Greetings:
In the name of the Commonwealth of Massachusetts you are hereby
directed to notify and warn the inhabitants of the Town of Brewster
qualified to vote in Town affairs to meet in the Brewster Elementary
School Cafetorium, on Thursday, the sixth of January next at 7 : 30 p.m.
o'clock in the evening, then and there to act on the following
articles:
ARTICLE 1. To see if the Town will vote to raise and
appropriate or transfer from Free Cash the sum of One thousand three
hundred forty-one and 98/100 ($1,341. 98) Dollars to pay the following
unpaid bills for a previous fiscal year:

ARTICLE 2 . To see if the Town will vote to authorize the Board
of Selectmen to appoint a committee of at least three (3) residents of
the Town of Brewster to be known as the Brewster Municipal Golf Course
Committee. This Committee to further study the feasibility of
establishing a Municipal Golf Course in the Town of Brewster and report
to the Town at the Annual Town Meeting in May 1983 .
ARTICLE 3. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Three thousand five hundred and
00/100 ($3 ,500. 00) Dollars to fund the expenses of the Brewster Municipal
Golf Course Committee.
ARTICLE 4. To see if the Town will vote to amend the wage and
salary scale under the Personnel By-Law by adding 2% to the following
wage scales:
DH-6 Fire Chief (part-time)
DH-7 Building Inspector
I-3 Gas Inspector (part-time)
I-5 Assistant Building Inspector (part-time)
I-6 plumbing Inspector (part-time)
M-5 Assistant Shellfish Constables (part-time)
ARTICLE 5. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Nine hundred seventy-six and 14/100
($976. 14) Dollars to cover the 2% wage adjustment retroactive to July 1 ,
1982 for the following positions covered under the Personnel By-Law.

ARTICLE 6. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of One thousand four hundred _forty
and 00/100 ($1, 440. 00) Dollars to fund the increase in working hours
of the Assistant Building Inspector to 25 hours per week through
June 30 , 1983 .
ARTICLE 7 . To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Four hundred twenty-nine and 30/100
($429 . 30) Dollars to be added to the Assistant Wiring Inspector ' s Salary
Account.
ARTICLE 8. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of One thousand ten and 76/100
($1 ,010 . 76) Dollars to be added to the Community Center Custodian Salary
Account (to pay a part-time custodian at $4. 23 per hour through June 30 ,
1983) .
ARTICLE 9 . To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Five thousand seven hundred
eighteen and 94/100 ($5 ,718. 94) Dollars to the Employees Blue Cross
Refund Distribution Account and to distribute this amount to those
employees who qualify for refunds for the year 1978 in accordance
with Chapter 394 , Acts of 1982 .
ARTICLE 10 . To see if the Town will vote to direct the Board of
Selectmen to appoint a "Data Processing Advisory Committee" for the
purpose of comparing and evaluating proposals .for use of Service
Bureaus or In-house computer equipment and make a recommendation to the
Town and to raise and appropriate or transfer from Free Cash the sum
of One thousand two hundred and 00/100 ($1,200. 00) Dollars to fund the
expenses of that committee.
ARTICLE 11. To see if the Town will vote to direct the Board of
Selectmen to appoint a committee of up to three (3) members for the
purpose of resuming grave-marker reconstruction and replacement in the
Old Cemeteries (ancient burial grounds) .
ARTICLE 12 . To see if the Town will vote to raise and appro-
priate or transfer from Free Cash the sum of Ten thousand and 00/100
($10 ,000 . 00) Dollars for the purpose of replacing two sub-surface
fuel tanks at the Brewster Community Center, and any unexpended balance
to be returned to Free Cash.

ARTICLE 13 . To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of One thousand two hundred and 00/100
($1 ,200. 00) Dollars to replace the obsolete oil burner unit in the Town
Hall furnace.
ARTICLE 14 . To see if the Town will vote to transfer from Council
on Aging Receipts Reserved for Appropriation Account the sum of Four
thousand two hundred forty-four and 00/100 ($4 ,244. 00) Dollars to the
Council on Aging Building Material Account. This is grant money awarded
from Elder Affairs for building materials for an addition to the
existing Council on Aging structure.
ARTICLE 15. To see if the Town will vote to transfer from Council
on .Aging Receipts Reserved for Appropriation Account the sum of One
thousand three hundred forty-three and 00/100 ($1,343. 00) Dollars to the
Council on Aging Outreach Account. This is grant money awarded from
Elder Affairs for outreach purposes.
ARTICLE 16. To see if the Town will vote to transfer the sum of
Eighty three thousand seven hundred forty and 86/100 ($83 ,740 . 86) Dollars
from the following water betterment accounts:

