PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, City Attorney Andrew Rawlings,Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Steve Ellsworth, Nanci Wadsworth, Aubrey Dokos, Michelle Tolman, Rebekah Brinkerhoff, Debra Haacke, Jen Crofts, Rylea Farrens, Christine Shelly, his Mann and Barbara Schreier. Mayor Gubler welcomed everyone, and Council Member Wadsworth led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of August 16, 2022 were reviewed. Council reviewed the finance reports for the period ending August 31, 2022 (92% of the fiscal year elapsed). The City had $2,606,752.57 in the bank and routine bills had been paid,"Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Mann seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Approval of additional Water & Sewer Hook-Up Location for Harvest Cove Subdivision — Mayor Gubler stated this item has already been reviewed and approved by Director Prouse and the City Engineer. He continued and stated this change added an actual sewer connection and water line to Lot 7 of the Harvest Cove Subdivision. Mayor Gubler stated this has already been implemented. Council President Geray stated he has no concerns if Director Prouse and the City Engineer have reviewed and approved it. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the additional Water & Sewer Hook-Up Location for the Harvest Cove Subdivision as presented. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Approval of FY2023 Bonneville County Sheriff's Office Law Enforcement Contract and Approval of Fiber Internet Contract with Direct Communications—Council President Geray stated they have not received an actual contract from Bonneville County to review and suggested tabling this approval until there is a written contract. Clerk West stated the contract is set to begin this week and the only item changing is the contract amount, which is 5% more than last year. Council President Geray stated Bonneville County will continue coverage for the City of Iona, but the Council needs to have a written contract to review before approving it. Mayor Gubler agreed and stated there is no contract from Direct Communications and suggested tabling that approval also. IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 Mayor Gubler entertained a motion. Council President Geray made a motion to table these discussions until there are contracts available. Council Member Thompson seconded the motion. All in favor. Motion carried. Public Hearing; Variance Application—Peter Wadsworth,4062 N. Olsen Street; a variance pertaining to the 30' driveway approach and construction as specified by Iona City Code § 10-1-17(E)(2)— Peter Wadsworth of 4062 N. Olsen Street approached the podium and stated he has had a gravel driveway for years and decided to pave it recently. During the process he contacted Director Prouse to ensure he was adhering to the City Code and Director Prouse suggested leaving the side of his driveway gravel. However, at the end of the thy there was extra asphalt,so he decided to put it down on that side because it did used to be asphalt in the past. Mr. Wadsworth continued and stated he does not consider that area to be part of the driveway, so the asphalt should not be a problem. Council President Geray stated if the area had been paved in the past, he would consider this to be a non-conformance situation. He continued and stated he does not think a variance is necessary if he is restoring an already non-compliant area and not making it bigger or changing it in any way. Attorney Rawlings explained if someone had a house that was non-compliant and tore down the whole house, they would not be able to rebuild it the same way. He continued and stated if there was asphalt there and it was torn up, a variance would be required to allow it to be re-paved, rather than bringing it into compliance. Clerk West asked Mr. Wadsworth if it was paved or gravel prior to the recent activity. Mr. Wadsworth stated it was paved years ago but was torn out to replace a sewer line and has been gravel since then. He continued and stated he drove around the City and took pictures of other homes that have done the same thing as he did and provided those pictures for the Council to view. Mr. Wadsworth continued and voiced concern over the inconsistencies. He stated his opinion that decisions are sometimes made simply to adhere to the letter of the law but restrict residents from making improvements to the appearance of their property. Council President Geray asked if the 30' driveway approach requirement from the Iona Subdivision Ordinance is the Code that is being referenced in this situation. Director Prouse confirmed. Council President Geray reviewed the Iona Subdivision Ordinance and stated the purpose is described as "guidance for future development and growth to the City..." He continued and stated it seems that it is written with new development in mind, not necessarily to upgrade the historical neighborhoods. Attorney Rawlings stated there is a section that discusses "Non-Conforming Uses" and explains the City cannot demand that existing