AN ORDINANCE, making an appropriation of Fifteen Million Seven Hundred
Thousand Dollars ($15,700,000.00) from the Sanitary Replacement Fund to be used for sanitary
sewer construction in Caulks Creek Forcemain (River Valley Rd to L-52) (11790) in the City of
Maryland Heights, Missouri; and authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 21951 with Bates
Utility Company, Inc. for sanitary sewer construction.
WHEREAS, the bid for said sanitary sewer construction is Fourteen Million Five
Hundred Seventy-Nine Thousand Eight Hundred Seventy-Seven Dollars ($14,579,877.00) and the
allowance for construction change orders and other project expenses is One Million One Hundred
Twenty Thousand One Hundred Twenty-Three Dollars ($1,120,123.00); and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Fifteen Million Seven Hundred Thousand Dollars
($15,700,000.00) is hereby appropriated from the Sanitary Replacement Fund for sanitary sewer
construction in Caulks Creek Forcemain (River Valley Rd to L-52) (11790) in the City of
Maryland Heights, Missouri; said contract being comprised of such terms and conditions as have
been approved by the Office of the General Counsel of the District.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 21951
with Bates Utility Company, Inc., as the lowest responsible bidder for sanitary sewer construction
in Caulks Creek Forcemain (River Valley Rd to L-52) (11790) in the City of Maryland Heights,
Missouri, pursuant to bids received on the 17th day of September, 2020.
Section Three. This ordinance, being an appropriation ordinance, shall take effect
immediately upon its enactment.
The foregoing ordinance was adopted on December 10, 2020.