Reserved for Appropriation Account for the purpose of developing a
wellfield at Rafe Pond within the Brewster Conservation District, North
of Freeman' s Way, including as incidental to such development, any design
costs, the construction of a bituminous road to provide access from the
wellfield to Silas Road, the construction of the building for the pumping
station including original pumping station equipment and costs related
thereto and for the construction of a connecting water main of at least
16 inches in diameter, and a water main of at least 16 inches in
diameter with appurtenances connecting the proposed well to the existing
16 inch main on Freeman' s Way.
ARTICLE 17. To see if the Town will vote to borrow the sum of
Five hundred forty-two thousand and 00/100 ($542 ,000. 00) Dollars for
the purpose of developing a wellfield at Rafe Pond within the Brewster
Conservation District, north of Freeman' s Way, including as incidental
to such development the construction of a bituminous road to provide
access from the wellfield to Silas Road, the construction of the building
for the pumping station including original pumping station equipment
and cost related thereto and for construction of a connecting water main

of at least 16 inches in diameter, and a water main of at least 16
inches in diameter with appurtenances connecting the proposed well
to the existing 16 inch main on Freeman ' s Way; and that to meet such
appropriation, the Town Treasurer, with the approval of the Board of
Selectmen, is hereby authorized to borrow the sum of $542 ,000. 00 at one
time or from time to time, under and pursuant to the General Laws as
amended and supplemented, or any other enabling authority and to issue
notes or bonds of the Town therefor, and to raise and appropriate the
sum of $25,000 . 00 for the purpose of paying the issuance costs of
said Bonds, and the costs of interest for temporary Notes issued in
anticipation thereof.
ARTICLE 18. To see if the Town will vote to transfer Twelve
thousand and 00/100 ($12 ,000 . 00) Dollars from the Water Receipts
Reserved for Appropriation Account to the Construction Account for
the purpose of rehabilitating the Town water system and to authorize
the Water Commissioners to accept the sum of Twenty-one thousand
four hundred fifty-seven and 00/100 ($21,457. 00) Dollars as a grant
from the Commonwealth of Massachusetts and to transfer said grant to
the construction account for the same purposes.
ARTICLE 19. To see if the Town will vote to transfer the sum
of Three thousand and 00/100 ($3 ,000 . 00) Dollars from Water Receipts
Reserved for Appropriation Account to the Construction Account for the
purpose of installing alarm systems in well houses one and two and for
any other security deemed necessary by the Water Commissioners.
ARTICLE 20. To see if the Town will vote to amend Article 12 ,
Special Town Meeting of December 10 , 1979 , which formerly read as
follows: To see if the Town will vote to borrow the sum of Seven
thousand and 00/100 ($7 ,000. 00) Dollars to install 500 feet of 8-inch
main, more or less, along Gages Way, the property owners repaying the
Town the above cost with interest, in full compliance with the Water
Betterment Assessment Program, by amending said article by reducing
the sum of Seven thousand and 00/100 ($7 ,000. 00) Dollars to the sum
of Six thousand four hundred and 00/100 ($6 ,400 . 00) Dollars.
ARTICLE 21. To see if the Town will vote to amend Article 42 ,
Annual Town Meeting, May 11, 1981, which formerly read as follows:
To see if the Town will vote to authorize the Treasurer to borrow the
sum of Thirty-nine thousand and 00/100 ($39 ,000 . 00) Dollars to install
water mains on Crowell ' s Bog Road (360 ft. ) and on Sheep Pond Circle
(1 ,960 ft. ) in accordance with the Water Betterment Program, by
amending said article by reducing the sum of Thirty-nine thousand and
00/100 ($39 ,000. 00) Dollars to the sum of Thirty-five thousand and
00/100 ($35,000. 00) Dollars.
ARTICLE 22 . To see if the Town will vote to raise and appro-
priate or transfer from Free Cash the sum of Four thousand two hundred
sixty and 00/100 ($4 ,260. 00) Dollars to be used for the engineering
and appraisal costs connected with the redesign of a portion of
STONY BROOK ROAD at the proposed RUN HILL ROAD intersection.