subdivision conform to updated standards. However, the City does need to have ordinances to protect the City from having homeowners alter their land any way they see fit after it is developed and adhering to the City Code standards. Mayor Gubler stated he thinks the discussion about the Code and how it is applied is something that needs to happen at another time. He continued and stated the Council needs to focus on what Mr. Wadsworth is requesting at this time. Council President Geray stated he needs the clarification to determine if this Code should apply to this situation. Director Prouse stated it is currently the only Code the City has to regulate driveway approaches. He continued and requested the Council to think about what they consider a subdivision and how to regulate construction outside of developments. Director Prouse also stated none of the properties in the photos Mr. Wadsworth has provided were constructed while he has been with the City. Mr. Wadsworth explained his desire and intention with the photos is to illustrate that homeowners should be able to make these improvements without the requirement of a variance. Director Prouse stated in most cases the asphalt area is not the property of the homeowner and paving it 2 IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 can cause a detrimental situation for everyone with improper drainage that can create standing water and ice on the road. Council President Geray stated the Code allows for 30' and asked how much wider Mr. Wadsworth approach is now that it has been paved. Mr. Wadsworth stated what he considers driveway is only 29' wide. Director Prouse stated the approach is much wider than 30', even though Mr. Wadsworth does not consider it part of the driveway. He continued and stated it is a non-conforming use of the public right-of-way as defined by the current City Code. Director Prouse stated every road is designed with drainage in mind and there has to be a place near the road to drain water. Rylea Farrens spoke up from the audience and stated the Planning& Zoning Commission (P&Z) discussed the drainage concern also and recommended the City Council require Mr. Wadsworth to add a french drain. Director Prouse stated due to the location of underground utilities,a french drain would not be allowed in that area. Clerk West stated the P&Z did recommend the Variance for approval, with the condition that Mr. Wadsworth add a drainage system. Mr. Wadsworth stated with recent rain there have been no issues with the water draining into his yard because of the slope. Director Prouse stated if too much water drains into the yard it can create future problems with the sewer lateral. He continued and stated he is worried about the precedent this will set for the future if the Variance is approved. Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience would like to address the Council regarding this agenda item. No response. Mayor Gubler then closed the Public Hearing portion of this agenda item for Council deliberation. Council Member Wadsworth recused himself from the discussion and vote. Council President Geray stated this application has shed light on a lot of issues that need to be addressed, including the Iona Subdivision Ordinance. He continued and stated he recognizes it is geared more towards new developments, but ordinances are put in place for a reason. Council President Geray stated if this Variance is approved it will set a precedent for anyone in the future that would like to widen their driveway, despite the reasoning behind it. Council Member Thompson stated he appreciates homeowners that try to improve their lot with the increased curb appeal. He continued and stated there are many areas in town that have gravel instead of asphalt and still have problems with weeds and drainage issues. Council Member Thompson stated he is leaning towards approving the Variance because of the aesthetics and doesn't feel the drainage will be an issue. Council President Geray stated the concern is regarding the potential hazard underground that this could cause. Council Member Thompson stated if the homeowner's sewer or water line breaks it would be up to the homeowner to repair, not the City. Council Member Mann agreed, but also stated he does not want to set a precedent by approving this Variance. Mayor Gubler stated it could influence perception, but the City legally cannot set a precedent. Council Member Thompson asked what other options they can give Mr. Wadsworth, rather than just disapproving the Variance. Council President Geray stated even if they allow him to add drainage, the driveway approach would still exceed the 30' that the Code allows. He continued and stated he defers to the Public Works Director and will follow his guidance on this issue. He is the one that maintains this entire infrastructure and has the expertise on this subject. 