HomeMy Public PortalAbout3296-1977 - AMENDING ZONING ORDINANCEP, C ORDINANCE NO. 3296-1977 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968, designates and describes as R-4 Multi -Family Resident District, the following described property located on the southeast corner of North 7th & D Streets, in the City of Richmond, Indiana more particularly described as follows: Lot Number Ninety-three (93) in that part of the City of Richmond laid out by Charles W. Starr, and ten (10) feet wide along the south side of said lot, and lying between said lot ninety-three (93) and lot number ninety-two (92) in that part of the City of Richmond laid out by Charles W. Starr and extending the full length of said lot. A strip of ground five (5) feet wide off of the east end of said lot ninety-three (93) and a strip five (5) feet wide off the east end of said ten (10) foot strip has heretofore been dedicated for a public alley. ALSO a part of lot number ninety-two (92) in that part of the City of Richmond laid out by Charles W. Starr, and described as follows, to -wit: Beginning at a point on the east side of north Seventh Street at the northwest corner of said lot number ninety- two (92), thence south twenty-five (25) feet; thence east one hundred and thirty-two (132) feet to an alley; thence north along said alley twenty-five (25) feet to the north line of said lot; thence west along said north line one hundred and thirty-two (132) feet to the place of beginning. SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification on the above described area from R-4 Multi -Family Resident District to C-2 Community Business District, and, SECTION 3. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the o2o 1� day of ��.�.,..1��✓ , 1977, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was G to O in favor of/' recommending the passage of Ordinance No. 3296-1977. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-2 Community Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. ORDINANCE NO. 3296-1977 Page 2 SECTION 7. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accordance with Section 2 of this Ordinance. Z'R'?9 �+ ;vi• 50 North Fifth Street ti RICHMOND, INDIANA 47374 December 22, 1977 Mr. James Carter, President Members of Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 3296-1977 - Plan Commission Case PC-77-16 YMCA, 50 North 8th Street, requesting zoning classifica- tion be changed from R-4 Multi -Family Resident District to C-2 Community Business District for a proposed park- ing lot at North 7th and D Streets (southeast corner) Dear Mr. Carter, Members of the Council and Mrs. Trimble: The Richmond City Planning Commission held a public hearing on Decem- ber 20, 1977 Lo hear thn request of the YMCA to rezone certain property located on the southeast corner of Ncrth 7th and "D" Streets from R-4 Multi -Family Residential to C-2 Community Business. The petition was represented by Mr. David Blackman. No one spoke against the petition; however, Mr. Voyles of Voyles News Agency expressed concern about access of delivery trucks from "D" Street into the.alley between 7th and 8th Streets. Twelve (12) letters were sent to adjoining property owners seeking their opinions, and none were returned either for or against the request. The Planning Commission voted 6-0 to recommend approval of the request to Common Council. Commissioners made note of the fact that this is a spot zoning that is brought about by the actual uses in the area and the fact that the current zoning as R-4 is not a proper classification of the area. The staff pointed out that work currently going on in the department indi- cates that future zoning for this area will probably be requested as C-4 in recognition of all criteria used in making such a determination.