ARTICLE 23. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Eight thousand four hundred forty-
seven and 95/100 ($8 ,447. 95) Dollars and to transfer said amount to the
ROAD MACHINERY EXPENSE Account of the D.P.W. in order to defray the costs
of repairs to the 1952 Caterpillar D-7 bulldozer.
ARTICLE 24. To see if the Town will vote to transfer from D.P.W.
Receipts Reserved for Appropriation the sum of Seven thousand six
hundred sixty-nine and 00/100 ($7 , 669. 00) Dollars from the proceeds
received from the Commonwealth under the provisions of Chapter 335,
Section 1 (c) , Acts of 1982 to be used for the reconstruction of TUBMAN
ROAD.
ARTICLE 25. To see if the Town will vote to authorize the Board
of Selectmen to sell stone rubble from the Town landfill.
ARTICLE 26. To see if the Town will vote to raise and appropriate
or transfer from available funds the sum of Thirty thousand and 00/100
($30 ,000. 00) Dollars for Brewster' s share of the Phase I design costs
for the regional sewage plant in Orleans, Massachusetts.
ARTICLE 27. To see if the Town will vote to recommend that the
Septage Study Committee continue in its present capacity, as authorized
by Article 70 of the 1982 Brewster Annual Town Meeting, and to raise
and appropriate or transfer from available funds the sum of Thirty
thousand and 00/100 ($30 ,000. 00) Dollars for engineering studies to
determine the proposed location of a septage facility in Brewster , said
Thirty thousand and 00/100 ($30 ,000 . 00) Dollars for engineering studies
to be expended under the authority of the Septage Study Committee.
ARTICLE 28. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Fifteen thousand and 00/100 Dollars
($15 ,000 . 00) Dollars for the implementation of a groundwater monitoring
program in and around the Sanitary Landfill.
ARTICLE 29. To see if the Town will vote to raise and appropriate
or transfer from Free Cash the sum of Two hundred fifty and 00/100
($250. 00) Dollars to fund an account for court costs involved with
placing overdue Personal Property and Boat Excise Tax bills that the
Town cannot collect into Small Claims Court.
ARTICLE 30 . To see if the Town will direct the Selectmen and
the Board of Health to look into the feasibility of having a separate
sticker for the dump at a cost of $2 . 00 for residents and a sticker
for the beach at a cost to be set by the Selectmen.

In accordance with the Warrant the Special Town Meeting was held
in the Brewster Elementary School Cafetorium, Thursday, January
6, 1983.
The meeting was called to order at 7: 31 p.m. by the Moderator,
Stephen L. Boyle® The tellers were Dorothy Grenier, June Gallant ,
Doris Powell, Gladys Curtis and J. Ogden Tyldsley, Jr. Checkers
were DorotYea Dugan, Jean Gage, Carl Scrivener and Mae Olson.
A quorum was present.

In the name of the Commonwealth of Massachusetts you are here-
by directed to notify and warn the inhabitants of the Town of
Brewster qualified to vote in Town affairs to meet in the Brewster
Elementary School Cafetorium, on Monday, the ninth of May next at
seven o ' clock in the evening, then and there to act on the following
articles:
ARTICLE 1. To act on the Annual Report of the Board of
Selectmen and other Town Officers.
ARTICLE 2. To hear the report of any special committee.
ARTICLE 3 . To see if the Town will vote to authorize the
Town Treasurer, with the approval of the Board of Selectmen, to
borrow money from time to time in anticipation of the revenue of
the financial year beginning July 1, 1983 , in accordance with
the provisions of the General Laws , Chapter 44 , Section 4 , and
to issue a note or notes as may be given for a period of less
than one (1) year in accordance with the General Laws , Chapter 44 ,
Section. 17.
ARTICLE 4 . To see if the Town will vote to raise and appropriate
as payment due, the sum of Three hundred twenty and 17/100 ($320. 17)
Dollars for the year 1982 under the provisions of Chapter 32 , Section
59A of the General Laws and authorize the Town Treasurer to pay said
appropriation to the Town of Arlington, Massachusetts , said Chapter
referring to the non-contributory pension payments made to veterans.
ARTICLE 5. To see if the Town will vote to raise and appropriate
as payment due the sum of Six hundred eighty-seven and 24/100 ($687. 24)
Dollars for the year 1982 under the provisions of Chapter 32 , Section
59A of the General Laws , and authorize the Town Treasurer to pay
said appropriation to the Commonwealth of Massachusetts , said Chapter
referring to the non-contributory pension payments made to veterans.
ARTICLE 6. To see if the Town will vote to raise and appropriate
the sum of One thousand two hundred and 00/100 ($1,200 . 00) Dollars
for the period from July 1 , 1983 to June 30 , 1984 , under the pro-
visions of Chapter 944 , Section 1 and 2 , Acts of 1971, and Act pro-
viding that cities and towns grant an annual pension to certain
retired teachers and that the Commonwealth reimburse said cities and
towns for the amount of all such pensions.
ARTICLE 7. To see if the Town will vote to assume liability
in the manner provided by Chapter 516 and 524 , Acts of 1950 for all

