide at its narrowest.point; (4) the subdivision results in the creation of two lots each with one of the existing dwellings thereon; and (5) if the Planning Commission determines that the lots created by the subdivision generally conform with the size of other lots in the immediate neighborhood. SECTION II. Ail ordinances and resolutions in conflict herewith are re- pealed. SECTION III.
