HomeMy Public PortalAbout15561 Union Road 100 Block Storm Improvements (10366)O R D I N A N C E NO. 15561 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Union Road 100 Block Storm Improvements (10366) in Unincorporated St. Louis County, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Unincorporated St. Louis County, Missouri within the Mackenzie Creek Watershed wherein numerous people live and work; and WHEREAS, stormwater gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Union Road 100 Block Storm Improvements (10366) hereinafter set forth, said easements and temporary easements being more particularly described below: Parcel #1 A SEWER EASEMENT being part of Lot 1 and Lot 2 of “Carondelet Commons” recorded in Plat Book 37, Pages 494, of the St. Louis County Records said tract being recorded in deed book 17765, page 4123 of the St. Louis County Records, in St Louis County, Missouri, T.44 N., R. 6 E. and being more particularly described as follows: COMMENCING at the North corner of the aforementioned property described and recorded in deed book 17765, page 4123 of the St. Louis County Records said POINT OF COMMENCEMENT being in the Southeast right-of-way line of Morganford (variable width) Road; THENCE leaving the aforementioned Southeast right-of-way line and along the Northeast property line of the aforementioned tract South 53 degrees, 20 minutes, 56 seconds East a distance of 100.01 feet to a point; THENCE continuing along the aforementioned Northeast property line North 36 degrees, 39 minutes, 04 seconds East a distance of 10.00 feet to a point; THENCE continuing along the aforementioned Northeast property line South 53 degrees, 20 minutes, 56 seconds East a distance of 584.77 feet to a point being the most Eastern property corner of the aforementioned tract; THENCE along the Southeast property line South 55 degrees, 42 minutes, 25 seconds West a distance of 326.41 feet to a point in the property line of the aforementioned tract; said point being the TRUE POINT OF BEGINNING of the herein described SEWER EASEMENT; THENCE North 47 degrees, 14 minutes, 11 seconds West a distance of 17.96 feet to a point; THENCE North 55 degrees, 42 minutes, 25 seconds East a distance of 305.87 feet to a point; THENCE North 53 degrees, 20 minutes 56 seconds West a distance of 294.60 feet to a point; THENCE North 08 degrees, 59 minutes, 29 seconds West a distance of 10.73 feet to a point; THENCE South 53 degrees, 20 minutes, 56 seconds East a distance of 312.79 feet to a point; THENCE South 55 degrees, 42 minutes, 25 seconds West a distance of 158.42 feet to a point; THENCE South 53 degrees, 20 minutes, 56 seconds East a distance of 10.58 feet to a point in the Southeast line of the aforementioned tract of land described in deed book 17765, page 4123 said line also being the North line of a tract of land described in deed book 16709, page 2948 of the St. Louis County Records; Thence along the aforementioned property line South 55 degrees, 42 minutes, 25 seconds West a distance of 157.41 feet to the POINT OF BEGINNING of the herein described SEWER EASEMENT and containing approximately 6,176 square feet or 0.142 acres. A 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT being part of Lot 1 and Lot 2 of “Carondelet Commons” recorded in Plat Book 37, Pages 494, of the St. Louis County Records said tract being recorded in deed book 17765, page 4123 of the St. Louis County Records, in St Louis County, Missouri, T.44 N., R. 6 E. and being more particularly described as follows: COMMENCING at the North corner of the aforementioned property described and recorded in deed book 17765, page 4123 of the St. Louis County Records said POINT OF COMMENCEMENT being in the Southeast right-of-way line of Morganford (variable width) Road; THENCE leaving the aforementioned Southeast right-of-way line and along the Northeast property line of the aforementioned tract South 53 degrees, 20 minutes, 56 seconds East a distance of 100.01 feet to a point; THENCE continuing along the aforementioned Northeast property line North 36 degrees, 39 minutes, 04 seconds East a distance of 10.00 feet to a point; THENCE continuing along the aforementioned Northeast property line South 53 degrees, 20 minutes, 56 seconds East a distance of 243.64 feet to a point; THENCE leaving said Northeast property line South 36 degrees, 39 minutes, 04 seconds West a distance of 10.00 feet to the TRUE POINT OF BEGINNING of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT; THENCE South 53 degrees, 20 minutes, 56 seconds East a distance of 14.30 feet to a point; THENCE South 08 degrees, 59 minutes, 29 seconds East a distance of 10.73 feet to a point; THENCE South 53 degrees, 20 minutes, 56 seconds East a distance of 294.60 feet to a point; THENCE South 55 degrees, 42 minutes, 25 seconds West a distance of 163.17 to a point; THENCE North 49 degrees, 48 minutes, 26 seconds West a distance of 10.38 feet to a point; THENCE North 55 degrees, 42 minutes, 25 seconds East a distance of 151.92 feet to a point; THENCE North 53 degrees, 20 minutes, 56 seconds West 284.64 feet to a point; THENCE North 08 degrees, 59 minutes, 29 seconds West a distance of 25.03 feet to the POINT OF BEGINNING of the herein described 10 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT. THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion of sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing ordinance was adopted on December 10, 2020.