damages that may be incurred by work to be performed by the
Department of Public Works of Massachusetts for the improvement,
development, maintenance and protection of tidal and non-tidal
rivers and streams, harbors , tidewaters , foreshores and shores along
a public beach outside Boston Harbor, including the Merrimack and
Connecticut Rivers , in accordance with Section 11 of Chapter 91 of
the General Laws , and authorize the Board of Selectmen to execute
and deliver a bond of indemnity therefor to the Commonwealth.
ARTICLE 8. To see if the Town will vote to raise and
appropriate the sum of Two hundred six and 80/100 ($206. 80) Dollars
under the provisions of Chapter 338 , Acts of 1954 , amended by
Chapter 433 , Acts of 1955, Control of the Greenhead Fly, and
authorize the Town Treasurer to pay said appropriation into the
State Treasury.
ARTICLE 9 . To see what action the Town will take
regarding its Herring or Alewife fishery..
ARTICLE 10. To see if the Town will accept Chapter 59 ,
Section 5, Clause 37A of the General Laws as amended by
Chapter 258 of the Acts of 1982. (abatement for blind)
ARTICLE 11. To see if the Town will accept Chapter 59,
Section 5, Clause 17C of the General Laws as amended by
Chapter 743 of the Acts of 1981. (abatement for widows)
ARTICLE 12 . To see if the Town will vote to approve the
1983-84 budget for the Nauset Regional School District in the
amount of $1 ,422 , 251. 73 as adopted by a vote of the Nauset
Regional School Committee.
ARTICLE 13 . To see if the Town will vote to approve the
annual regional school district budget for the Cape Cod
Regional Technical High School District for the fiscal year
beginning July 1, 1983 , in the amount of $151, 990. 00 .
ARTICLE 14 . To see if the Town will vote to amend the
Personnel By-Law by adding Section 26 . "Equal Employment
Opportunity Employer" to read as follows , to be effective
immediately: The Town of Brewster is committed to a policy
providing equal employment opportunity. Discrimination against
any person in recruitment, examination, appointment, training,
promotion, retention or any other personnel action because of
political affiliation, race, creed, color, national origin, age,
sex, handicap or any other non-merit factor is prohibited.

ARTICLE 15. To see if the Town will vote to amend the
Personnel By-Law Section 16 . Leave of Absence Without Pay by
adding item c. as follows : c. Maternity Leave - Whenever a
regular full-time or regular part-time employee becomes
pregnant, she shall furnish a certificate from her physician
stating the expected date of her delivery. While an employee
may take maternity leave without pay at any time after a
diagnosis of her pregnancy is confirmed by her physician in
writing, the Town may require written certification from her
physician as to how long the employee should continue her
regular work. All requests for maternity leaves of absence
shall be made in writing by the employee to her Administrative
Authority at least two (2) weeks prior to the desired date of
leave. For maternity leave which does not exceed ten (10)
weeks , the Town shall reinstate the employee in her previous
position with the same status, pay, and length of service
credit as of the date of her leave, and cover the Town' s part
of the employee ' s Blue Cross/Blue Shield for the ten (10)
week period. For longer periods of leave, the Town shall
reinstate the employee in the first available opening for
which she is qualified.
ARTICLE 16 . To see if the Town will vote to amend the
Personnel By-Law by adding Section 27 "Education and Training"
to be effective immediately and read as follows : It shall
be the policy of the Town of Brewster to encourage employees
to improve their knowledge and skills by on-the-job training,
participation in recognized job-related programs sponsored by
State, County and other professional government related
Associations and by enrollment in accredited schools and
colleges. The Personnel Board shall establish procedures
defining the limits of financial assistance and conditions
under which assistance shall be provided for employee
participation in accredited school and college programs .
ARTICLE 17 . To see if the Town will vote to amend the
wage and salary scale under the Personnel By-Law by adding 50
to the wage and salary scale excepting temporary part-time
personnel who are employed less than 6 months per year on a
part-time basis . Said increase is permanent, is a cost-of-living
increase beginning fiscal year 1984 and is to be effective
July 1, 1983 .
ARTICLE 18 . To see if the Town will vote to amend the
Personnel By-Law, Section 9 Vacation Leave, by amending
section c . to read as follows : "During the sixth through the
tenth year of continuous employment, such employee shall be
granted three calendar weeks of vacation effective July l . "
and section d. to read: "Beginning the eleventh year of
continuous employment, such employee shall be granted four
calendar weeks of vacation effective July l. "
ARTICLE 19 . To see if the Town will vote to amend the
wage and salary scale under the Personnel By-Law by amending
individual classifications as follows :