3 IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 Mayor Gubler entertained a motion. Council President Geray made a motion to disapprove the Variance Application for Peter Wadsworth. Council Member Mann seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: NO Council Member Mann: YES Public Hearing; Variance Application — Todd Hyde, 3213 N. Olsen Street, a variance pertaining to the construction of a metal carport in front of the existing home, within the required front yard setback as specified by Iona City Code§ 11-4-5(A)—Todd Hyde of 3213 N. Olsen Street approached the podium and stated he would like to put up a metal carport approximately 5' from the front of his house. He continued and stated when people drive down the gravel road next to his house; it throws rocks up towards his house and vehicles. He continued and stated the carport would be 37' from Olsen Street. Director Prouse asked if any of the structure would be placed in the public right-of-way. Discussion then took place regarding the location of Mr. Hyde's property lines and the measurements from there to the carport. Director Prouse stated he would like to verify the property lines with Mr. Hyde prior to approval. Clerk West stated P&Z discussed this and expressed concern regarding line of sight as people turn the corner. Mayor Gubler stated it adheres to the 35' requirement. Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience would like to address the Council regarding this agenda item. Rylea Farrens stated she is concerned about the line of sight and stated if fences are not allowed to be taller than 3' in front of the house, this structure would be taller than 3' and should not be allowed in front of the house. Mayor Gubler reiterated this structure would be 37' from the road, which meets the 35' setback requirement for buildings. Clerk West displayed the Bonneville County Parcel Viewer and explained it shows the property line is very close to the existing home. She continued and agreed the property lines need to be verified prior to approval. Council President Geray asked which Variance section this application would be considered. Attorney Rawlings stated Iona City Code § 11-14-2(A) and read it aloud: "Applications for variances to this Title may be granted when they are not contrary to the public interest, where owing to special conditions, a literal enforcement of the provisions of this Title will result in an unnecessary hardship because of the physical characteristics of the site. A variance is a modification of the requirements of this Title such as minimum lot size, width, depth, setbacks affecting the size or shape of the structure or the placement of the structure upon lots, or the size of the lots. A variance shall not be considered a right or privilege and will only be granted to the applicant if hardship is proven and it is not in conflict with the public interest." Mayor Gubler asked if anyone from the audience would like to address the Council. No response. Mayor Gubler closed the Public Hearing portion of this agenda item to allow for Council deliberation. Council Member Thompson stated he is concerned about the property lines and would like to have Director Prouse verify on site. Mr. Hyde stated no concern with this. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the Variance Application for Todd Hyde at 3213 N. Olsen Street with the condition that the setbacks 4 IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 are met, and the structure does not encroach on any of the City's easements. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Thompson: YES Council Member Wadsworth: YES Council Member Mann: YES Approval of First Amendment to the Annexation Agreement for Harvest Cove — Attorney Rawlings stated this amendment is to include the additional water and sewer hook-ups that were approved tonight,on the drawings and description of the Annexation Agreement. Mayor Gubler entertained a motion. Council Member Mann made a motion to approve the First Amendment to the Annexation Agreement for Harvest Cove. Council Member Thompson seconded the motion. All in favor. Motion carried. Approval of Engagement Letter for Fiscal Year 2022 Audit—Mayor Gubler stated this is the Engagement Letter from Searle Hart &Associates for the City to use their services for the annual audit. Council President Geray stated the "Report on the Firm's System of Quality Control" for Searle Hart & Associates was dated October 2020. He continued and expressed concern there is not a more recent report. Mayor Gubler stated he doesn't have any concern because the City has worked with them for many years. Council President Geray stated he is not objecting to approving it,but would like to see a more recent report, if it is required annually. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Engagement Letter for Fiscal Year 2022 Audit for Searle Hart & Associates, PLLC, subject to any update to the report on the firm's quality control. Council Member Thompson seconded the motion. All in favor. Motion carried. Discussion and Approval of Contract with Bonneville County Library District — Attorney Rawlings stated he has amended the original version of the contract with the Bonneville County Library District (BCLD) and has included three changes to the current version. Those changes include a monthly rent charge of$200, defining activities and events as part of normal `library operations", and the books marked as "Iona Library" may be used throughout all district locations as long as they are returned to the Iona Library. Attorney Rawlings stated he has provided the most recent version of the contract to BCLD's attorney but was informed by her that she has been instructed by the BCLD Board to not review the contract. Attorney Rawlings stated Council Member Mann has been working directly with BCLD. Council Member Mann stated he has discussed the contract with BCLD Director, Michelle Tolman, and she has expressed concern over the rent requirement in the contract. He continued and stated if BCLD would like to offer something additional in services or value in lieu of rent, he believes that can be considered. Attorney Rawlings stated the City's concern is to not end up in a similar situation in the future if BCLD is no longer able to manage the Iona Library. He continued and stated including rent rather than services or values of new books each year is the least complicated way to make that a contractual requirement. Council Member Thompson stated the $200/month would then be used towards the Iona Library to purchase new materials, books, etc. Clerk West agreed and stated all of the rent money collected from BCLD would be used each year towards the Iona Library to ensure the supplies are up to date and in good condition. Council President Geray stated he doesn't understand why the City would collect money each month from BCLD 5 IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 to give it back to them at the end of the year. Clerk West stated it would be used to secure additional assets for the Iona Library. Discussion continued regarding the pros and cons of the option to collect rent to purchase new materials. Council Member Wadsworth expressed concern over losing the opportunity to have a library in Iona because of a debate over $200/month. Council President Geray agreed and suggested removing the rent requirement and evaluate it again upon the renewal in one year. Clerk West stated BCLD would need to be in charge of cleaning the library space and taking out their garbage because the City has now contracted with an outside company to clean the rest of the City Building. Director Tolman with BCLD stated they look forward to providing great library services to the residents of Iona and all of Bonneville County. Clerk West stated the library will be closed the next three days to allow Idaho Falls Public Library (IFPL) to move out of the Iona Library. She continued and said the new bookshelves will be delivered on September 29's and BCLD will be able to move in on October 1 S`. Rylea Farrens suggested BCLD be required to replace books that belong to Iona once they are too worn out for circulation. She continued and explained this would help Iona maintain their catalog of materials. Director Tolman stated Friends of the Iona Library (FOIL) will still be raising funds to purchase new books and materials for the Iona Library. She continued and stated BCLD has already spent $100,000 on new books and currently has approximately 5,500 books of which many will be coming to the Iona Library. Audience members stated their commitment to helping BCLD get up and running, along with many other community members. They expressed the disservice it would be to all of the volunteers that have been working diligently if the City of Iona did not agree to at least a one- year contract with BCLD. All Council Members agreed to proceed with the contract without the rent requirement. Attorney Rawlings stated this contract is an administrative item and does not require a vote. STAFF REPORTS: Clerk West reported that she attended the ICCTFOA Conference last week and earned her Certified Municipal Clerk Treasurer for the State of Idaho (Id-CMCT). She also stated the City employee that cleaned the City Building quit in September. Clerk West stated she calculated the numbers and received many bids from outside companies for cleaning. She continued and stated it will be an annual savings of approximately$5,000 to go that route, rather than hiring another employee and continuing to purchase all of the cleaning supplies. She stated the company she hired will start keeping track of our cleaning supply inventory and will replenish as needed. Deputy Randall stated there have been a few car accidents in the last month. He continued and stated that other than that, nothing much to report. Council President Geray asked about an accident in the school zone. Deputy Randall stated there was a small accident in the school zone, but it was not during school hours. Attorney Rawlings, Council Members Mann,Thompson and Wadsworth stated nothing to report. 6 IONA CITY COUNCIL REGULAR MEETING—SEPTEMBER 27,2022 Council President Geray asked if he is the speaker for the joint Veteran's Day program with the City of Iona and Iona Elementary School. Rylea Farrens confirmed. Discussion continued regarding logistics of the program itself and gifts for the Veterans. SUGGESTED AGENDA ITEMS: None.