ARTICLE 21. To see if the Town will vote to authorize
and direct the Board of Selectmen to petition the General
Court to pass the following special act:
SECTION 1. Notwithstanding any contrary provision of law,
the office of Town Treasurer and Collector
of the Town of Brewster shall be appointed
by the Board of Selectmen for a term of 3 years .
Upon the appointment and qualification of said
Town Treasurer and Collector, the term of
office of the person holding this office shall
cease and terminate. All provisions of the
law relative to treasurers and to collectors of
taxes shall, except insofar as the same may be
inconsistent with the provisions of this act,
apply to said Town Treasurer and Collector.
SECTION 2 . Notwithstanding any contrary provisions of law,
the offices of Town Clerk; and Town Treasurer and
Collector, in the Town of Brewster shall not be
held by the same individual .
SECTION 3 . Notwithstanding the provisions of SECTION 2 . ,
the incumbents in the offices of Town Clerk and
Town Treasurer/Collector, if they are the same
person, shall continue to hold office as follows :
The Town Clerk may continue to serve the remaining
term of office, unless removed for any reason; the
Town Treasurer/Collector shall continue to serve
until a new Town Treasurer and Collector is
appointed in accordance with SECTION l. , above
or is removed for any reason.
SECTION 4. This act shall take effect upon its passage.
ARTICLE 22 . To see if the Town will vote to amend the
Personnel By-Law, Section XII , 1 . 3 by adding to the. Appendix
the following job description:

plan entitled "County of Barnstable, Plan of Road to Shore in
Brewster as laid out by the County Commissioners, scale 40 feet

the Town will vote to raise and appropriate or transfer from
available funds the sum of $9 , 600 . 00 for payment of this eminent
domain taking and to designate the parcel so purchased to be a
Town Park in perpetuity, placed under the care and maintenance
of Brewster ' s Department of Public Works .

ARTICLE 36. To see if the Town will vote to amend Article 69
voted at the Annual Town Meeting of May 12 , 1975 by deleting the
words "ninety (90) days" and substituting the words "one hundred
twenty (120) days" and deleting "June 30, 1975" and substituting
"June 30, 1983" , so the amended article shall read as follows :
The Annual Town Report shall be printed and available for
distribution to the inhabitants of Brewster within one hundred
twenty (120) days of the close of the fiscal year, commencing
with the year ended June 30, 1983 and each year thereafter.
ARTICLE 37 . To see if the Town will vote to amend the
Finance Committee By-Law by adding, at the end of the first
paragraph of said By-Law, the following phrase:
All appointments by the Moderator shall begin on July 1
and shall terminate on June 30, of the third year following
appointment, except vacancies in existing offices which
may be appointed by the Moderator for the original term.
So that as amended, the complete By-Law will read as follows :
There shall be a Finance Committee consisting of nine
members who shall hold no other town office. The Moderator
of the Town Meeting when this by-law is adopted shall within
thirty days after such by-law becomes effective, appoint
from the citizens of the town three persons whose term of
office shall expire at the adjournment of the first annual
Town Meeting following the time when this by-law becomes
effective; three whose term of office shall expire at the
adjournment of the second annual Town Meeting following
the time when this by-law becomes effective; and three whose
term of office shall expire at the adjournment of the third
annual Town Meeting following the time when this by-law
becomes effective. The Moderator of each Annual Town Meeting
thereafter shall appoint three members for a term of three
years. All appointments by the Moderator shall begin on
July 1 and shall terminate on June 30 of the third year
following appointment, except vacancies in existing offices
which may be appointed by the Moderator for the original
term.
It shall be the duty of this Committee to consider all
matters of business included within the articles of any
warrant for a Town Meeting and it shall be the duty of
the Selectmen immediately upon drawing up a Warrant for
Town Meeting to transmit a copy thereof to the Finance
Committee. The Committee shall report on each article to
the Town Meeting, in print or otherwise as it deems for the
best interest of the Town.
The Finance Committee shall have authority at any time to
investigate the books , accounts and management of any
department of the Town, and the books and accounts of the
Town shall be open to inspection of the Committee or any
person authorized to act for the Committee.
The members of the Finance Committee shall serve without

expenses incurred in discharge of their duties thereunder.
Any vacancy which may occur in said Committee shall be
filled by the remaining members of the Committee .
All existing appointments shall remain in effect until their
normal expiration date.

Dollars to fund the Finance Committee Reserve Fund Account.

implement the Outreach program in anticipation of reimbursements

money by borrowing or otherwise, for the acquisition of land by
purchase or taking by eminent domain for recreational and conserva-

on February 15, 1983 , said plan being on file in the Town
Clerk' s Office, plus a sum of money sufficient to pay interest

money by borrowing or otherwise, for the construction of a
municipal golf course including the construction of buildings
and the cost of original equipment and furnishings, as shown on
a plan dated February 7, 1983 prepared by Schofield Brothers , Inc.
and approved by the Planning Board on February 15, 1983 , said
plan being on file in the Town Clerk ' s Office, plus a sum of
money sufficient to pay interest on any bonds or notes issued

appropriate or transfer from available funds a sum of money to
pay the principal and interest on the first year 's borrowing
on the golf course.
ARTICLE 44 . To see if the Town will vote to authorize and
instruct the Town Treasurer to pay a sum of money from the Dog Tax
assessments of 1982 to the Brewster Ladies ' Library Association
in accordance with Chapter 140, Section 172 .

for better utilization of the present Town Hall for Town offices .
ARTICLE 72 . To see if the Town will vote to instruct the
Selectmen to lay out a forty (40) foot way from Route #137,
along Crowell ' s Bog Road, along an ancient way bordered by land
of Elizabeth Sheehy and Lillian Callahan and Pearl Dickey, to
the boundary of Sheep Pond Estates, Section II (a distance of
twenty-two hundred (2200 feet more or less) and to improve said
road as in your judgment the public convenience and necessity
shall require and to transfer from available funds or to raise
and appropriate a sum of money for engineering and appraisal

By-Law on Laying Out of Public Ways, adopted under Article 21,
Annual Town Meeting, March 6, 1967 by deleting prior By-Law and
adding the following By-Law: "In the matter of laying out a
public way over private property, the Board of Selectmen shall
require a plan drawn by a registered engineer or registered land
surveyor at the petitioner ' s expense which shall include all
details of the road, names of all owners and abuttors, areas to
be taken, drainage disposal, easements and any other specifica-
tions that the Board of Selectmen may require. If in the discretion
of the Board of Selectmen, a subdivision plan, approved by the
Brewster Planning Board and duly recorded in the Barnstable County

it complies with the necessary requirements for the layout. No
layout shall be considered by the Board of Selectmen if the road
does not meet all of the requirements pertaining to road layouts

Board of Selectmen may require certain road repairs if deemed
necessary before laying out said road. If the Board of Selectmen
decides that said road layout is in the best interests of the
Town relative to convenience and necessity, it shall institute

Dollars to align, widen, reconstruct, install drainage and pave
with bituminous concrete a section of TUBMAN ROAD, from the
intersection of ALDEN DRIVE to New England Telephone Company

following resolution: Resolved: The Nuclear Crisis Relocation
Plan developed for the Town of Brewster by The Massachusetts
Civil Defense Agency proposes the evacuation of 23 , 966 residents
of the Town of Dartmouth to the Town of Brewster in the event
of the danger or perceived threat of nuclear attack. We, the

crisis Relocation Pian, finding nat it creates an illusion of

Brewster Elementary School Cafetorium, Monday, May 9, 1983.
The meeting was called. to order at 7: 00 p.m. by the Moderator, Stephen
Doyle. The Tellers were June Gallant, Doris Powell, Gladys Curtis,
J . Ogden Tyldsley, Jr. , and Ruth Hanlon. Checkers were Dorothea Dugan,

rivers and streams , harbors , tidewaters , foreshores and shores along
a public beach outside Boston Harbor, including the Merrimack and
Co7znecticut Rivers , in accordance with Section 11 of Chapter 91 of
the General Laws , and authorize the Board of Selectmen to execute
and deliver a bond of indemnity therefor to the Commonwealth.

ARTICLE 14 . To see if the Town will vote to amend the
Personnel By-Law by adding Section 26 . "Equal Employment
Opportunity Employer" to read as follows, to be effective
immediately: The Town of Brewster is committed to a policy
providing equal employment opportunity. Discrimination against
any person in recruitment, examination, appointment, training,
promotion, retention or any other personnel action because of
political affiliation, race, creed, color, national origin, age,
sex, handicap or any other non-merit factor is prohibited.

ARTICLE 15 . To see if the Town will vote to amend the
Personnel By-Law Section 16 . Leave of Absence Without Pay by
adding item c. as follows : c . Maternity Leave - Whenever a
regular full-time or regular part-time employee becomes
pregnant, she shall furnish a certificate from her physician
stating the expected date of her delivery. While an employee
may take maternity leave without pay at any time after a
diagnosis of her pregnancy is confirmed by her physician in
writing, the Town may require written certification from her
physician as to how long the employee should continue her
regular work. All requests for maternity leaves of absence
shall be made in writing by the employee to her Administrative
Authority at least two (2) weeks prior to the desired date of
leave. For maternity leave which does not exceed ten (10)
weeks, the Town shall reinstate the employee in her previous
position with the same status , pay, and length of service
credit as of the date of her leave, and cover the Town' s part
of the employee ' s Blue Cross/Blue Shield for the ten (10)
week period. For longer periods of leave, the Town shall
reinstate the employee in the first available opening for
which she is qualified.
ARTICLE 16 . To see if the Town will vote to amend the
Personnel By-Law by adding Section 27 "Education and Training"
to be effective immediately and read as follows : It shall
be the policy of the Town of Brewster to encourage employees
to improve their knowledge and skills by on-the-job training,
participation in recognized job-related programs sponsored by
State, County and other professional government related
Associations and by enrollment in accredited schools and
colleges . The Personnel Board shall establish procedures
defining the limits of financial assistance and conditions
under which assistance shall be provided for employee
participation in accredited school and college programs .

wage and salary scale under the Personnel By-Law by adding 5%
to the wage and salary scale excepting temporary part-time
personnel who are employed less than 6 months per year on a

increase beginning fiscal year 1984 and is to be effective
July 1, 1983 .
ARTICLE 18 . To see if the Town will vote to amend the
Personnel By-Law, Section 9 Vacation Leave, by amending

The Annual Town Report shall be printed and available for dis-
tribution to the inhabitants of Brewster within one hundred twenty
( 120 ) days of the close of the fiscal year, commencing with the
year ended June 30, 1983 and each year thereafter.

There shall be a Finance Committee consisting of nine mem-
bers who are residents of the Town and who shall hold no other
Town office. All members of the Finance Committee shall be app-
ointed by the moderator for the term of three years. The Town
Moderator shall annually appoint three members for a term of
three years. All appointments by the Moderator shall begin on
July 1 and shall terminate on June 30, of the third year follow-
ing appointment, except vacancies in existing offices which

So that as amended the complete By-Law will read as follows:

investigate the books, accounts and management of any depart-
ment of the Town, and the books and. accounts of the Town shall
be open to inspection of the Committee or any person author-
ized to act for the Committee.
The members of the Finance Commttee shall serve without
pay for their services but may be reimbursed for actual expenses
incurred in the discharge of their duties thereunder.
Any vacancy which may occur in said Committee shall be filled
by the remaining members of the Committee.
All existing appointments shall remain in effect until their
normal expiration date.

Commission shall be appointed by the Selectmen for the following
initial terms : Two (2) members appointed for three-year terms; two
(2) members appointed for two-year terms; one (1) member appointed for
one-year term; two (2) alternate members appointed for two-year terms,
thereafter the Selectmen shall appoint members for three (3) year
terms . Vacancies shall be filled by appointment by the Selectmen.
The Commission shall, within thirty (30) days of the end of the
fiscal year, make a report to the inhabitants of the Town, and shall
be subject to audit in the same manner as other boards and commissions
and to act fully thereon.

ARTICLE 4 . To see if the Town will vote to authorize the
Selectmen to negotiate a lease with a private corporation or
individual for the construction, equipping and operation of a
full-size eighteen hole public golf course on land acquired by the
Town under Article 41 of the Annual Town Meeting of May 9 , 1983
and to act fully thereon.
ARTICLE 5 . To act on any other business that may legally
come before this meeting.
And you are directed to serve this Warrant with your doings
thereon to the Town Clerk at the time and place of said meeting
as aforesaid.

In the name of the Commonwealth of Massachusetts you are hereby directed
to notify and warn the inhabitants of the Town of Brewster qualified to vote
in Town affairs to meet in the Brewster Elementary School Cafetorium, on
Monday, the twenty-sixth of September next at 7:30 p.m. o'clock in the even-
ing, then and there to act on the following articles:
ARTICLE 1. To see if the Town will vote to reduce the FY'84 Town Share
Group Plans budget as voted under Article 34 in the May 1983 Annual Town
Meeting from $155,220.00 to $135,000.00, a reduction of $20,220.00 for Blue
Cross/Blue Shield, or to take any action relative thereto.
ARTICLE 2. To see if the Town will vote to amend Article 12 and Article
34, line item 121 of May 9, 1983 Annual Town Meeting by substituting the
amount of $1,324,259.73 in place of the amount of $1,422,251.73 of the Town's
shares of the Nauset Regional School District Assessment to accommodate the
adjustment of $97,992, or to take any action relative thereto.
ARTICLE 3. To see if the Town will vote to authorize the Board of
Selectmen to grant an easement to Commonwealth Electric Company for the
installation and maintenance of an overhead electric system over land of the
Town of Brewster between Slough Road and Walkers Pond for service to a new
home. The easement is to extend from a pole numbered 34/15 on Slough Road in
a general northeasterly direction approximately eighty (80) feet to a pole
numbered 149/1 on private property. The easement is to be ten (10) feet in
width throughout and to act fully thereon, or take any action thereto.
ARTICLE 4. To see if the Town will vote to authorize the Board of
Selectmen to appoint a three (3) member committee for a one-year term to make
recommendations to the Selectmen to implement the improvement of the parcel
known as "The Egg" for a Town Park, or to take any action relative thereto.
ARTICLE 5. To see if the Town will vote to authorize the Town Clerk,
with the approval of the Board of Selectmen, to sell, trade or otherwise
dispose of one (1) Silver Reed Portable Electric Typewriter, or to take any
action relative thereto.
ARTICLE 6. To see if the Town will vote to raise and appropriate or
transfer from available funds the sum of Three-hundred and 00/100 ($300.00)
Dollars for the purchase of dog tags and licenses and the sum of Five-hundred

ment the vote under Article 90 of Annual Town Meeting of 1982, or to take any

machine at the Brewster Council on Aging, or to take any action relative

departmental budgets of capital items costing One thousand and 00/100 ($1-
,000.00) Dollars or less, or to take any action relative thereto.
ARTICLE 9. Whereas the Brewster Ladies Library serves all the people of
Brewster as a free public library: Now, therefore, be it resolved that it is
the will of the people of Brewster assembled in Town Meeting that 100% of the
Library operating expenses be met by the Town effective with the fiscal year
beginning July 1, 1984. Such funds are to be appropriated at the Annual Town
Meeting and to be accounted for in accordance with procedures established by
the Board of Selectmen.
ARTICLE 10. To see if the Town will vote to transfer the sum of Fifteen
thousand seven hundred eighty-four and 85/100 ($15,784.85) Dollars from the
following accounts:

Corporation in regard to a Service Agreement between the Town and STELEC

Facility, and any agreement reached between the Selectmen and STELEC
Corporation to be subject to approval at a subsequent Town meeting, or act on
anything relative thereto.
ARTICLE 27. To see if the Town will vote to accept Chapter 597 of the
Acts of 1982 amended Massachusetts General Laws, Chapter 60A, Section 1 to
provide an exemption from the Motor Vehicle Excise for any motor vehicle owned
and registered by a former prisoner of war, which term is defined as any
regularly appointed, enrolled, enlisted, or inducted member of the U. S.
military forces who was captured, separated and incarcerated by an enemy of
the United States during armed conflict, or to take any action relative
thereto.
ARTICLE 28. To see if the Town will vote to raise and appropriate or
transfer from available funds the sum of Two thousand seven hundred fifty and
00/100 ($2,750.00) Dollars to supplement the $12,000 voted in Article 81, May
9, 1983 Annual Town Meeting, to purchase and equip a new four-wheel drive
pickup truck for the D.P.W. , with snow plow, and to raise and appropriate or
transfer from available funds the sum of One thousand seven hundred fifty and
00/100 ($1,750.00) Dollars for a new snow plow to equip the four-wheel drive

Landfill entrance from the present site on Run Hill Road to a proposed

appropriate or transfer from available funds a sum of money for the laying
out, engineering and/or appraisal services for this proposed entrance off

transfer from available funds the sum of Six thousand five hundred and 00/100
($6,500.00) Dollars to provide engineering and/or appraisal services for
construction plans for a portion of GREAT FIELDS ROAD extending southerly from

Board of Selectmen on file with the Town Clerk laying out and making public: as

In accordance with the Warrant the Special Town Meeting was held in the
Brewster Elementary School Cafetorium, Monday, September 26, 1983.
This meeting was called to order at 7:31 p.m. by the Moderator, Stephen L.
Doyle. The tellers were Dorothy Grenier, June Gallant, Doris Powell, Gladys
Curtis and J. Ogden Tyldsley, Jr. Checkers were Dorothea Dugan, Jean Gage,
Carl Scrivener and Mae Olson. A quorum was present.
The Warrant was read by the Assistant Town Clerk, Janice M. Stratton, with the

COURT and HIGHRIDGE ROAD, all as shown on a plan entitled "Cluster Development
Plan in Brewster, MA made for Heritage Development Corporation, August 16,
1977, Sheet 1: Scale 1" = 60' , Sheets 2 & 3: Scale 1" = 40' , Nickerson &
Berger, Inc. - P.E. & R.L.S. , Orleans, MA" which plans are recorded in the
Barnstable County Registry of Deeds, Book 319, Pages 79-81 and a copy of which
is on file with the Town Clerk and to authorize the Selectmen to acquire by
eminent domain the fee in the land, drainage easements and rights therein.

ARTICLE 35. To see if the Town will vote an expression of opinion in the
form of a resolution.
Be it resolved that the Water Commissioners came before the residents of
Brewster, at a Special Town Meeting, September 26, 1983, to ask its residents
to direct the Water Commissioners to apply for a 100% reimbursable grant for
the protection of the existing well fields. This grant is known as the
Aquifer Land Acquistion Program, with the maximum grant money of $500,000.

form of a resolution:
TO: His Excellency, Michael Dukakis, Governer
Whereas the provision of advanced prehospital emergency medical care is
inherently different in the non-urban setting from the urban setting; and
Whereas the taxpayers of the Town of Brewster intend to maintain the level of
service currently provided, at the lowest possible cost; and
Whereas in accordance with the letter and spirit of Massachusetts Law Chapter
580, Acts of 1980, all agencies of the Commonwealth of Massachusetts must
refrain from promulgating regulations which will increase municipal costs.
Be it Resolved, this twenty-sixth day of September, 1983, that the Town of
Brewster is opposed to any revisions of the criteria for the Emergency Medical
Technician-Paramedic's recertification other than those required by the
National Registry of Emergency Medical Technicians.
